Petraeus mistress won't face cyberstalking charges

The David Petraeus biographer whose aggressive emailing launched the federal investigation that brought down the CIA director will not be criminally charged with cyberstalking, the U.S. attorney’s office in Tampa announced Tuesday.
Paula Broadwell, the author and fellow West Point alum who had an affair with Petraeus, was widely reported to have harassed local socialite Jill Kelley, who hosted parties for military officials at her Tampa home.

“The decision on whether to bring a prosecution is always a serious matter, and one that should never be undertaken without the most thoughtful deliberation,” said William Daniels, the spokesman for Tampa U.S. Attorney Robert O’Neill. “As federal prosecutors, we are guided in the discharge of our responsibilities by considerations of fairness and justice. The prosecution of a case is undertaken only after the most careful review and analysis of the evidence and applicable law. After applying relevant case law to the particular facts of this case, the United States Attorney's Office for the Middle District of Florida has decided not to pursue a federal case regarding the alleged acts of ‘cyber-stalking’ involving Paula Broadwell.”
Broadwell, who authored the fawning biography “All In” about Petraeus, reportedly wrote threatening, anonymous emails to Kelley that suggested she would make her “go away” in retaliation for her socializing with Petraeus and Gen. John Allen, the commander of U.S. forces in Afghanistan. Kelley reported the emails to the FBI, which eventually began its investigation.
The Justice Department declined to comment Tuesday.
UPDATE: “We are pleased with the decision, and are pleased with the professionalism of the Tampa United States Attorney’s Office, particularly Assistant United States Attorney W. Stephen Muldrow.” Broadwell's attoruney Robert Muse said in a statement.
