LAVEEN, Ariz. (CBS News) - An Arizona man is fighting his Home Owner's Association over a flag that many are using to represent the Tea Party movement.
Andy McDonel is flying the historic "Don't Tread on Me" flag outside his Laveen, Arizona home.
He's been flying the flag since January, but recently his H.O.A. asked him to take it down.
He's appealed to the board but was denied. He's now been fined for flying the flag.
McDonel says, "There's no way that I'm going to take the flag down because an uneducated board member or an uneducated management company member doesn't recognize what the flag truly is."
Neighbors support McDonel's decision to fly the flag.
Ed Turner: "If you want to fly a flag that represents something you believe in than you should be able to do it without anyone telling you that you don't have a first amendment right."
Arnie Gonzales: "I think it's the same as a freedom of speech, you know.
It's a flag that anybody should be able to fly no matter what it's for."
The state is also on McDonel's side. Arizona law states that the U.S. Flag, the state flag, and military flags may be flown in outdoor displays.
McDonel said Sunday he'll keep fighting for the right to fly the flag and to stop the fines.
