    The Ninth Circuit Court of Appeals has overturned Arizona’s requirement that people show proof of citizenship to register to vote.

    The split decision by a three-judge panel determined that the requirement to show proof of citizenship — passed by voters in 2004 — is not consistent with the National Voter Registration Act.

    Associate Justice Sandra Day O’Connor, temporarily sitting by designation, and Circuit Judge Sandra Ikuta, with chief judge Alex Kozinski dissenting, said Prop. 200 creates an additional hurdle, while the national act is intended to reduce “state-imposed obstacles” to registration.

    The majority noted that Congress was well aware of the problem of voter fraud when it passed the voter act, and built in sufficient protections, including applying perjury penalties to applicants who lie about their eligibilty.

    The court determined Arizona’s polling place photo identification requirement, however, is a minimal burden and does not violate the Equal Protection Clause in the 14th Amendment.

    Attorney General Terry Goddard’s office is still reviewing the decision and was unavailable for comment.

    Secretary of State Ken Bennett said he does not anticipate that the ruling will make any difference in voting next week, since it wasn’t in place when registration closed Oct. 4.

    Bennett said the state plans to appeal the ruling, adding he disagrees the documentation sets up a barrier for registration. “I think it’s an outrage and a slap in the face of Arizonans who are concerned about the integrity of elections,” he said.

    There are times in human history when events occur and they are measured and marked not by those who witnessed and lived through the event, but by historians who noticed the marker which changed the course of a nation’s direction and forever altered the construct of that society. On November 2, 2010, one week from today, it is this historian’s belief that the United States will begin such a journey and despite the protestations of those who have been warning for years, the course will be unalterable and expedited as the citizens will be overwhelmed as the Constitution truly takes its place alongside the Magna Carta as just another antique piece of parchment.

    The American people, its spirit and psyche, are exhausted. The economic crisis of our own design has worn the people down after almost three years of relentless decline, deception, and depression. The pictures of people crying on the sidewalks amidst their piles of belongings as they lose their homes will leave an indelible mark in our hearts and minds, yet for those who do not know nor care about this fiasco, it is just a distant problem to be drowned out by the latest pop music sensation on their iPod. Ignoring these souls however did not make the problem go away. The idea that fifty-three percent of the population is at risk of living in their largest and in many cases, only investment as it slips into a negative equity situation with little prospect of price recovery in our lifetimes, insures the spreading of this disaster because of the ineptness and inaction of our leaders. The individuals who have spent decades ignoring our political system though are not absolved of their responsibilities either I might add and in fact contributed mightily to the accelerated downfall.

    The Congress will return to session almost immediately after the election and the intelligent voter should be filled with great trepidation. Unlike the Republicans who have been plotting how to carve up their freshly baked power pie, the Democrats and the administration have been designing a systemic attack on our freedoms by planning on the passing and implementation of numerous pieces of legislation previously rejected due to public pressure and long desired by the extremists in power now. The reason the pre-election session did not pass a budget nor appropriations was not because of some mysterious Republican filibuster being held in the men’s room beside the Senate floor. The truth is that the Democrats had a fairly certain determination of the outcome of these elections as early as Labor Day and thus decided to plot the perfect storm to trap the Republicans and complete their agenda. Inserted into omnibus spending acts and defense appropriations will be the largest amount of regulatory whoredom ever witnessed. The design is to force the Republicans into approving the acts or bypass opposing them so they can expand their permanence of an expansive bureaucracy while Americans celebrate the diversions of sport and holiday. A failure or attempt to block any of the Democrat plans will result in chaos by design, with government agencies shutting down and benefits suspended for American citizens, conveniently right before Christmas when they want and need them the most.

    This session of Congress will be anything but lame. It will behave more like a cunning tiger waiting to pounce on its prey and shred it. Everyone feels that after whatever victory occurs next week for those Tea Party candidates and deserving Republicans a call for celebration should be allowed to proceed but I call for increased vigilance. The seven weeks after November 2nd will prove to be consequential, unless of course one elects to imbibe in the victory parades and platitudes which will be the call of the day by the amenable Republicans. After all, the Republicans owned the pie for over a decade and all they did was sour it with the same ideology which enabled the influences of Marx to seep into our societal fabric and enable this administration and their minions to usurp our freedoms.

    LAS VEGAS -- Clark County election officials insisted on Tuesday that electronic voting machines were not malfunctioning at polling locations are some voters complained that Sen. Harry Reid's name had been pre-selected.Controversy arose after Boulder City resident Joyce Ferrara complained to FOX5 that when she went to vote for GOP Senate candidate Sharron Angle, Reid's name was already checked."Something's not right," Ferrara said.

    She claimed her husband and several others voting at the same time all had the same thing happen.Registrar of Voters Larry Lomax said those claims were “patently false” and said at no time did any of those voters report the incident to staff at their polling location.“In fact, although over 160,000 people have voted early in Clark County, those allegations that have been made have gone directly to the media as opposed to election board officers,” he said.

    Lomax advised voters to be aware that touch-screens on the screens are sensitive. For that reason, a person may not want to have their fingers linger too long on the screen after they make a selection at any time.

    "Especially in a community with elderly citizens (they have) difficulty in (casting their) ballot," Lomax said. "Team leaders said there were complaints (and the) race filled in."At any time, voters can go back on the screen and review their selections. They are also allowed to make changes and encouraged to double-check their ballot on screen and on paper before it is cast. Copyright 2010 by KVVU.com.

    If given the chance, nearly nine out of ten Tea Party members would vote out every member of Congress, a new poll found.

    The results of the Rasmussen poll, released Thursday, show that it’s not just Democrats who are drawing the ire of voters and confirms the views of Republican leaders who have warned their party that they can’t return to business as usual when they return to Washington in stronger numbers next year.

    Overall, nearly two-thirds of Americans would like to fire everybody in Congress, the poll found. One in five respondents said every Member of Congress should stay on and 15 percent are undecided on the issue.

    The discontent is strongest among self-identified Tea Party members, 88 percent of whom want to throw out Congress in its entirety and start with a fresh group of lawmakers.

    Republicans and those unaffiliated with either major party are not far behind in their disapproval of the current crop of Members of Congress with 82 percent and 78 percent, respectively, of them wanting to vote out everyone.

    Democrats are the only group relatively split on the issue. Forty-four percent would keep Congress, while 38 percent would vote everyone out.

    The problem with incumbents is not based on their political affiliation.

    Fifty-three percent of voters have an unfavorable opinion of Democrats, but an almost equal number, 54 percent, feel that way about Republicans.

    Within the parties, however, Republicans are less favorably inclined towards their representatives in Congress. Sixty-one percent of Republicans have a favorable opinion of the party, while 76 percent of Democrats have a favorable view of their party.

    The poll also found that 91 percent of Tea Party members dislike the Democratic Party . Their view of the GOP is much better with 56 percent holding a favorable view of Republicans.

    A majority of voters, 61 percent, would grade Congress as doing a “poor” job, and about the same number, 62 percent, “believe that no matter how bad things are, Congress can always make them worse.”

    I have clout in some circles friends.

    I'm hearing now the biggest bestest tactic the Dims are using is "Piroting".

    (I just coined that phrase).

    That's when they start pushing a 3rd party guy who is running where their own guy is losing in the polls. That way they can split the votes and keep the Republican from winning.

    The Democratic National Committee formally has asked the Pentagon for reams of correspondence between military agencies and nine potential Republican presidential candidates, a clear indication that Democrats are building opposition-research files on specific 2012 contenders even before the midterm elections.

    An internal Army e-mail obtained by ABC News indicates that the DNC has filed Freedom of Information Act requests for "any and all records of communication" between Army departments and agencies and each of the nine Republicans -- all of whom are widely mentioned as possible challengers to President Obama.

    The agencies are asked to respond to the request by this Friday, just four days before Election Day.

    DNC officials declined to comment, but did not dispute that the information has been requested. An Army spokesman confirmed that the DNC's formal request for information has been received.

    "We did receive a FOIA request, and now we are responding to that FOIA request," said the spokesman, Col. Tom Collins.

    Fifteen Missouri counties have more people registered to vote than they have people who are aged eighteen or older. This is egregious, illegal and contemptuous of the rule of law. And it is just the tip of the iceberg.


    Voter fraud is rampant. Nevada voting machines are automatically registering votes for Harry Reid, no matter who you vote for. And who are the voting machine technicians? Members of the Service Employees International Union (SEIU), which donated $500,000 to the Patriot Majority PAC, which in turn has spent $1.3 million to destroy Sharron Angle — who is running against Reid.

    In Craven County, North Carolina, a man voted the straight Republican ticket, only to see the machine register his votes as if he had voted straight Democrat.

    In Chicago, thousands of votes submitted through the new vote-by-mail system may not be counted. In Daytona Beach, Florida, City Commissioner Derrick Henry was arrested last week for absentee ballot fraud during his re-election campaign earlier this year.

    In southeastern Pennsylvania’s 8th district, according to Thomas A. Shakely in National Review, voters “were receiving notices warning that their right to vote could be in jeopardy if they did not return an absentee ballot to the ‘Pennsylvania Voter Assistance Office,’ a fictitious agency headquartered at a post office box. The letters…were underwritten by the Pennsylvania Democratic State Committee.”

    This comes on top of the sharp increase in Democrat absentee ballot requests in Pennsylvania in 2008 — probably because they threw away non-Democrat requests. This tactic resembles incidents in Texas and Arizona. And in Harris County, Texas, a former SEIU member registered 23,207 fraudulent voters. There are rampant incidents of voter intimidation being documented in Harris County.

    Americans, be prepared: the same thing could occur in your town, at your polling place, on November 2.

    It is not enough to win Tuesday. We must win big, by a landslide. There is more evidence than just what is above that the Democrats appear to be trying to steal the election. They have had plenty of practice — ask Al Franken. The ghost vote used to account for maybe six to eight percent of the vote. There is no telling where that number is now, with organizations like ACORN and SEIU gaming the system for years.

    When Democrat House Speaker Nancy Pelosi speaks confidently of keeping her leadership position, it’s not because she is crazy. It’s because she knows something we don’t know. Do not underestimate the moochers and the looters. They appear to be willing to do anything to hold on to the reins of power – even crossing the line of illegality.

    Consider this: our soldiers are being denied their right to vote while they lay down their lives for us in the bloody war waged by the Islamic jihad, but the votes of felons and convicts count — as do the those of the homeless (whose benches are registered as their homes). But not our soldiers. And the Democrats do this every election.

    It’s hard to feel anything but contempt for Barack Obama. Notice the uptick: his rhetoric in recent days has been increasingly radical. Judging from the tone of his recent public statements, Obama seems to think he’s back in some Third World country where banana republic dictators steamroll over the little people and the fat cat corruptocrats rule.

    Not so fast, buddy.

    What ever happened to the rule of law? Who is investigating these allegations of voter fraud now? Is there no one protecting and preserving the Republic? We have lain down too long. This is a call to action — that means you and your loved ones. Ask yourself: what have I done today to save the Republic? Volunteer at the polls, volunteer for a candidate, volunteer to drive an elderly or infirm neighbor to the polls. Do something, anything.

    If something is not done in these rampant incidents of Democrat voter fraud, millions should march on Washington. They can’t steal the country. They must not be allowed to steal it. We must not let these thieves, carpetbaggers, thugs, moochers and looters keep control over America — they will have to go through us first.

    I do have some thoughts about this and the 2012 election and how it relates to the TAA's plans that I'd like to expound upon when I have a little more time.

    Stopping Voter Fraud
    Voter fraud happens. Just ask Olivia Alair, press secretary for the U.S. Department of Transportation. Alair was regional communications director for the 2008 election in Ohio under White House press secretary Robert Gibbs. In 2008, Alair and two other Obama campaign staffers registered to vote in Ohio. The problem was that Alair did not live in Ohio and had no permanent plans to do so. By Ohio law, this made her ineligible to register. Only after this was made public did Alair and her cohorts send letters asking that their registrations be canceled. If the press had never made this public, would Alair have gone ahead and committed a felony by voting? Only she knows. But her cavalier attitude toward our nation's voting laws permeates the entire Obama administration.

    In 2004, an immigrant illegally registered to vote in Putnam County, Tenn., and then voted illegally. This is a felony three times over! 18 U.S.C. § 1015(f) makes it illegal to claim you are a U.S. citizen in order to register to vote for any election; 18 U.S.C. § 611 prohibits a noncitizen from voting in an election where there is a federal candidate on the ballot; and 18 U.S.C. § 911 makes false claims of citizenship in general a felony. Instead of prosecution, the Obama administration sent the immigrant a letter asking him when he "discovered" that he was "not a United States Citizen." Protecting the ballot box was not their priority (you can read more about The Threat of Non-Citizen Voting, here).

    And the Tennessee case was not an isolated incident. Thanks to the U.S. Commission on Civil Rights, we now know that not protecting the ballot box from voter fraud is the official policy of the Obama Justice Department. Former American Civil Liberties Union attorney and current Justice Department employee Christopher Coates testified before the committee that: 1) Deputy Assistant Attorney General Julie Fernandes ordered DOJ attorneys only to enforce "traditional types of [voter intimidation] cases that would provide political equality for racial and minority language voters;" and 2) Fernandes informed DOJ attorneys that it was the policy of the Obama administration not to enforce anti-voter fraud laws since Obama "was not interested in that type of issue, but instead interested in issues that pertained to voter access." Fernandes has never responded to these allegations.

    For most electoral races today, fraud will not be a factor. But there are some races where some will desperately cling to power in a close election. And that is where voting fraud is most likely to happen. The Heritage Foundation's voting law expert Hans von Spakovsky told Fox News:

    Any place where we have very close elections, there's always going to be the potential there that voter fraud may make a difference, and that's where we are going to have to be really careful to be sure that doesn't happen.

    In fact, voter fraud has already happened in this election. A Daytona Beach City Commissioner was arrested for absentee ballot fraud just last week. In Troy, N.Y., Democrats on the city council have been ordered to supply DNA to prosecutors to be tested against absentee ballots and absentee ballot applications that were allegedly forged. And in Bucks County, Pa., a Democratic program intimidated some voters into needlessly, and sometimes fraudulently, applying for absentee ballots.

    Federal law does allow for poll workers to assist the disabled and those who can't read English. But, if you see or hear a poll worker attempt to give unsolicited instructions to any voter (other than technical instructions), that is not allowed. Neither is any electioneering in or near the polling place, and promises of payments for voting of any kind (whether it be cash or free food) are also illegal. If you witness any of these activities, notify both the chief election official in their particular county or city, as well as the media to make sure that officials do something about it.

    The right to vote in a free and fair election is the most basic civil right, on which depends all of the other rights of the American people protected by the Bill of Rights. Unfortunately, as long as elections put people into positions where they can make decisions about how much the government will spend, who will receive the money, and how the government will exercise its power, elections will be important enough to tempt some individuals to steal them. As the Supreme Court recognized when it upheld the constitutionality of Indiana's voter identification law in 2008, flagrant examples of voter fraud "have been documented throughout this Nation's history by respected historians and journalists." Those examples "demonstrate that not only is the risk of voter fraud real but that it could affect the outcome of a close election." Be on the look out to protect your most basic civil right today.

    I'm very curious and going to be paying a lot of attention to just what effect the Tea Party has on the outcome. Will they gather enough independent support to push the conservative candidates forward, or will they split GOP votes conservatives vs moderates giving advantage to the left. Arguements have been made on both sides and it'll be interesting to see just what happens. I kind of suspect a little of both will happen.

    Overall I think the right will regain a lot of the 2008 losses. 2012 will see them sitting stronger than where they left off in 2008.

    Actually... Toad, for the most part the Tea Party in nearly every state has pushed forward REPUBLICAN candidates.

    In other words, they won't split the vote since the primaries.

    However we have one oddity here in Colorado, for governor.

    Dan Maes was the Tea Party push originally. Tancredo joined the fray AFTER the fact.

    Maes is running as Republican. Hickenlooper is running as Dem (he's the mayor of Denver, and he sucks bad).

    Suddenly Maes had a lot of stuff come out about him which has turned people off, Tancredo (whom I actually LIKE, but I think should have stayed the hell out of it) - on the other hand, Conservatives have endorsed him big time. Including as of yesterday, Sara Palin.

    Thus... today, I vote. I have no idea how the previous, early voting has gone, or in which direction.

    But when I heard Palin was endorsing Tancredo (and again, I'd have voted in the primaries for him ANYWAY had he run, but he WASN'T RUNNING!) now I will vote for him.

    So we might end up with a badly split vote here in CO putting that moron in office as Governor.

    I hope not, but that's how it goes

    O'Donnell faces obstacles in effort to air 30-minute TV ad in Delaware

    Christine O'Donnell is taking a page from the playbook of Barack Obama.

    The Republican Senate candidate has produced a 30-minute television advertisement in the form of a documentary chronicling her connection with the people of Delaware.

    But unlike Obama's ad at the end of the 2008 race, the tea party insurgent's campaign has run into obstacles getting it in front of voters before Election Day. The campaign did not purchase advance time on networks in the Philadelphia or Delaware markets, said a source close to the O'Donnell campaign, and the networks did not have time available to air the ad on such short notice.

    So O'Donnell turned to a public access television station, Delaware Channel 28. She told supporters at a Tea Party Express rally on Sunday in Wilmington to watch that night at 11:30. "Tell everyone to tune in," she said at the rally.

    "1 minute until the premiere of our 30 minute feature. Tune in to meet all the heart warming people I've met on the campaign trail. Ch. 28," O'Donnell tweeted Sunday night.

    But the ad never aired.

    A few minutes later, O'Donnell tweeted: "Okay... this is NOT our show! Must be a programming mix up. We will get back to you..."

    The source, who spoke only on the condition of anonymity to discuss sensitive campaign operations, said the station "forgot to air it."

    Then on Monday morning, O'Donnell's campaign issued a press release saying the ad would air on Channel 28 at 10 a.m. The candidate tweeted: "The Inspiring TV show about Delawareans will air at 10 aam and 3 pm today on Channel 28. Please watch this before you vote."
    And again, it did not air.

    "This isn't our show either! We are told channel 28 'forgot' to air it...both times... even though we paid for the time slot last week," O'Donnell tweeted shortly after 10 a.m.

    Tim Qualls, executive producer at Channel 28, said in an interview the ad did not air because O'Donnell's campaign did not bring a tape to the production studio by the agreed upon deadline. She reserved the time on Thursday, for $2,500, and agreed to bring a tape by Friday at 5 p.m., Qualls said.

    "I did not receive a tape until Sunday night at one of my employees' houses," Qualls said. "It has nothing to do with us refusing to air it. I just didn't get the tape by my deadline."

    Qualls added: "It was all their people's fault."

    He said he is a Republican and had planned to vote for O'Donnell, but the tape situation changed his mind. "She's lost my vote," Qualls said.

    O'Donnell spokesman Doug Sachtleben said he was not sure why the ad did not air Sunday night. "I don't know if it was something on the cable channel's side," he said in an interview.

    Sachtleben said the ad is scheduled to air on Channel 28 twice each on Monday and Tuesday, at 10 a.m. and 3 p.m., and that the campaign is negotiating on Monday for an airing on WBOC-TV, the Fox affiliate in the Delmarva Peninsula.

    The campaign's plan Tuesday "is to go station to station with a DVD in hand begging anyone to run it," said the source.

    O'Donnell has run behind her Democratic opponent, Chris Coons, in every recent public poll. The ad, titled "We the People of the First State," is a last-ditch effort to win over more support before Tuesday's election with a closing argument that O'Donnell, unlike Coons, connects with people of Delaware.

    But Sachtleben said the campaign is unlikely to air the ad in the Philadelphia market, which covers the more densely populated northern parts of Delaware.

    In an interesting twist, the ad guru who has produced O'Donnell's television ads, Fred Davis, was not involved in producing the 30-minute video. Sachtleben said it was produced by Screaming Dime Productions, a firm from California.

    It is billed as a 30-minute advertisement, but the video is 24 minutes.
    The ad, narrated by O'Donnell, opens with sweeping shots of Delaware's beaches, natural beauty and small-town charm. Then it quickly segues to footage of shuttered storefronts and "For Lease" signs.

    "This video takes viewers past the filters of the mainstream media and gives a powerful look at a candidate who understands the struggles and opportunities that Delaware families are facing," Sachtleben said in a statement.

    The question for O'Donnell is whether enough voters will tune in.

    Illinois Challenge for Military Ballots

    As work gets underway Monday morning, members of the House Administration committee will receive a letter from Illinois Republican Party Chairman Pat Brady. The letter urges an investigation into shortcomings of election districts tasked with providing absentee voters, specifically combat soldiers, ballots in the time required by law.

    "I respectfully write with an urgent request for the House Administration Committee to investigate serious deficiencies in the nationwide implementation and enforcement of the Military and Overseas Voter Empowerment Act of 2009," writes Brady.

    The MOVE act is an amendment to the 1986 Overseas Citizens Absentee Voting Act ("UOCAVA"). The key element of that act is the requirement that ballots be sent 45 days ahead of the election, creating ample time for soldiers in Iraq and Afghanistan to receive their ballots and mail them back in time to be counted. That means ballots needed to be mailed by September 18th.

    In 35 out of 110 Illinois voting districts, they were not. At least one district was 20 days late.

    Brady's letter claims efforts by the Department of Justice and the Illinois State Board of Elections to ensure compliance with the law were "lackadaisical at best." The letter claims the DOJ sent a status inquiry to the Illinois SBE four days before the legal deadline and the response was a two sentence e-mail assuring the DOJ that Illinois Electoral Districts were on track to meet the deadline. There was no county by country request for information and no mention that counties in Illinois were refusing to print, until a court challenge to include a 3rd party on the ballot was resolved.

    Representatives of the SBE, the DOJ and the Illinois Attorney General, met and produced a consent decree that adds one day for soldiers and other Illinois absentee voters to get postmarks on their returning ballots. It provides more time for the ballots to be counted, but the point of contention for Illinois Republicans is that the period of time for some soldiers and other absentee voters to receive and return their ballots is unfairly shortened.

    So, Illinois Republicans are requesting an investigation on behalf of American service members, "that their votes are not disenfranchised by the accidental or willful acts of local election authorities, and that the Department of Justice vigorously ensure that the provisions of the MOVE Act are enforced."
