    Federal Court Halts Trump’s Immigration Ban

    Deportations are suspended, but a long fight is yet to come

    The federal court for the Eastern District of New York issued an emergency stay halting deportations under President Donald Trump’s executive order banning entry to the US from seven majority-Muslim countries tonight, following widespread protests at airports around the country.

    The court order prevents the government from sending immigrants back to their home countries because it would cause them “irreparable harm,” but it is unclear if they will have to remain in detention until a substantive ruling on the constitutionality of the ban is delivered. “If someone is not being released, I guess I’ll just hear from you,” Judge Ann Donnelly told the plaintiff’s lawyers, according to the New York Times.

    People affected by the order with valid greencards and visas who were not in transit at the time are still likely stuck abroad, but there’s now at least a time frame for a further ruling on the ban.








    The court ruled on a habeas corpus petition filed by the ACLU on behalf of Hameed Khalid Darweesh and Sameer Abdulkhaleq Alshawi, who were denied entry to the US upon landing at JFK airport in New York City and detained indefinitely by Customs and Border Patrol. Darweesh spent a decade working for the United States military in Iraq as an interpreter and engineer and had been granted an entry visa after background checks; Alshawi had been granted a visa in order to join his wife and son who are already permanent residents of the US after similar interactions with the US military.




    The court specifically ruled on Darweesh and Alshawi’s petition; other similarly-situated people being detained and those in transit are covered by the ruling, which is only temporary. But the point of a stay is to preserve the status quo while a permanent ruling is made — something the judge specifically reminded the lawyers for the goverment in the courtroom. And as the tweet from the National Immigration Law Center’s Jackie Vimo indicates above, the judge feels there is a likelihood of success on the merits for the case moving forward.




    Trump’s executive order halts all immigration from Iraq, Iran, Libya, Somalia, Sudan, Yemen, and Syria. The ban was issued late on Friday, leading to widespread confusion about how it would be implemented and enforced, chaos as those decisions were made quickly and without a great deal of transparency, and controversy as the essential legality of a ban that effectively targets Muslims was called into question.




    Protests have erupted at airports around the country in response to the ban, and the tech industry has signaled significant opposition to it in tones ranging from measured to morally outraged.

    It’s clear that the White House will argue to have the executive order reinstated as soon as possible while it fights to show the ban is constitutional.

    Rights groups have filed a lawsuit in a New York court to demand the release of refugees in transit who have been detained at John F Kennedy airport.

    Entry to the US for nationals of seven Muslim-majority countries has been stopped for 90 days by Donald Trump.

    The exact implications of his order remain unclear. The US State Department has told the BBC it is working on the immediate implementation of the ban.

    People fleeing Syria are banned until further notice.

    The two Iraqi refugees detained in New York, one of whom had worked as a US Army interpreter, were in transit when the executive order was signed on Friday.

    The National Immigration Law Centre (NILC) told the BBC that it was suing President Trump and the secretary of the Department of Homeland Security.


    It described the two Iraqis as "courageous Haneed Khalid Darweesh, who interpreted for US army & Haider Sameer Alshawi also targeted for aiding US military".

    The organisation had been unable to speak to the two men, it said.

    The American Civil Liberties Union (ACLU) is one of several other rights groups also involved in the lawsuit, filed in the Eastern District of New York on Saturday morning.


    Lawyers are "keeping tabs on several flights" the NILC told the BBC, but did not have a full number of people who had been detained at US airports.

    On Saturday several Iraqi passengers and a Yemeni national were prevented from boarding a flight at Cairo airport bound for New York, despite holding valid visas for the US.

    Google has urged travelling staff members who are nationals of the seven countries affect to return to the US as quickly as possible.

    Friday's wide-ranging order includes the following measures:

    The suspension of the entire US refugee admissions programme for 120 days
    A ban on all refugees from Syria until "significant changes" are made
    A 90-day suspension on anyone arriving from Iraq, Syria, Iran, Libya, Somalia, Sudan, and Yemen, except certain visa categories such as diplomats
    Priority for future refugee applications from those persecuted for their religion - but only if the person is part of a minority religion in their home country
    A cap of 50,000 refugees in 2017 - less than half of the upper limit under Mr Trump's predecessor, Barack Obama

    Mr Trump signed the order on Friday, which was International Holocaust Remembrance Day.

    The president's statement to mark that occasion, on the 72nd anniversary of the liberation of Auschwitz, made no mention of Jews or anti-Semitism.

    In response to Mr Trump's order, the United Nations refugee agency said the needs of those fleeing conflict had never been greater.

    The Council on American Islamic Relations (CAIR) also says it will file a lawsuit.

    There have been reports of "green card" holders, who are legal permanent residents of the US, being prevented from getting on flights. However, green cards are not specifically mentioned in the executive order, and so the status of green card holders remains unclear.

    CAIR advised non-US citizens, including permanent residents, from the seven countries to plan to delay all international travel for at least 90 days.

    Mr Trump said the measures detailed in his executive order would "keep radical Islamic terrorists out of the US".

    But rights groups say there is no link between Syrian refugees in the US and terrorism.

    The sudden and severe immigration restrictions imposed on passport holders from seven Muslim countries could seriously demonstrate the law of unintended consequences. The president wants to restrict some Muslims but the effect could be to damage America's most important and profitable sector: technology.

    Google has recalled around 100 of its affected staff from overseas. Microsoft has warned its shareholders that curbs on immigration could have a material impact on its business.

    The technology sector relies heavily on highly skilled and well-paid workers from overseas on H1-B visas. If there's a risk, however small, that that brainpower could be restricted in some way or scare off others who may feel unwelcome, the big tech companies may have to rethink where they place their key staff in future.

    Some Republicans have welcomed Mr Trump's announcement, including the Speaker of the House of Representatives, Paul Ryan, who said it was "time to re-evaluate and strengthen the visa vetting process".

    The order also said all immigration programmes should include questions to "evaluate the applicant's likelihood of becoming a positively contributing member of society."

    Other measures include a broad review of the information required from all countries to approve a visa; a review of visa schemes between nations to ensure they are "truly reciprocal" for US citizens; and the immediate suspension of the Visa Interview Waiver Programme.

    But the document says exceptions could be made on a case-by-case basis.

    During the election campaign, Mr Trump suggested a "total and complete shutdown of Muslims entering the United States until our country's representatives can figure out what is going on".

    It is time for those associated with the courts in America, who are intent on exposing Americans to terror attacks, be subject to their actions in the latest treacherous attempt by the ACLU and two federal Judges who have stopped the deportation of foreigners from America.

    U.S. District Judge Ann Donnelly of New York, and US District Judge Brinkema of Virginia, in siding with the ACLU, have given American Rights to non Americans, who were in custody of the Government and being deported.

    Included in this, is the reality that almost 60% of these foreigners once out of detention "disappear".

    It is paramount for the Trump Administration to not only appeal these actions endangering Americans, but place this entire group on notice that it does not require one terror event to occur in America or against Americans overseas in this time, that this group's actions is giving aid and comfort to terrorists, and is criminally responsible and are accomplices to the terror event.
    This group must face full and immediate prosecution.

    Seriously, at least bin Laden's family had sense to flee America, but in the case of these 3rd world squatters, they are inflicting upon Americans, and have the ACLU using American courts against the American People.

    When enough of these liberals are charged, convicted speedily in courts, ruined financially and placed into Gitmo detention for life in aiding terrorists, these pompous court officials will soon enough be scurrying away.

    This is what the 2016 elections were all about in Americans being fed up with the entire police state protecting foreigners and criminalizing Americans trying to protect themselves. It is time the persecutors of Americans be held responsible in the US Courts.

    US judge bars deportations under Trump travel ban

    WASHINGTON (AP) -- A federal judge issued an emergency order Saturday night temporarily barring the U.S. from deporting people from nations subject to President Donald Trump's travel ban, saying travelers who had been detained had a strong argument that their legal rights had been violated.

    The Department of Homeland Security issued a statement early Sunday that said the court order would not affect the overall implementation of the White House order and the court order affected a small number of travelers who were inconvenienced by security procedures upon their return.

    "President Trump's Executive Orders remain in place-prohibited travel will remain prohibited, and the U.S. government retains its right to revoke visas at any time if required for national security or public safety," according to the DHS statement. Stephen Miller, a senior adviser to the White House, said: "Nothing in the Brooklyn judge's order in anyway impedes or prevents the implementation of the president's executive order which remains in full, complete and total effect."

    U.S. District Judge Ann Donnelly in New York issued the emergency order after lawyers for the American Civil Liberties Union filed a court petition on behalf of people from seven predominantly Muslim nations who were detained at airports across the country as the ban took effect.

    The judge's order addressed only a portion of Trump's executive action. As the decision was announced, cheers broke out in crowds of demonstrators who had gathered at American airports and outside the Brooklyn courthouse where the ruling was issued.

    The order barred U.S. border agents from removing anyone who arrived in the U.S. with a valid visa from Iraq, Syria, Iran, Sudan, Libya, Somalia and Yemen. It also covered anyone with an approved refugee application.

    It was unclear how quickly the judge's order might affect people in detention, or whether it would allow others to resume flying. The White House said the court ruling affected a small number of people who had boarded planes before the White House order was issued.

    Homeland Security said those travelers "were inconvenienced while enhanced security measures were implemented. These individuals went through enhanced security screenings and are being processed for entry to the United States, consistent with our immigration laws and judicial orders."

    But the detention of the travelers caused a great deal of confusion.

    "Realistically, we don't even know if people are going to be allowed onto the planes," said ACLU lawyer Lee Gelernt. "This order would protect people who they allow to come here and reach U.S. soil."

    Under Trump's order, it had appeared that an untold number of foreign-born U.S. residents now traveling outside the U.S. could be stuck overseas for at least 90 days even though they held permanent residency "green cards" or other visas. However, an official with the Department of Homeland Security said Saturday night that no green-card holders from the seven countries cited in Trump's order had been prevented from entering the U.S.

    Some foreign nationals who were allowed to board flights before the order was signed Friday had been detained at U.S. airports, told they were no longer welcome. The DHS official who briefed reporters by phone said 109 people who were in transit on airplanes had been denied entry and 173 had not been allowed to get on their planes overseas.

    In her three-page order, Donnelly wrote that without the stay "there will be substantial and irreparable injury to refugees, visa-holders and other individuals from nations subject to the Jan. 27, 2017, executive order."

    Trump billed his sweeping executive order as a necessary step to stop "radical Islamic terrorists" from coming to the U.S. It included a 90-day ban on travel to the U.S. by citizens of Iraq, Syria, Iran, Sudan, Libya, Somalia or Yemen and a 120-day suspension of the U.S. refugee program.

    Trump's order singled out Syrians for the most aggressive ban, indefinitely blocking entry for anyone from that country, including those fleeing civil war.

    The directive did not do anything to prevent attacks from homegrown extremists who were already in America, a primary concern of federal law enforcement officials. It also omitted Saudi Arabia, home to most of the Sept. 11 hijackers.

    As a candidate Trump pledged to temporarily ban Muslims from coming to the U.S., then said he would implement "extreme vetting" for people from countries with significant terror concerns. He told reporters Saturday the order is "not a Muslim ban."

    "It's working out very nicely," Trump said of the implementation of his order. "We're going to have a very, very strict ban and we're going to have extreme vetting, which we should have had in this country for many years."

    The order sparked protests at several of the nation's international airports, including New York's Kennedy and Chicago's O'Hare and facilities in Minneapolis and Dallas-Fort Worth. In San Francisco, hundreds blocked the street outside the arrival area of the international terminal. Several dozen demonstrated at the airport in Portland, Oregon, briefly disrupting light rail service while hoisting signs that read "Portland Coffee Is From Yemen" and chanting anti-Trump slogans. U.S. lawmakers and officials around the globe also criticized the move.

    Two of the first people blocked from entering the United States were Iraqis with links to the U.S. military. Hameed Khalid Darweesh and Haider Sameer Abdulkhaleq Alshawi were detained by immigration officials after landing at New York's Kennedy airport Friday night. Both had been released by Saturday night after their lawyers intervened.

    The government can exempt foreign nationals from the ban if their entry is deemed in the national interest. But it was not immediately clear how that exemption might be applied.

    Diplomats from the seven countries singled out by Trump's order would still be allowed into the U.S.

    Those already in the U.S. with a visa or green card would be allowed to stay, according to the official, who wasn't authorized to publicly discuss the details of how Trump's order was being put in place and spoke only on condition of anonymity.

    Trump's order also directed U.S. officials to review information as needed to fully vet foreigners asking to come to the U.S. and draft a list of countries that don't provide that information. That left open the possibility that citizens of other countries could also face a travel ban.

    The U.S. may still admit refugees on a case-by-case basis during the freeze, and the government would continue to process requests from people claiming religious persecution, "provided that the religion of the individual is a minority religion in the individual's country."

    The Council on American-Islamic Relations said it would challenge the constitutionality of Trump's order.

    "There is no evidence that refugees - the most thoroughly vetted of all people entering our nation - are a threat to national security," said Lena F. Masri, the group's national litigation director. "This is an order that is based on bigotry, not reality."

    John Cohen, a former Department of Homeland Security counterterrorism official who worked under Democratic and Republican administrations, said the order didn't address America's "primary terrorism-related threat" - people already in the U.S. who become inspired by what they see on the internet.

    Trump's order drew support from some Republican lawmakers who have urged more security measures for the refugee vetting program, particularly for those from Syria.

    It is unclear how many people would be immediately impacted by the non-refugee travel ban. According to the statistics maintained by the Homeland Security Department, about 17,000 students from the seven designated countries were allowed into the U.S. for the 2015-2016 school year. In 2015 more than 86,000 people from those countries arrived in the U.S. on other, non-immigrant visas and more than 52,000 others became legal permanent residents.

    Last year the U.S. resettled 85,000 people displaced by war, political oppression, hunger and religious prejudice, including more than 12,000 Syrians. Before leaving office President Barack Obama announced that the U.S. would accept 110,000 refugees in the coming year, but Trump's order cut that by more than half to 50,000.

    The MSM is lying about Fed Judge order contermanding Trumps EO

    The MSM would have you believe that the Federal Judge's order to allow a couple of previously issued visa holders from moslem countries to enter the US was a cancellation of President Trumps EO.

    It does no such thing.

    It is actually very limited in scope. It applies to about 200 people worldwide.It allows people who have a previously issued visa to come into the US instead of being held at the airport.
    The Judges ruling merely cleared the airports of people who were already in transit when it went into affect. It does not question the legality of the EO, and the airlines are already denying people affected by the EO from even boarding a flight to the US.

    Also the judges order has no effect on people, even with visas, who have not already started their flights to the US. Those people will not be allowed to come to the US.

    President Trump's EO is still legal and still bans people from those seven countries from entering the US, BUT it is obvious that the President needs a Secretary of State and an Attorney General RTFN.
    Much of this chaos could have been avoided if Trump had those two vacancies filled and had an effective State Department and Justice Department. McConnell needs to have a fire lit under his ass to get the cabinet nominees approved.

    New York Federal Judge Intercedes To Clear Airports of Current Limbo Visa Holders…

    While there is much pontification and opinion about a judicial ruling by New York Judge Ann Donnelly, the decision is actually quite narrow. The judge’s involvement is specifically and narrowly only targeted to current permitted visa holders who were in the limbo zone between travel (during XO) and the denial of entry upon landing.

    Despite the insufferable airport protests being promoted on U.S. MSM, there are less than 200 people nationwide who were in the limbo zone. The ruling stops DHS from forcibly turning around a group of currently valid visa holders arriving from Iran, Iraq, Libya, Somalia, Sudan, Syria and Yemen. Nothing more.

    NEW YORK […] U.S. District Judge Ann M. Donnelly ordered a halt to any removal of refugees or others who hold valid visas to enter the United States—meaning those who have arrived at U.S. airports from the seven predominantly Muslim countries named under the President’s executive order can remain, for now.
    The judge did not rule on the legality of the executive order, nor did she say that others who have not yet arrived in the U.S. can be allowed to proceed. [She’s simply clearing the airports.]

    DHS Will Continue To Enforce Trump's Travel Ban

    January 29, 2017

    The Department of Homeland Security issued a statement early Sunday saying that they plan on continuing to “enforce all of the president’s executive orders in a manner that ensures the safety and security of the American people.”

    The DHS said the court order would not affect the overall implementation of the White House order and the court order affected a small number of travelers who were inconvenienced by security procedures upon their return.

    “The president’s executive orders remain in place—prohibited travel will remain prohibited, and the U.S. government retains its right to revoke visas at any time if required for national security or public safety,” the statement said.

    A federal judge issued an emergency order Saturday night temporarily barring the U.S. from deporting people from nations subject to President Donald Trump's travel ban, saying travelers who had been detained had a strong argument that their legal rights had been violated.

    Stephen Miller, a senior adviser to the White House, said, "Nothing in the Brooklyn judge's order in anyway impedes or prevents the implementation of the president's executive order which remains in full, complete and total effect."

    U.S. District Judge Ann Donnelly in New York issued the emergency order after lawyers for the American Civil Liberties Union filed a court petition on behalf of people from seven predominantly Muslim nations who were detained at airports across the country as the ban took effect.

    The order barred U.S. border agents from removing anyone who arrived in the U.S. with a valid visa from Iraq, Syria, Iran, Sudan, Libya, Somalia and Yemen. It also covered anyone with an approved refugee application.

    Homeland Security said the order affects a small amount of people traveling internationally.

    The DHS said the order was the “first step towards reestablishing control over America's borders and national security.”

    Trump’s travel ban sparked protests around the country at several international airports. Demonstrators ranged from a few dozen people to thousands.

    Under Trump's order, it had appeared that an untold number of foreign-born U.S. residents now traveling outside the U.S. could be stuck overseas for at least 90 days even though they held permanent residency "green cards" or other visas. However, an official with the DHS said Saturday night that no green-card holders from the seven countries cited in Trump's order had been prevented from entering the U.S.

    Trump billed his sweeping executive order as a necessary step to stop "radical Islamic terrorists" from coming to the U.S. It included a 90-day ban on travel to the U.S. by citizens of Iraq, Syria, Iran, Sudan, Libya, Somalia or Yemen and a 120-day suspension of the U.S. refugee program.

    Trump's order also drew support from some Republican lawmakers who have urged more security measures for the refugee vetting program.

    The DHS said in the statement that they “will faithfully execute the immigration laws, and we will treat all of those we encounter humanely and with professionalism.” They also added that they plan to ensure the safety of the American people by making sure those entering the U.S. pose no threat.

    TEL AVIV – Amid the furor over President Donald Trump’s executive order temporarily halting refugees while the government can revamp its flawed screening process, it may be instructive to recall that President Obama in 2011 reportedly quietly suspended the Iraq refugee program for six months over terrorism fears.

    In 2013, ABC News first revealed that two years earlier, the State Department had imposed a freeze over the processing of Iraqi refugees for six months. The halt was the result of the discovery of two al-Qaida members admitted as refugees from Iraq who were living in Bowling Green, Kentucky and who had admitted to targeting U.S. troops in Iraq.

    The network also cited FBI agents conceding that “several dozen suspected terrorist bombmakers, including some believed to have targeted American troops, may have mistakenly been allowed to move to the United States as war refugees.”

    ABC News reported on the six month refugee freeze (emphasis added):
    As a result of the Kentucky case, the State Department stopped processing Iraq refugees for six months in 2011, federal officials told ABC News – even for many who had heroically helped U.S. forces as interpreters and intelligence assets.
    Trump’s executive order halts visas for 90 days for “immigrants and non-immigrants” from Syria, Somalia, Sudan, Libya, Yemen, Iran, and Iraq. The executive order further suspended the entry of all refugees for 120 days, indefinitely blocks Syrian refugees from entering and lowers the ceiling to 50,000 for refugees allowed to enter the U.S. during Fiscal Year 2017.

    In response to the order, protests have taken place outside major U.S. airports while immigration lawyers from groups financed by billionaire George Soros, a champion of open border policies, were signatories to a lawsuit filed Saturday to block the order.

    In response to the lawsuit, U.S. District Judge Ann Donnelly issued an emergency order that temporarily blocks U.S. authorities from deporting those from the nations listed in Trump’s executive order.

    German Chancellor Angela Merkel released a New Year’s message earlier this month calling on Germans to “use love and compassion” to battle the Islamist extremists in their communities.

    Islamists extremists murdered 22 people in Germany in 2016 in seven different attacks.



    Germany, a country of 80 million, received over one million migrants and unvetted “refugees” in 2015. Chancellor Angela Merkel expected another million migrants in 2016.
    For New Year’s she called on Germans to use love and compassion to battle Islamic extremists on German soil.

    Good Lord.

    The rape of a ten-year-old girl in Leipzig, the largest city in Saxony, has drawn renewed attention to the spiraling levels of violent crime perpetrated by migrants in cities and towns across Germany — and the lengths to which German officials and the media go to censor information about the perpetrators of those crimes.

    A MIGRANT turf war erupted into violence on the streets of one of Paris' trendiest neighborhoods early this morning as asylum seekers beat each other to a pulp with wooden clubs.

    The blood-curdling brawl erupted just yards from the Stalingrad Metro station, where a squalid migrant camp has popped up following the demolition of the Jungle.

    It was not immediately clear what sparked the early morning fight, but rival gangs of people smugglers have previously been involved in violent brawls in Calais.

    And despite the horrific brawl, a pro-migrant rally is apparently being organised to take place at the camp at 6pm tonight.

    Rival gangs of migrants smugglers have frequently bawled in France.

    The once peaceful neighbourhood, in Paris' 10th Arrondissement, used to be a popular area with tourists, boasting a lively nightlife scene bustling with restaurants and bars.

    But worried residents have revealed how it has become a no go zone in recent weeks following the establishment of the refugee camp, which has brought squalor and violence.

    Thousands of migrants – mostly from Sudan, Libya, Afghanistan, and Eritrea – have pitched tents under the Metro station after the demolition of the Jungle hampered their attempts to reach Britain.

    French police have tried and failed on many occasions to clear the squalid squat, but asylum seekers simply keep on returning and reestablishing it.

    There are now nore than 2,500 migrants pitching up in the makeshift camp, with locals saying the eyesore is ruining their businesses and making life a "living hell".

    Residents in the once popular district say that the squatters are now becoming increasingly violent and dangerous, with increased reports of muggings.

    Faisal, a shopkeeper, told the French daily Le Figaro that Stalingrad locals are living in fear, threatening the future of his business.

    He said: “The stench of urine, faeces, and rubbish has made Stalingrad an insalubrious place to live. The place is dead – no-one wants to come here anymore. People are afraid to go out and lock themselves in.

    “I’m making less than €60 (£53) a day. A few more weeks like this and I’ll go bust!

    “French people have been kind to them. I know they’re desperate, but the least they can do is respect the law and try and integrate into French society.”

    Furious locals have demanded that the camp be closed once and for all, describing how they have heard "blood-curdling noises" coming from it in the middle of the night.

    Marie, who lives right next to the makeshift camp, told Le Figaro: “Life here has become unbearable. More than 2,500 squatters were evacuated in September, and now, less than two months later, they’re back. And now that the ‘Jungle’ camp has been closed, things are about to get even worse.”

    Another local, Monique, said that she was at “a loss for words” and “utterly distraught” over the situation.

    She said: “The streets are littered with rubbish and faeces. We can hear blood-curdling screams coming from the camp in the middle of the night.

    October 1. Two migrants raped a 23-year-old woman in Lüneburg as she was walking in a park with her young child. The men, who remain at large, forced the child to watch while they took turns assaulting the woman.

    October 2. A 19-year-old migrant raped a 90-year-old woman as she was leaving a church in downtown Düsseldorf. Police initially described the suspect as "a Southern European with North African roots." It later emerged that the man is a Moroccan with a Spanish passport.

    October 2. Finance Minister Wolfgang Schäuble called for the development of a "German Islam" to help integrate Muslims in the country. In an opinion article published by Welt am Sonntag, he wrote:
    "Considering the diverse origins of Muslims in Germany, we want to promote the development of a German Islam, the development of self-assurance of Muslims living as Muslims in Germany, in a free, open, pluralistic and tolerant order, according to our laws and the religious neutrality of the state.

    "There is no doubt that the growing number of Muslims in our country today is testing the tolerance of mainstream society. The origin of the vast majority of refugees means that we are increasingly dealing with people from very different cultures.... In this tense situation, we should not allow for the emergence of an atmosphere in which well-integrated people in Germany feel alien."
    October 4. Münchner Merkur reported that the 2016 Munich Oktoberfest recorded its lowest turnout since 2001. Visitors reportedly stayed away due to concerns about terrorism and migrant-related sexual assaults.

    October 6. Frankfurter Allgemeine Zeitung reported on a German intelligence study which found that almost half the German Salafists who left for Syria or Iraq were active in mosques. "The mosques continue to play a central role in the radicalization of Islamists in Germany," a spokeswoman for the German domestic intelligence agency, the Bundesamt für Verfassungsschutz (BfV), said. The ongoing study analyzes the background and course of the radicalization of persons who left for Syria or Iraq. The study has collected data from 784 Islamists who left Germany or were actively trying to leave the country. The BfV estimates that there are 9,200 known Salafists in Germany.

    October 6. More than 400 residents of the Altenessen district in Essen met local politicians in a televised "town hall meeting" to discuss spiraling violence and crime perpetrated by migrants in the area.     October 14. German President Joachim Gauck, who is stepping down for health reasons, said he believed that Germany will eventually have a Muslim president. Of the eleven German presidents so far, nine have been Protestant and two have been Catholic. Gauck's statement caused a stir in Germany. Some said that all German citizens are eligible for the position, regardless of confession, and others said a Muslim president would further divide society. Vice President of the European Parliament Alexander Graf Lambsdorff said: "A mullah with a turban would be impossible, but a representative of modern, enlightened Islam, such as the mayor in London, of course." The Office of the President told Bild that the oath of office would never be changed from "so help me God" to "so help me Allah."

    October 14. Green Party politician Volker Beck called on Germans to learn Arabic so that they can communicate with migrants who do not speak German. When asked on NTV how migrants can integrate if there are no German speakers in many parts of German cities, he replied: "Other countries are more relaxed about the fact that, in some areas, a different language is spoken by a migrant community. In the US, you will find your Chinatown, you will find areas where Mexicans live, or whatever community is strong in a city." He also said it was good that German is not spoken in many German mosques. "Arab sermons are a piece of home," he said.

    October 14. Volker Kauder, a key member of Chancellor Angela Merkel's party, threatened internet giants such as Facebook and Google with fines up to 50,000 euros ($53,000) if they fail to tackle online hate speech. The move comes amid a rise in anti-immigration sentiment in Germany.

    October 15. A Syrian migrant disrupted a wedding at the Karmel Church in downtown Duisburg. He burst into the building and began fondling a statue of the Virgin Mary while shouting "Allahu Akhbar" ("Allah is the greatest.") After undergoing a psychological evaluation, the man was released. The incident is one of a growing number in which Muslim migrants have disrupted or vandalized German churches.

    October 16. A 16-year-old boy and his 15-year-old girlfriend were walking along the banks of the Alster, a lake in the heart of Hamburg, when a stranger ambushed him from behind and plunged a knife into his back. The attacker then pushed the girl into the water and walked away. The girl survived, but the boy died of his wounds. The suspect, a "southern-looking" (südländischer Erscheinung) man in his early twenties, remains at large. Police say the victims were not robbed and there is no evident motive for the crime: The suspect appears to have randomly stabbed the boy just because he felt like it. The Islamic State later claimed responsibility for the murder, but German police cast doubt on that claim.

    October 17. The German Press Council reprimanded the weekly newspaper, Junge Freiheit, for revealing the nationality of three Afghan teenagers who raped a woman at a train station in Vienna, Austria, in April 2016. The press council said the nationality of the perpetrators was "not relevant" to the case, and by revealing this information the newspaper "deliberately and pejoratively represented the suspects as second-class persons." In the interests of "fair reporting," the council demanded that the newspaper remove the offending item from its website. The newspaper refused to comply, and said it would continue to publish the nationalities of criminal suspects.

    October 17. The German branch of Open Doors, a non-governmental organization supporting persecuted Christians, reported that Muslims are attacking Christians at refugee shelters throughout Germany. The NGO documented 743 incidents between May and September 2016, but said they were only the "tip of the iceberg." The report said:
    "Many of the refugees concerned have previously been persecuted and discriminated against in their Islamic countries of origin and have therefore fled to Germany. The religious minorities in refugee accommodations are now experiencing the same oppression prevalent in their countries of origin."
    October 17. The Federal Statistics Office reported that the birthrate in Germany reached the highest level in 33 years in 2015, boosted mainly by babies born to migrant women. The rate was 1.5 births per woman in 2015, up from 1.47 births in 2014, and the highest figure since 1982 when it was 1.51. For German women, the birth rate increased only slightly from 1.42 children per woman in 2014 to 1.43 in 2015. For women of foreign nationality, the rate increased from 1.86 to 1.95 children per woman.

    October 18. Sigrid Meierhofer, the mayor of Garmisch-Partenkirchen, in an urgent letter (Brandbrief) to the Bavarian government, threatened to close a shelter that houses 250 mostly male migrants from Africa if public safety and order could not be restored. The letter, which was leaked to the Münchner Merkur, stated that local police had responded to more emergency calls during the past six weeks than in all of the previous 12 months combined.

    October 18. Süddeutsche Zeitung reported that during the first eight months of 2016, more than 17,000 migrants sued the Federal Office for Migration and Refugees (BAMF) for not giving them full refugee status. Most Syrian refugees in Germany receive only partial asylum status, known as subsidiary protection, which delays family repatriations by at least two years. According to Süddeutsche, 90% of the refugees who challenged the subsidiary protection status in court won their case and were granted full rights under the Geneva Convention. Refugees with full status are allowed immediately to submit applications to bring spouses and children to Germany. If all of the 17,000 migrants win their cases, hundreds of thousands of additional migrants would be allowed to come to Germany.

    October 19. Bild reported that a 49-year-old Syrian refugee in Rhineland-Palatinate is seeking social welfare benefits in Germany for his four wives and 23 children. The man, identified as Ghazia A., told Bild that "according to our religion, I have the duty to visit and be with each family equally, and not show any preferential treatment." Local officials told the newspaper that the family is integrating well and all of the children are going to school.

    October 19. A 29-year-old migrant from Syria appeared in court on charges of sexually molesting ten children in Freiburg and Müllheim. The father of one of the victims took a photograph of the suspect, but police waited ten days before acting on the lead.

    October 19. A 16-year-old German-Moroccan girl appeared in court on terrorism charges. In February 2016, when she was 15, she stabbed a police officer with a kitchen knife at the central train station in Hanover. Prosecutors say she was conducting a "martyrdom operation" for the Islamic State.

    October 20. Pupils at a grade school in Garmisch-Partenkirchen were required to memorize and recite the shahada, the Muslim profession of faith ("There is no god but Allah, and Mohammed is his messenger."), in both German and Arabic, for an interfaith chapel service.

    October 21. In an interview with Welt am Sonntag, Islam expert and Green Party member Kurt Edler said that Syrian migrants should be allowed to set up their own city in Germany as a way to prevent radicalization. He said: "Why do not we set up a New Aleppo in Pomerania? Then we can show that what the British and Irish emigrants have done in the North East of the USA is also possible with us."

    October 24. A group of Serbian teenagers in Hamburg were handed suspended sentences for gang-raping a 14-year-old girl and leaving her for dead in sub-zero temperatures. The judge said that although "the penalties may seem mild to the public," the teens had all made confessions, appeared remorseful and longer posed a danger to society. The ruling, which effectively allowed the rapists to walk free, provoked a rare moment of public outrage over the problem of migrant sex crimes in Germany.

    October 24. A YouGov poll found that 68% of Germans believe that security in Germany has deteriorated over the past several years. Also, 68% of respondents said they fear for their lives and property in German train stations and subways, while 63% feel unsafe at large public events.

    October 25. Seven migrant boys, some as young as seven years old, sexually assaulted three girls (ages 9, 11 and 14) at a public swimming pool in Berlin.

    October 25. The German edition of the Huffington Post published an article by a Syrian migrant named Aras Bacho in which he demanded that all signs and products in Germany be translated into in Arabic to make life easier for migrants. He wrote:
    "As a refugee I believe that in Europe the street signs should be translated into Arabic. Likewise, food packaging should be in Arabic. It should also be possible to take exams in Arabic.... Most refugees have been driving in Syria. It would be helpful if the road signs were in Arabic. We should help these people more, no matter what it costs."
    October 25. Police in five German states raided a dozen apartments and a refugee shelter as part of a counter-terrorism investigation. Fourteen Chechens, all asylum seekers who arrived in Germany in 2013, are at the center of a probe into "terrorist financing." No one was arrested.

    October 25. A group of Muslim children shouting "Allahu Akbar" threw stones at a visiting Ethiopian priest who was walking to a chapel in Raunheim. Police said the priest was targeted because he was wearing a cross.

    October 27. A ten-year-old girl was raped while she was riding her bicycle to school in Leipzig. Police published a facial composite of the migrant suspect with the politically correct warning: "This image is to be published only in print media products in the Leipzig region. Publishing it on the internet, including on social media such as Facebook, is not covered by the court order and is therefore not allowed."

    October 27. Officials in Monheim donated 845,000 euros ($890,000) of taxpayer money to two Islamic associations, to build mosques in the town. The money will be used to purchase land for the mosques, the construction of which will be paid for by the Turkish government. Mayor Daniel Zimmermann said he hopes the mosques will promote Muslim integration. "I hope the mosques will be city-shaping and also architectural monuments," he said. The grant is subject to only one condition: the minarets must not be more than 25 meters (80 feet) high.

    October 27. Deutsche Welle reported that the parents of a German teenager face prosecution for refusing to allow their son to enter a mosque during a school field trip. The parents were fined 300 euros ($315) for their son's truancy. The prosecutor's office in Itzehoe is now reviewing whether or not the parents should appear in court because they did not pay the fine. The school's principal, Renate Fritzsche, said that there are no exceptions to Germany's mandatory school law. The goal of education, Fritzsche emphasized, is to teach children about other cultures so they will be able to interact and tolerate them.

    October 27. Berliner Zeitung reported that a 19-year-old Syrian migrant, identified only as Shaas Al-M., scouted out potential terror targets in Berlin for the Islamic State. He was allegedly actively recruiting assassins in Germany and was preparing to attack when he was arrested in March 2016. The man, who received religious and military training with the Islamic State in Syria, arrived in Germany in the summer of 2015 posing as a Syrian refugee.

    October 28. Reuters reported that many Arab mosques in Germany are more conservative than those in Syria. The report states: "A dozen Syrians in six places of worship in three cities told Reuters they were uncomfortable with very conservative messages in Arabic-speaking mosques. People have criticized the way the newcomers dress and practice their religion, they said. Some insisted the Koran be interpreted word-for-word."
    October 28. A mob of 17 Muslim migrants sexually assaulted two women in front of a church in Freiburg. Police arrested three of the men, all from Gambia, who arrived in Germany as refugees in 2015 and had previously been detained for other crimes.

    October 28. Der Spiegel reported that Justice Minister Heiko Maas wants to make it easier for German courts to void child marriages. There currently are 1,475 married adolescents in Germany; 361 of them are younger than 14 years, 120 are 14 or 15 years old. According to German law, young people above the age of 16 may marry, but only if the other spouse is 18 and a family court gives a so-called exemption. Maas wants to tighten the criteria for this. The exemption is to be granted only "if the intended marriage does not affect the welfare of the applicant." Günter Krings (CDU), parliamentary secretary of state, said the measure does not go far enough. "For the sake of clarity of our legal system, we should consistently ensure that no marriages with minors can be concluded in our country, even in exceptional cases," he said.

    October 31. A 53-year-old woman attacked two police officers after they entered her apartment in Mülheim. The officers were checking in on her after she had allegedly thrown furniture out the window. When she refused to open the door, the officers broke it down. Once inside the apartment, the veiled woman attacked them with a box-cutter while shouting "Allahu Akbar" ("Allah is the greatest.") Police said the woman was a Muslim convert and was already familiar to police after a series of earlier incidents linked with Islamic extremism.

    Starbucks Pledges to Hire 10,000 Refugees in Response to Trump’s Executive Order

    Starbucks says it plans to hire 10,000 refugees over five years in the 75 countries where it does business.

    Chairman and CEO Howard Schultz outlined the company’s plan in a memo sent to employees Sunday in response to President Trump’s executive order banning travel from seven Muslim majority countries.

    “We are living in an unprecedented time,” Schultz wrote in the memo, which listed several actions the company says it is taking to “reinforce our belief in our partners around the world.”

    The refugee hiring proposal, Schultz wrote, will begin with a focus on people who have served with U.S. troops as interpreters and support personnel.

    Schultz also reiterated Starbucks’ support for the Deferred Action for Childhood Arrivals program, or DACA, which helps undocumented immigrants who were brought to the United States as children get driver’s licenses, enroll in college and secure jobs. The program was created by President Obama through an executive order in 2012.

    And Schultz said the company is “ready to help and support our Mexican customers, partners and their families” should any proposed trade sanctions, immigration restrictions and taxes affect their businesses.

    “We are in business to inspire and nurture the human spirit, one person, one cup and one neighborhood at a time,” Schultz wrote. “That will not change. You have my word on that.”

    Schultz is the latest business executive to weigh in on the travel ban. Earlier Sunday, General Electric CEO Jeff Immelt wrote to employees that he shared their “concern” over the order, and added that GE has many employees from the countries named in the ban.

    Several tech executives have also publicly denounced the travel ban.

    Seven Inconvenient Facts About Trump’s Refugee Actions



    The sober and logical reasons for President Donald Trump’s executive order on refugees and visitors are rising above the noise after an evening of hysterical over-reactions and emotional meltdowns on the nation’s TV networks.

    Advocates of sane, secure immigration policy have long noted that it’s almost impossible to have a reasonable discussion of the refugee and immigration issues, because it’s been sentimentalized and politicized beyond the realm of rational thought.
    This weekend brings them another superb example of media-magnified shrieking about fascism, bleating about “white nationalists,” howling about “religious persecution,” false invocations of the Constitution, and theatrical sobbing on behalf of the Statue of Liberty.
    For readers who want to wallow in the emotion, examples can be found in this handy dossier of hysteria compiled by the Washington Post. But clear-eyed adults prefer to examine plain facts about Trump’s executive order:


    1. It is NOT a “Muslim ban.” You will search the Executive Order in vain for mentions of Islam, or any other religion. By Sunday morning, the media began suffering acute attacks of honesty and writing headlines such as “Trump’s Latest Executive Order: Banning People From 7 Countries and More” (CNN) and printing the full text of the order.
    Granted, CNN still slips the phrase “Muslim-majority countries” into every article about the order, including the post in which they reprinted its text in full, but CNN used the word “Muslim,” not Trump. The order applies to all citizens of Iraq, Iran, Syria, Libya, Somalia, Sudan, and Yemen. It does not specify Muslims. The indefinite hold on Syrian refugees will affect Christians and Muslims alike.

    As Tim Carney at the Washington Examiner points out, the largest Muslim-majority countries in the world are not named in the Executive Order.
    More countries may be added to the moratorium in the days to come, as the Secretary of Homeland Security has been instructed to complete a 30-day review of nations that don’t provide adequate information for vetting visa applicants.

    It’s also noteworthy that the ban is not absolute. Exceptions for “foreign nationals traveling on diplomatic visas, North Atlantic Treaty Organization visas, C-2 visas for travel to the United Nations, and G-1, G-2, G-3, and G-4 visas” are expressly made in the order. The Departments of State and Homeland Security can also grant exceptions on a “case-by-case basis,” and “when in the national interest, issue visas or other immigration benefits to nationals of countries for which visas and benefits are otherwise blocked.”
    There is a provision in the Executive Order that says applications based on religious persecution will be prioritized “provided that the religion of the individual is a minority religion in the individual’s country of nationality.”

    This has been denounced as a “stealth Muslim ban” by some of the very same people who were conspicuously silent when the Obama administration pushed Christians – who the most savagely persecuted minority in the Middle East, with only the Yazidis offering real competition — to the back of the migration line.


    2. The order is based on security reviews conducted by President Barack Obama’s deputies. As White House counselor Kellyanne Conway pointed out on “Fox News Sunday,” the seven nations named in Trump’s executive order are drawn from the Terrorist Prevention Act of 2015. The 2015 “Visa Waiver Program Improvement and Terrorist Travel Prevention Act of 2015” named Iraq, Iran, Sudan, and Syria, while its 2016 update added Libya, Somalia, and Yemen.
    “These are countries that have a history of training, harboring, exporting terrorists. We can’t keep pretending and looking the other way,” said Conway.


    3. The moratorium is largely temporary. Citizens of the seven countries named as security risks are banned from entering the United States for the next 90 days. Refugee processing is halted for 120 days. The longest-lived aspect of the ban may prove to be the halt on Syrian refugees, but that isn’t given a time frame at all. It will last “until such time as I have determined that sufficient changes have been made to the USRAP to ensure that admission of Syrian refugees is consistent with the national interest,” as President Trump wrote.


    4. Obama banned immigration from Iraq, and Carter banned it from Iran.
    “Fact-checking” website PolitiFact twists itself into knots to avoid giving a “true” rating to the absolutely true fact that Jimmy Carter banned Iranian immigration in 1980, unless applicants could prove they were enemies of the Khomenei theocracy.
    One of Politifact’s phony talking points states that Carter “acted against Iranian nationals, not an entire religion.” As noted above, Trump’s Executive Order is precisely the same – it does not act against an “entire religion,” it names seven countries.

    As for Barack Obama, he did indeed ban immigration from Iraq, for much longer than Trump’s order bans it from the seven listed nations, and none of the people melting down today uttered a peep of protest. Richard Grenell summed it up perfectly in a Tweet:

    5. Trump’s refugee caps are comparable to Obama’s pre-2016 practices: David French, who was touted as a spoiler candidate to keep Donald Trump out of the White House during the presidential campaign – in other words, not a big Trump fan – wrote a lengthy and clear-headed analysis of the Executive Order for National Review. He noted that after the moratorium ends in 120 days, Trump caps refugee admissions at 50,000 per year… which is roughly the same as President Obama’s admissions in 2011 and 2012, and not far below the 70,000 per year cap in place from 2013 to 2015.

    Obama had fairly low caps on refugees during the worst years of the Syrian civil war. He didn’t throw open the doors to mass refugee admissions until his final year in office. Depending on how Trump’s review of Syrian refugee policy turns out, he’s doing little more than returning admissions to normal levels after a four-month pause for security reviews.


    6. The Executive Order is legal: Those invoking the Constitution to attack Trump’s order are simply embarrassing themselves. The President has clear statutory authority to take these actions. As noted, his predecessors did so, without much controversy.

    Most of the legal arguments against Trump’s order summarized by USA Today are entirely specious, such as attacking him for “banning an entire religion,” which the order manifestly does not do. Critics of the order have a political opinion that it will in effect “ban Muslims,” but that’s not what it says. Designating specific nations as trouble spots and ordering a pause is entirely within the President’s authority, and there is ample precedent to prove it.

    It should be possible to argue with the reasoning behind the order, or argue that it will have negative unintended consequences, without advancing hollow legal arguments. Of course, this is America 2017, so a wave of lawsuits will soon be sloshing through the courts.


    7. This Executive Order is a security measure, not an arbitrary expression of supposed xenophobia. Conway stressed the need to enhance immigration security from trouble spots in her “Fox News Sunday” interview. French also addressed the subject in his post:
    When we know our enemy is seeking to strike America and its allies through the refugee population, when we know they’ve succeeded in Europe, and when the administration has doubts about our ability to adequately vet the refugees we admit into this nation, a pause is again not just prudent but arguably necessary. It is important that we provide sufficient aid and protection to keep refugees safe and healthy in place, but it is not necessary to bring Syrians to the United States to fulfill our vital moral obligations.
    French’s major objection to the Executive Order is that applying it to green-card holders is “madness,” but unfortunately many of the terrorists who attacked Americans during the Obama years were green-card holders. Daniel Horowitz and Chris Pandolfo addressed that subject at Conservative Review:
    Both liberals and conservatives expressed concern over hundreds of individuals going over to fight for ISIS. We are already limited in how we can combat this growing threat among U.S. citizens. Given that it is completely legal to exclude non-citizens upon re-entry, Trump extended the ban to legal permanent residents as well.
    If a Somali refugee is travelling back to Somalia (so much for credible fear of persecution!), government officials should have the ability to prevent that person from coming back when necessary. Obviously, there are some individuals from these seven countries who already have green cards and we might not want to exclude. That is why the order grants discretion to the State Department to issue case-by-case exemptions for “religious persecution, “or when the person is already in transit and denying admission would cause undue hardship.” A CBP agent is always stationed at any international airport from which these individuals would board a direct flight to the United States (Paris and Dubai, for example). That individual would not allow anyone covered by this ban onto a U.S.-bound flight unless he grants them a hardship exemption.
    Indeed, it appears that green card holders returning yesterday from those seven countries were all granted entry.
    Because he is a progressive globalist, Obama deliberately blinded us to security threats, in the name of political correctness and left-wing ideology. Ninety or 120 days isn’t much time for Trump to turn all that around, especially because it is unlikely much will change in the seven countries Trump named.
    The hysterical reaction to Trump’s order illustrates the very thing that worries advocates of strong immigration security: Americans’ security is the lowestpriority, far below progressive ideology, crass political opportunism, and emotional theater.

    We’re being effectively told by the theatrical class to tolerate a certain amount of Islamic terrorism because their feelings would be hurt by the tough measures we need protest ourselves from a tough enemy. But this time, President Trump is proving tough enough to push our security up into the top priority.

    WASHINGTON – Acting Attorney General Sally Yates, a Democratic appointee, says she's directed Justice Department attorneys not to defend President Donald Trump's executive order on refugees.

    Yates said in a memo Monday that she is not convinced that Trump's order is lawful, or that its defense is consistent with the department's obligation to "always seek justice and stand for what is right."

    Yates was appointed deputy attorney general by President Barack Obama. She became acting attorney general once Loretta Lynch left the position.

    Her directive will be in place until she leaves the department, which will happen once the Senate confirms Sen. Jeff Sessions, Trump's pick for attorney general.

    A Democratic senator says she is working on two bills to strike down President Trump's executive order that temporarily bars immigration from seven Muslim-majority countries and refugees.

    "Congress must take swift action in response to President Trump's discriminatory order," tweeted California Sen. Dianne Feinstein on Sunday.

    Feinstein, the ranking member on the Judiciary Committee, said she is drafting the legislation that she will introduce Monday.

    "The first bill immediately rescinds the order," Feinstein said. "The second limits executive authority under the Immigration and Nationality Act," an act that has been amended several times since it was created in 1952. analysis on defense and national security issues in your Inbox c

    She added: "Under our bill, the president would not be able to unilaterally ban groups of immigrants."

    Feinstein didn't offer any other details.

    A slew of Democrats have made appearances at protests nationwide to oppose what they are calling a "Muslim ban" — a term that the Trump administration has pushed back against.

    The executive order has also become a cause for concern among some Republican lawmakers.

    Sens. John McCain and Lindsey Graham said in a statement Sunday that the ban "will become a self-inflicted wound in the fight against terrorism." Another senator, Ben Sasse, of Nebraska, panned the executive order as being "too broad."

    A federal judge in New York granted a temporary stay on the ban Saturday evening, which applies to travelers who have already arrived in the U.S. or those who are already travelling with valid visas. Similar legal rulings were reached in a handful of other states.

    Before Trump Executive Order, Obama Officials Warned Islamic State Would Use ‘Refugee Flows’ to Enter West

    As experts and politicians debate the merits of President Donald Trump’s executive order limiting refugee flows from terror-prone nations, few have addressed the many warnings prior to Trump’s assumption of the presidency that Islamic State terrorist have long planned to infiltrate Western nations disguised as refugees.

    Trump’s executive order, which many in the left have falsely described as a “Muslim ban,” temporarily halts the entry of individuals from seven nations listed in the Obama-era Terrorist Prevention Act of 2015: Syria, Sudan, Somalia, Libya, Iran, Iraq, and Yemen. The government is set to restore entry of refugees from these nations contingent upon establishing an orderly and competent screening process to prevent terrorists from posing as refugees and entering the United States.

    In this sense, the executive order addresses a concern former CIA director John Brennan presented before the Senate Select Committee on Intelligence in June 2016, shortly after the massacre at Orlando’s Pulse nightclub orchestrated by an Islamic State sympathizer.


    “ISIL has a large cadre of Western fighters who could potentially serve as operatives for attacks in the West,” Brennan said, using an alternate acronym for the Islamic State. “And the group is probably exploring a variety of means for infiltrating operatives into the West, including refugee flows, smuggling routes, and legitimate methods of travel.”


    He noted that ISIS has also expanded its propaganda efforts to “inspire attacks by sympathizers who have no direct links to the group.”


    These remarks came months after Brennan had warned against “hermetically seal[ing] our borders,” a statement he made at a forum in November 2015. Even before the Pulse massacre, Brennan nonetheless suggested U.S. officials should be “wary” of who enters the country.


    Brennan was not the first to warn that Islamic State terrorists may pose as refugees to enter the United States. The same month Brennan suggested the U.S. should decline to “hermetically seal our borders,” Senator John McCain said in an interview he had reason to believe that Islamic State terrorists could pose as Syrian refugees to enter the United States.

    “I am sure that Baghdadi, the leader of ISIS, has already told some of these young men, go into the refugee flow and call us when you get to Berlin, New York, Paris, wherever it is,” he told New York radio host John Catsimatidis. “So we are going have to be very, very careful about what individuals we allow to come into this country as a result of this terrible tragedy.”


    Senator McCain has since accused Trump of fueling “ISIS propaganda” by responding to the threat of Islamic State terrorists posing as Mideast refugees.


    House Homeland Security Committee Chairman Rep. Michael McCaul also suggested in 2015 that intelligence he had been privy to suggested the Islamic State was seeking to infiltrate the West through refugee flows. “ISIS members in Syria have attempted to exploit [the refugee program] to get into the United States,” he told an audience at National Defense University. “The U.S. government has information to indicate that individuals tied to terrorist groups in Syria have already attempted to gain access to our country through the U.S. refugee program.”


    The State Department has also indicated the U.S. is struggling with a concerted effort by Islamic State terrorists to enter the United States from Syria. “I wouldn’t debate the fact that there’s the potential for ISIS terrorists to try to insert themselves,” State Department Spokesperson Rear Admiral John Kirby said in September, adding that he believed those who have entered the United States have “all been extremely and very stridently vetted.”


    The plan has succeeded in Europe. The Islamic State terrorist responsible for the New Year’s Eve massacre in Istanbul’s Reina nightclub, for example, entered Turkey through Syria with his wife and child, despite being an Uzbek national. Nearly a year before that attack, another Islamic State suicide bomber succeeded in killing 25 people in Istanbul, entering Turkey as a Syrian refugee. In Western Europe, four Islamic State terrorists cleared Syrian refugee vetting in October 2015, with two of them successfully attacking Paris.


    At least one refugee with ties to the Islamic State has been arrested in the United States: Omar Faraj Saeed Al Hardan, an Iraqi refugee who pled guilty to “providing material support and swearing allegiance to ISIS” in a Texas court.

    Federal judge declines to renew restraining order on Trump travel ban

    The Department of Homeland Security is looking to clear up some confusion about the travel order
    (CNN) In the first court victory for the Trump administration, a federal judge in Boston declined Friday to renew a temporary restraining order that prohibited the detention or removal of foreign travelers legally authorized to come to the US.

    The win in court comes at the same time that the administration issued a clarification to its travel order allowing for some citizens from the seven banned countries -- Iraq, Syria, Iran, Libya, Somalia, Sudan and Yemen -- to enter the US under specific circumstances.

    The original temporary restraining order, issued by US District Court Judge Allison Burroughs and US Magistrate Judge Judith Dein, was put in place early Sunday morning and was set to expire on February 5.

    But a different federal judge, US District Court Judge Nathaniel Gordon, ruled Friday that the claims brought by legal permanent residents are now moot given the White House counsel's recent clarification that the travel ban order does not apply such individuals.

    Gordon went on to additionally conclude that because the other plaintiffs in the case -- Iranian nationals and Oxfam America, Inc. -- did not demonstrate a likelihood of success on the merits of their claim, "an extension of the restraining order at the present time is not warranted."

    But attorneys who brought the lawsuit vowed to continue the fight after Friday's ruling.

    "The ACLU of Massachusetts is deeply disappointed that the federal district court did not extend the temporary restraining order on President Trump's illegal and dangerous executive order. But this case is not over; ACLU of Massachusetts lawyers will continue to challenge the executive order in this case, and the ACLU will continue to challenge it in cases all over the nation," Carol Rose, executive director of the ACLU of Massachusetts, said in a statement.

    ACLU attorney Lee Gelernt in the New York lawsuit also pointed out that the federal judge's order in that case protects travelers from being removed from the country on a nationwide basis until at least February 21.

    DHS clarifies travel ban

    The Department of Homeland Security is looking to clear up some confusion about who from the seven restricted countries can still enter the US during what the agency described as a "pause."

    "This pause does not apply to Lawful Permanent Residents" -- also known as green card holders -- "dual citizens with passports from a country other than the seven listed, or those traveling on diplomatic, NATO or UN visas. Special Immigrant Visa holders who are nationals of these seven countries may board US-bound planes, and apply for and receive a national interest exception to the pause upon arrival," according to the DHS release.

    The flurry of Friday night activity was capped off by a new tweet from the President, who insisted that we must keep "evil" out of the country.

    President Trump’s executive order on immigration is not a permanent ban, but it is necessary for America’s national security, thanks to the lax vetting practices applied by the Obama administration, according to a leading immigration policy expert.

    Trump has issued a flurry of orders, but his executive order last week ordering an immediate and indefinite pause on travel to the United States from seven terrorism-prone nations is drawing by far the fiercest response. Protesters have clogged airports, and political critics are demanding Trump rescind the order.

    Jessica Vaughan is director of policy studies at the Center for Immigration Studies. She told WND and Radio America there is a lot of confusion and misinformation about what Trump’s order does.

    “I think the most misunderstood part is that people are being permanently prevented from coming to the United States who had been approved before,” Vaughan explained. “This is not a permanent ban. It’s a temporary suspension. You can call it a ban if you want, but it’s a temporary ban. No one has been told that the benefit they were approved for has been taken away.”

    And she said refugees in dire situations are still being processed from those countries even with the pause in place.

    “I have to emphasize there is language in this executive order that anybody with a particularly emergency situation, compelling circumstances, in imminent danger, or in other categories can ask for a waiver,” Vaughan said. “From what I’ve heard in statements today, they’ve already granted more than a thousand waivers for people.”

    But she said the pause on entry from the seven unstable nations is needed to recalibrate how the U.S. screens people entering the country.

    “The point was to give our government the opportunity to take another look at these people who have been granted green cards, visas, refugee status,” Vaughan said. “We know that the vetting process under the Obama administration was not adequate.”

    Vaughan, a former visa officer, said the Obama administration failed to do even basic screening much of the time, including waiving required interviews with those seeking to go to the U.S. But she said the problems didn’t end there.

    “In other cases, officers were not allowed to look very deeply into the applications that they got,” Vaughan said. “The claims they made on their applications were not always verified. Officers were told to assume that they were qualified and not ask too many questions. [There was] not a lot of fraud prevention work taking place.”

    Then there is the problem of trying to vet people coming from hostile countries or ones that don’t have decent records on their people.

    “In some of these countries, we don’t have enough of a relationship with the government to be able to be sure that people’s identities are who they say they are or that their story checks out,” she said.

    “There was a lot of enforcement that was undone by the Obama administration. We’ve seen illegal immigration rise to levels we have not seen in many years.”

    Vaughan said she has sympathy for those caught in transit as the order took effect, but she said national security has to take precedence.

    “It is important to recognize that our security has been put at risk every single day that we have not had adequate vetting in place,” she said. “So it was important to put a stop to that as soon as possible.”

    Vaughan likens the pace of Trump’s immigration actions thus far – ranging from the immigration order to ordering border wall construction to cracking down on sanctuary cities – to “drinking from a fire hose,” but she believes Trump is on the right course.

    “There’s a lot that needed to happen,” she said. “It’s been presented as an integrated plan. Throwaway lines like, ‘Let’s have more border security.’ They’re talking about a wall but changing the policies also and enforcing the laws in the interior. That’s a comprehensive approach that’s likely to work.”

    Judge Wears Anti-Trump Pussy Hat to Court

    Travis County Judge Sarah Eckhardt has been rocking headgear with strong anti-Trump symbolism: The Pussy hat. To say it’s politically charged is like saying third-rails are shocking:

    These hats are pointed symbols in opposition to President Donald Trump, who said in an infamous 2005 video that he grabbed women by their privates. That footage became controversial because the action meets legal definitions of sexual assault if done without consent.

    News of Eckhardt’s fashion choice started spreading with a now-partially deleted Reddit post from late January. KVUE later picked up the story and started looking into it. Can the Texas judge wear a hat with strong political connotations? Well, yes. Because she’s not a judge in the conventional sense.

    From their story a couple of weeks ago:
    KVUE’s Jason Puckett reached out to multiple county departments to verify that this behavior was acceptable and found that almost every source he spoke with agreed – Eckhardt is in the clear.

    Meanwhile, the County Attorney office told the outlet they haven’t gotten any complaints, and Judge Eckhardt’s office declined to comment.

    Clarification is important here: This Democratic politician is actually Travis County’s top executive, an elected official who leads the Commissioners Court. Here’s the official description of her job [emphasis ours]:
    The County Judge is the presiding officer and a voting member of the Travis County Commissioners Court. In the role of presiding officer, the County Judge sets the Court’s weekly voting session agenda, and is often thought of as the chief administrator of the County through the Court´s responsibility for approving annual budgets for the entire County. In large counties like Travis, the County Judge no longer exercises judicial functions as a probate or constitutional county court judge, though the office retains the power to conduct marriages and may also be called upon to conduct administrative hearings.

    So it’s not like a Supreme Court justice it wearing the hat.

    Investigation Launched After Texas Judge Wears ‘Pussy Hat’ in Courtroom

    A short investigation was launched after a Travis County judge wore a pink, knitted “pussy hat” in her courtroom late in January causing, some to doubt her impartiality from the bench.

    Travis County Judge Sarah Eckhardt started her session on January 24 by putting on the pink knitted hat that has become associated with the Women’s March protests held the day after Donald J. Trump took the oath of office to become the 45th president of the United States.

    The judge’s shocking partisanship was first noted by Reddit users and soon caused residents to quiz Texas authorities as to whether or not a sitting judge is allowed to wear partisan political paraphernalia on the bench.

    Local Austin TV station KVUE claimed that several county officials told them that Eckhardt didn’t break any rules other than that of propriety.

    Eckhardt has been known as a liberal, activist judge in the past.

    In June of last year, Eckhardt used a naturalization ceremony to attack Donald Trump, the Second Amendment of the U.S. Constitution, and the death penalty. At one point during the ceremony, the judge urged the newly sworn citizens to register to vote so they could vote against Donald Trump. Her bald attempt to politicize the ceremony rankled some participants.

    In October of 2015, Eckhardt met with activists for illegal aliens who were seeking help to quash a lawsuit filed by the state of Texas against the Obama administration over its executive amnesty program that would allow up to five million illegal aliens to remain in the United States without fear of deportation.

    Also in October, Eckhardt insisted that the state’s lawsuit was only being waged by “those who wish to play politics with peoples’ lives” and that Travis County’s economy was a success only because it is “built on immigration.”
