    Hmmm....

    Star Trek: Axanar
    Our 20-minute short film, Prelude to Axanar, premiered Saturday, July 26th, 2014, at San Diego Comic Con and features Richard Hatch, Tony Todd, Kate Vernon, JG Hertzler and Gary Graham, who reprises his role of Soval from "Enterprise". The makeup was done by Academy Award winner Kevin Haney and Star Trek veteran Brad Look and Make Up Effects Lab. Top that off with the amazing visual effects of Tobias Richter and The Light Works, and sound by Academy Award winner Frank Serafine, and the result is Prelude to Axanar: something unlike anything you have ever seen before. We have our loyal donors to thank for this!

    This Kickstarter is for the full-length feature Axanar. Unlike the short film, which we shot in two days and cost $75,000, the 90-minute Axanar feature will take about 20 days and cost about $650,000. So we are breaking up our costs into discreet sections which should allow us to reach significant milestones, as we don't expect to raise all $650,000 at once. This first Kickstarter will be for the sound stage and set construction. Anything over what we need for that will be applied to the feature production costs. Full details are below.
    Axanar takes place 21 years before the events of “Where no Man Has Gone Before”. It tells the story of Garth of Izar, the legendary Starfleet captain who is Captain Kirk’s hero and the role model for a generation of Starfleet officers. Garth charted more planets than any other Captain and was the hero of the Battle of Axanar. His exploits are required reading at Starfleet Academy.

    Me too, had to go back and look at the whole Star Trek timeline to see how it all fits.

    Your post made me curious about this issue so I did some looking.

    Turns out there is actually split ownership of the Star Trek franchise currently. Here's what I got from Memory Alpha:
    TV - CBS Television Distribution, CBS Paramount Network Television/CBS Television Studios, CBS Corporation (2005 – present)
    Viacom had purchased the CBS Corporation in 2000. They split in 2005. The old Viacom then became the CBS Corporation. Its holding Paramount Television became CBS Paramount Network Television. CBS Television Distribution formed soon after and took over distribution of past Star Trek shows. In 2009, CBS Paramount Network Television became CBS Television Studios; CBS Television Studios has production rights for new Trek series, though it has not (yet) produced any under that name.
    Movies, DVDs - Paramount Pictures, Viacom (new) (2005 – present)
    In the 2005 Viacom/CBS split, the old Viacom became the CBS Corporation and a new Viacom was created. This new company owns Paramount Pictures which owns the Trek films. Paramount Pictures produced Star Trek and Star Trek Into Darkness under license from CBS Television Studios. Paramount continues to also distribute DVDs of the TV series on behalf of CBS.
    And it turns out this question is the first thing listed in their FAQ:
    Is Star Trek licensed by CBS/Paramount?

    No, Star Trek: Axanar is an independent project that uses the intellectual property of CBS under the provision that Axanar is totally non-commercial. That means we can never charge for anything. We will never sell the movie, DVD’s, T-shirts, or anything which uses CBS intellectual property.
    So it sounds like they met with them and this is what was agreed upon.

    Interesting that CBS would be so generous in allowing its IP to be used but, good on them for it.

    Guess I should have RTFM.. lol. Not to mention not make the embarrassing mistake of mixing up Star Wars and Star Trek.

    Even though they aren't ever charging for anything, it still seems risky for CBS to allow this. Reminds me of the episode of SpongeBob SquarePants where Plankton is giving away free "Krabby Patties", but they are just crap so everyone starts assuming the real ones are horrible too.

    Exactly! That's why I'm surprised this had their blessing.

    Maybe it's because of the fairly strong cast. All of those folks are veteran actors of the SciFi variety.

    Well, I guess now that CBS is planning on launching a new TV series, they can't have any independent production upstaging their CGI/lens flare sploogefest that tries too hard to be hip like the new movies.


    Crowdfunded STAR TREK Fan Film Slapped With A Lawsuit From Paramount Pictures

    December 30, 2015

    Earlier this year, a prelude to a Star Trek fan film was released called Axanar. I've posted that 21-minute short for you to watch below. That short was crowdfunded and it served as a stepping stone to a much larger project. The team that made that launched another crowdfunding campaign on Indiegogo for a full-length feature film, and so far it has raised over $1.13 million.

    Over the years, Paramount and CBS — the rights holders to the Star Trek franchise — have supported fan films and even encouraged them at times! But this week they slapped the production company of this Star Trek film with a lawsuit. I guess it just got too big for them, and they felt threatened by it.

    It probably didn't help that Axanar is officially described as the "first independent" Star Trek film, and not a fan film. Here's the official description of the project:

    Axanar is the first fully-professional, independent Star Trek film. While some may call it a "fan film" as we are not licensed by CBS, Axanar has professionals working in front and behind the camera, with a fully-professional crew--many of whom have worked on Star Trek itself--who ensure Axanar will be the quality of Star Trek that all fans want to see.

    For you, the Star Trek fan, Axanar is a return to the type of Star Trek all of us grew up on, with a hopeful future where mankind works with other races to explore the stars, via storytelling that is positive and teaches us about ourselves. Axanar feels like Star Trek because it is made by two of the biggest Star Trek fans in the world, Alec Peters and Robert Burnett. Alec was the executive producer/co-writer of Prelude to Axanar, and Rob wrote & directed Free Enterprise.

    The producers of the film, including Alec Peters, are obviously looking to make a studio-quality film. Apparently veteran Star Trek actor George Takei has even helped push the film forward. It's easy to see why Paramount is going after them.

    According to the lawsuit that was filed, "The Axanar Works infringe Plaintiffs’ works by using innumerable copyrighted elements of Star Trek, including its settings, characters, species, and themes."

    Here's the description of the film itself, and what the story will entail:

    "Axanar takes place 21 years before the events of 'Where no Man Has Gone Before,' the first Kirk episode of the original Star Trek. Axanar is the story of Garth of Izar, the legendary Starfleet captain who is Captain Kirk’s hero ... Axanar tells the story of Garth and his crew during the Four Years War, the war with the Klingon Empire that almost tore the Federation apart. Garth’s victory at Axanar solidified the Federation and allowed it to become the entity we know in Kirk’s time. It is the year 2245 and the war with the Klingons ends here."

    It sounds like it would be a pretty awesome film! It's a shame that Paramount is trying to shut it down, but they do have every legal right to do so. Peters didn't think there would be any legal issues with the film because he has met with CBS and Paramount regarding it, and it seemed to him like everything would be fine as long as the movie didn't make any money upon its release.

    When talking to The Wrap, Peters said, "CBS has a long history of accepting fan films. I think Axanar has become so popular that CBS realizes that we’re just making their brand that much better." I guess the studio had a change of heart.

    According to THR, "Paramount and CBS, represented by attorneys at Loeb & Loeb, are now demanding an injunction as well as damages for direct, contributory and vicarious
    copyright infringement. Although the plaintiffs have allowed ample cosplaying over the years and even permitted other derivatives like amateur Star Trek shows to circulate, the lawsuit illustrates that there is a place where no man has gone before, where the entertainment studios are not willing to let be occupied: Crowdfunded, professional-quality films that use copyrighted 'elements' like Vulcans and Klingons, Federation starships, phasers, and stuff like the 'look and feel of the planet, the characters’ costumes, their pointy ears, and their distinctive hairstyle.'"

    Maybe the studio should have told Peters that when they initially met with him regarding the project. Seems to me like they gave the talented people involved with this production a false sense of hope.


    I thought Renegades was decent with what they were working with but was really looking forward to Axanar because it showed a real serious effort at production and professionalism. Too bad...

    I was planning on signing up for the CBS All Access to support the new show to help show there's support out there for a new Star Trek TV series but now, I think I'm going to just stick to torrenting the episodes.
