Supreme Court Justice Scalia Dies During Hunting Trip In Marfa, Texas

February 13, 2016

An El Paso source close to Justice Antonin Scalia tells ABC-7 that the 79-year-old died in his sleep last night after a day of quail hunting at Cibolo Creek Ranch outside of Marfa, Texas.

The Justice did not report feeling ill and retired to his room after dinner. The source, who was traveling with Scalia, told ABC-7 an El Paso priest has been called to Marfa.

Scalia was the longest-serving current Justice on the Supreme Court. He was appointed by President Ronald Reagan in 1986.

Texas Governor Greg Abbott released the following statement:

"Justice Antonin Scalia was a man of God, a patriot, and an unwavering defender of the written Constitution and the Rule of Law. He was the solid rock who turned away so many attempts to depart from and distort the Constitution. His fierce loyalty to the Constitution set an unmatched example, not just for judges and lawyers, but for all Americans. We mourn his passing, and we pray that his successor on the Supreme Court will take his place as a champion for the written Constitution and the Rule of Law. Cecilia and I extend our deepest condolences to his family, and we will keep them in our thoughts and prayers."

Well fuck... He and Thomas were are last, best hopes on the court. RIP Justice Scalia. You were one of the brightest legal minds in the SCOTUS.


It sounds like right now, the Senate won't (hopefully) approve any nominations until after the election and Obama will finish out his term with just 8 justices sitting.

If ever there was a reason to vote for Ted Cruz, this is definitely it. Trump has said he'd nominate his sister Maryanne Trump who is fairly liberal, pro abortion, and was a Clinton nominee to the Third Circuit Court of Appeals for SCOTUS. He has also said he supports the eminent domain travesty of Kelo 100% and would most likely nominate justices that agree with that as well.

WASHINGTON - Republican Senate Majority Leader Mitch McConnell said on Saturday that the next US president should be the one to nominate a justice to fill the vacancy left on the Supreme Court by the death of Antonin Scalia.

"The American people should have a voice in the selection of their next Supreme Court justice. Therefore, this vacancy should not be filled until we have a new president," McConnell said in a statement.

For the authorities who are short on reading comprehension and eager to break out a new armored vehicle to taser my wife in the shower and beat me into submission along with their zeal to fire a 30 mm chain gun into a wood framed house for violating the edicts of some obscure bureaucrat humping their mothers, I must start this article off with this disclaimer:

I am not advocating nor endorsing the murder, assassination, or deaths of any United States Supreme Court justices, ESPECIALLY Scalia and Thomas.

In President Obama’s world of purple unicorns pooping Skittles and rainbows, it is believed that by using armored vehicles and men carrying sub-machine guns (aka, the IRS/FBI/DHS,etc.) will induce people who can not afford privately provided health care insurance to purchase government mandated health care insurance that they can not afford. Unfortunately for the part time employees of America who double as Obama supporters and EBT card testers, you voted for him, you buy it, or they will come to your house and behead your kittens and puppies. Or just stop giving you freebies and seize a sizable portion of your annual tax refund.

The reality is sinking into the propaganda machine as the AP, MSNBCNBCCBSABCCNNAJCNBC, and the Voice of America are not even able to spin the fact that come January 31, 2014 all hell will break loose with those who think they have iron clad subsidy agreements via the exchanges from the Federal government. Starting with January 2014, the next phase of budget sequestration will kick in and a 7.2% reduction in budget allocations for the subsidies will kick into effect for the Federal Exchanges supplying insurance to qualified applicants under the ACA.

The amazing theory behind the professorial hubris known as Obamacare is that each budgetary or actuarial adjustment occurs via Presidential or bureaucratic edict, a private corporation will cause itself injurious harm and accept losses for the greater good. This is the price of placing individuals into positions of power who have never punched a clock, created a business, nor ever signed the front of a check for the purposes of managing their own capitalist enterprise. As this new problem under the sequestration becomes apparent to the regime it is believed that they can order the insurers to accept a Presidential edict and suffer a 7% plus loss on all subsidized policies. What the imperial District of Columbia fails to realize is that for a company to stay in business a profit is mandatory. Thus once the idea of illegally imposed losses becomes part of this flawed business model which provides cover for the survival of Obamacare, individuals within the exchanges will see massive reduction of choices as companies withdraw from the government markets and begin to focus only on employee group plans or high priced “Cadillac” plans that only the upper middle class and wealthy can afford.

But that is not the only shoe yet to drop in 2014. As Americans are finding out as early as October of this year, employee group plans are being severely modified if not outright cancelled; especially for small companies outside of group pools with 50 to 300 employees. This second shoe to drop will increase the number of uninsured citizens from its current levels to anywhere north of sixty to seventy million if some of the pundits touting insurance industry studies are correct. Despite these threats however, the real danger to the existence of Obamacare regardless of functionality truly begin in early 2015.

Causa Causans

The Latin phrase listed above might well be the most dangerous dagger left in American’s final hope to return our nation to a Constitutional Republic and thus reverse the destructive effects and legality of Obamacare. What does this phrase “causa causans” actually mean? From the duhaime.org legal dictionary:

The real, effective cause of damage.

The major reason that no effective challenge to the ACA has been successful is quite simple; no damages to the civil rights, freedoms, nor financial penalties have been inflicted upon any citizen up to this date. While there are several lawsuits challenging various aspects of the Constitutionality of the subsidies created and dispersed by the Internal Revenue Service to states with Federally run exchanges without Congressional approval and in violation of the Affordable Care Act limitations. The case, Civil Action 2013-0623 Halbig, et al v. Sebelius, et al can be viewed here:

Dispensing with the legal phrasing this is but one aspect of the legal battle against Obamacare but the larger issue resides in the United States Constitution and is the great untested aspect of the law as to which Supreme Court Justice John Roberts seemed to taunt both the citizenry and administration with in his overly broad, flawed ruling in 2012. They most important portion of the Constitution which is being tested in the case above and by January 2015 appears in Article 1, Section 7:

All bills for raising revenue shall originate in the House of Representatives; but the Senate may propose or concur with amendments as on other Bills.

Causation is the primary reason no individual has had the ability to bring forth a case challenging Obamcare using the Constitutional clause listed above. Since the ACA originated in the U.S. Senate and was only deemed Constitutional within Justice Robert’s ruling if the penalty is interpreted as a tax, the act itself demanding an individual mandate is unconstitutional. However, that can not be causation alone as no individual has been damaged by the ACA nor paid a penalty until January 2015 at the earliest (provided the IRS can produces the necessary tax forms and documentation to permit early filing).

Thus once one of us enterprising patriotic American citizens(1) who is willing to accept the enmity of the U.S. government up to and including harassment and financial assault by filing their taxes, paying the 1% penalty, and then filing a lawsuit, a new fast track will be created which barring a miracle should be heard by the entire Supreme Court before the 2015 term is over. This challenge is truly the one complex case which resides on a singularly obvious aspect of the founding rules of law within the Constitution and thus have the most merit and should destroy the legality and functionality of the entire act.

Sadly, time is the greatest enemy of both the complaint filed above and the individual mandate challenge which threatens our Republic. For Obamacare to survive the upcoming legal challenges, Supreme Court Justices Scalia and Thomas must pass away as soon as possible and this glaring fact is front and center within the thinking of the Obama regime. Unlike the mistakes of other Marxist/Progressive predecessors like Franklin Delano Roosevelt, Obama has elected to circumvent the Constitution at will leaving the greater legal issues to be decided at the end of his second term where he had hoped to pack the courts with other extremists jurists like Sotomayor and Kagan.

If the two justices are still alive in the October-November 2014 time period leading up to the mid-term elections, the Republicans would be foolish not to point out the dangers of failing to re-take the Senate to blunt any efforts to install more activists judges who will usurp the U.S. Constitution. If the Senate suddenly has a Republican majority and the first case reaches the court, followed shortly by the second one, the Court will have little choice but to adhere to the strictest of interpretations otherwise any bureaucrat at any level can create subsidies, cash disbursements, or impose taxation to or upon anyone without Congressional authorization thus de facto voiding Article 1, Section 7.

It is up to every American to pray for Supreme Court Justices Scalia and Thomas to survive well into 2015 and hopefully force the court to reconcile the most egregious flaws within the Obamacare act. May they avoid polonium cocktails and lunches at the White House until these cases are heard within their realm.

President Obama Announces Intent to Nominate Replacement for Justice Scalia

President Obama has announced his intent nominate a replacement for Supreme Court Justice Antonin Scalia, who was found dead in Texas today.

"These are responsibilities that I take seriously as should anyone," Obama said of his constitutional power to nominate in the case of a vacancy. "They are bigger than any one party."

The move sets up a major political battle in the president's final year in office. Senate Majority Leader Mitch McConnell said in a statement today that Scalia's seat should not be filled until the American people elect a new president.

In a statement released this evening, McConnell said: "The American people should have a voice in the selection of their next Supreme Court Justice. Therefore, this vacancy should not be filled until we have a new President."

Senate Democrats were just as adamant that Obama should nominate a new justice, and said they will attempt to keep Republicans from dragging out the confirmation process.

"It would be unprecedented in recent history for the Supreme Court to go a year with a vacant seat," said Senate Minority Leader Harry Reid of Nevada. "Failing to fill this vacancy would be a shameful abdication of one of the Senate's most essential constitutional responsibilities."

Without Scalia, the court is evenly divided between four conservative and four liberal justices, which could make the leaning of Scalia's replacement a key to court decisions.

The president didn’t directly address McConnell’s statement, saying the day should be used to remember Scalia, a "larger than life" figure who "dedicated his life to the cornerstone of our democracy -- the rule of law."

Following his statement, the president issued a proclamation ordering flags to be flown at half-staff in honor of Scalia.

Sri Srinivasan, who is he? Scalia's possible replacement?

Shortly after news broke that Supreme Court Justice Antonin Scalia had passed many started speculating who his successor would be if President Barack Obama were to nominate the next Supreme Court Justice.

One name floated frequently was Sri Srinivasan, who The New Yorker described as "the nominee in waiting."

Srinivasan, according to The New Yorker is "the Obama Administration's principal deputy solicitor general."

"He's had twenty or so arguments in the Supreme Court, including part of the Administration's attack on the Defense of Marriage Act last month. "

Srinivasan was nominated to the U.S. Court of Appeals for D.C. in 2012, at which time the President described him as "a highly-respected appellate advocate who has spent a distinguished career litigating before the U.S. Supreme Court."

According to a release by The White House at the time of his nomination, Srinivasan "began his legal career by serving as a law clerk for Judge J. Harvie Wilkinson on the U.S. Court of Appeals for the Fourth Circuit ."

Srinivasan also spent a year as a fellow in the office of the Solicitor General and clerked for Sandra Day O'Conner, The White House said.

After serving as an associate at O'Melveny & Myers LLP, Srinivasan returned to the Solicitor General's Office to work as an Assistant to the Solicitor General.

While serving in that post, Srinivasan represented the United States "in litigation before the Supreme Court," according to The White House.

As The New Yorker noted, Srinivasan " is currently the Obama Administration's principal deputy solicitor general."

The Stanford educated potential nominee received his bachelor degree, law degree and J.D. from California school. While Srinivasan was born in Chandigarh, India he grew up in Lawrence, Kansas, according to The White House.

Srikanth Srinivasan, of Virginia, was nominated to the U.S. Circuit Court Judge for Washington D.C. in May 2013. The tally was 97-0, including votes U.S. Senate Majority Leader Mitch McConnell and Presidential candidates Ted Cruz and Marco Rubio.

Flashback: Hillary Loves The Idea Of Appointing Obama To Supreme Court



She doesn’t get charged by DOJ and if she wins, then he gets the Supreme Court nod.

Democratic presidential front-runner Hillary Clinton said she “loves” the idea of appointing Barack Obama to the Supreme Court if she’s elected president.
At a campaign event in Iowa Tuesday, Mrs. Clinton told the crowd the next president may have to appoint up to three Supreme Court justices. When one attendee mentioned Mr. Obama as a contender, she seemed excited by the recommendation.
“Wow, what a great idea. No one has ever suggested that to me, I love that, wow,” Mrs. Clinton said. “He may have a few other things to do, but I tell you, that’s a great idea.
“I mean, he’s brilliant, he can set forth an argument and he was a law professor,” she added. “So he’s got all the credentials, but we would have to get a Democratic Senate to get him confirmed.”

Ted Cruz: Honor Justice Scalia by Preventing Obama from Choosing His Replacement

Sen. Ted Cruz, following the tragic death of Supreme Court Justice Antonin Scalia, pledged to honor his name by asking his followers to help prevent Barack Obama from nominating his replacement to the nation’s highest court.

Justice Scalia, one of the court’s most steady Constitutional voices for decades, passed away at his West Texas ranch on Saturday. The 79-year-old died of natural causes, according to reports.

Cruz took to social media, stating:

Justice Scalia was an American hero. We owe it to him, & the Nation, for the Senate to ensure that the next President names his replacement.

Sen. Cruz also issued the following statement regarding Scalia’s passing:

As liberals and conservatives alike would agree, through his powerful and persuasive opinions, Justice Scalia fundamentally changed how courts interpret the Constitution and statutes, returning the focus to the original meaning of the text after decades of judicial activism. And he authored some of the most important decisions ever, including District of Columbia v. Heller, which recognized our fundamental right under the Second Amendment to keep and bear arms.
