Obama declares Bears Ears National Monument in southern Utah

By BRIAN MAFFLY AND THOMAS BURR | The Salt Lake Tribune
    First Published Dec 28 2016 01:57PM • Updated 5 hours ago

President Barack Obama on Wednesday protected a sprawling landscape in southeastern Utah that many had either hoped or dreaded would join the outgoing president's long list of national monuments.

The 1.35 million acres of public lands surrounding San Juan County's Cedar Mesa will be known as Bears Ears National Monument, named after the pair of buttes protruding from a ridge joining the mesa and the Abajo Mountains to the north.

What is Bears Ears? Read more here, see how Utahns are reacting and read Obama's proclamation.

Obama made the designation at the behest of five Indian tribes with ancestral and spiritual ties to Cedar Mesa, the highlands west of Blanding where ancient cultural sites abound.

The president also set aside Gold Butte National Monument in southern Nevada. That 300,000-acre monument is near the ranch of Cliven Bundy, who stands charged, along with supporters, in the 2014 armed standoff with federal officers trying to seize his cattle.

Like Bears Ears, Gold Butte includes "abundant rock art, archaeological sites, and lands considered sacred by Native American tribes," according to a White House statement.

"Today's actions will help protect this cultural legacy and will ensure that future generations are able to enjoy and appreciate these scenic and historic landscapes," Obama's statement continues.

A Bears Ears Commission was also established to work with the federal Interior and Agriculture departments to craft a management plan for the monument that reflects "tribal expertise as well as traditional and historical knowledge," according to a White House news release.

There has been broad agreement that the Bears Ears region should be protected, but opinions diverge sharply over the extent of that protection and the mechanism for achieving it.

In the works for several years was Rep. Rob Bishop's Utah Public Lands Initiative — a seven-county "grand bargain" designed to protect some Utah lands, open others to development and circumvent a monument. The PLI was introduced into the U.S. House in July, but Congress adjourned this month without taking action on it.

The new monument's footprint hews closely to the PLI's proposal for national conservation areas in San Juan County. But Bishop and many other state and San Juan County leaders say executive decree deprives locals of their voice and perpetuates conflict over use of public lands.

Utah Sen. Orrin Hatch called Obama's declaration an "attack on an entire way of life" and an "astonishing and egregious abuse of executive power" that far exceeds the intent of the Antiquities Act.

"In the next Congress under President [Donald] Trump, I will do everything in my power to reverse this travesty," Hatch said.

He said he'll meet with Trump's pick to lead the Interior department, Montana Rep. Ryan Zinke, to discuss reversing the monument, and he and fellow Utah Sen. Mike Lee plan to reintroduce legislation exempting Utah from the Antiquities Act.

"This arrogant act by a lame duck president will not stand," Lee said in a statement. "I will work tirelessly with Congress and the incoming Trump administration to honor the will of the people of Utah and undo this designation."

According to the White House, Wednesday's action is an attempt to satisfy both the PLI and a larger proposal from the Bears Ears Inter-Tribal Coalition, made up from representatives of the Hopi Nation, Navajo Nation, Ute Mountain Ute Tribe, Ute Indian Tribe of the Uintah Ouray and Zuni Tribe.

Christy Goldfuss, managing director of the White House Council on Environmental Quality, said there has been broad support, including from Utah's elected officials, to protect the area, with the only difference the size, scope and means to do so.

"We are not concerned about a backlash about this designation, given the support for the location and the value and the cultural significance of this place," Goldfuss said on a conference call with reporters. "Of course, there are always political discussions but on the merits, this is the right thing to do and consistent with our designations across the board."

Gov. Gary Herbert held a press conference Wednesday to denounce the new national monument, saying Obama left a "little bomb here in Utah" on his way out of office, apparently to punish a state where he has had little support.

Obama abused his power to create a record 25 national monuments, Herbert said, likening his actions to a dictator's. "It's certainly not the democratic way, it's certainly not the American way," he said.

Utah Attorney General Sean Reyes announced Wednesday he is working with Herbert, the state's congressional delegation and lawmakers on a lawsuit, "and we are confident in our chances of success."

A legal challenge has a good chance, Herbert said, because the Antiquities Act requires creation of monuments as small as possible to protect resources — and the new monument is larger than Delaware and Rhode Island, and 1 million acres larger than Canyonlands National Park, the largest of Utah's national parks.

The monument has "added to the divisiveness on the public land issues that we have here is this state and other states, and the growing unrest that we have here."

However, he urged people to avoid any violence and to fight the monument within options available under the law.

"We have under the law opportunities for remedies," including Congress passing a law to override the monument, having the new Trump administration reduce or remove the monument or fighting in court.

He said he has talked to Vice President-elect Mike Pence about the issue, and expects the incoming Trump administration to look at least at reducing the size of the monument.

Herbert said Interior Secretary Sally Jewell called him at 1:45 p.m. Wednesday — a little more than an hour before the monument was announced — to inform him of the monument designation.

Jewell agreed with him, he said, that protecting the area through legislation would have been better, but argued that Utah's congressional delegation failed to pass anything — so the monument was needed.

"I disagree," Herbert said, adding it may take longer to pass legislation, but it's the best way to find compromise and ensure proper protection of all parties.

Officials elected to various tribal government posts argued Utah leaders had their chance and failed to come up with a meaningful conservation plan, which left them with no choice but to go straight to the president with a proposal.

The Bears Ears Inter-Tribal Coalition identified 1.9 million acres it wanted set aside. The president's proclamation includes about two-thirds of that, leaving out lands west of Natural Bridges National Monument, including Red and Moki canyons, the Abajo Mountains and some lands around Bluff that are encumbered with oil and gas leasing.

But the coalition applauded Wednesday's announcement.

"For the first time in history, a president has used the Antiquities Act to honor the request of Tribal Nations to protect our sacred sites," said David Filfred, Navajo Nation Council delegate.

Russell Begaye, the president of the Navajo Nation, said on the White House conference call that the 1.35 million acres protected by Obama is what the tribes "most want" to be preserved. He said other discussions had ranged from 1.2 million acres to 1.9 million acres.

The monument's size is "sufficient" to protect the areas that are sacred to the tribes, "where our people gather herbs and where our people go out and do ceremonial events," Begaye said.

Begaye added that Wednesday's announcement was an "exciting" moment after decades of efforts to preserve the area.

"The Bears Ears region is a special, distinctive and significant place to surrounding tribes as well as my nation, the Navajo nation," Begaye said. "These places, the rocks, the wind, the land — they are living, breathing things that deserve timely and lasting protection."

Longtime monument proponent Mark Maryboy — a former San Juan County commissioner and former member of the Navajo Nation council — said he believed the monument designation would protect the cultural importance of the land while also preserving it for the use of all Americans for generations to come.

"This monument is for everybody," he said. "It belongs to everybody. Its land will be protected for our generation, and many more generations to come."

Maryboy said there was a Navajo prayer ceremony on Wednesday in which they implored Mother Earth and the Navajo gods to protect the designation and prevent Trump from reversing the decision. A bigger celebration is planned for Jan. 7.

While many residents of tourism-dependent Bluff supported the monument push, most in Blanding and Monticello have been steadfastly opposed.

"I don't know why anybody would want to lock up all the resources in this country so that we can't use them, and that's what they're doing," said Val Dalton, a San Juan County rancher who has grazing allotments within the monument.

The monument's proclamation preserves existing rights to mine, drill and graze within the monument, but Dalton says he is worried about what the future holds for his children, who will inherit the family business.

It is already difficult to make a living in San Juan, he said, "because we can't use our resources. We're locked out of them, and they want to lock us out of more and more of it. ... I hope somebody can undo it."

Toni Turk, a former mayor of Blanding, called the monument designation "an overreach" by Obama.

"If they really wanted to just concentrate on the Indian ruins, which is what the Antiquities Act is about, that would have been one thing," he said. But 1.3 million acres is "excessive," he said.

"I'm not surprised. I expected it," Turk said. "And I also expect it will be a casualty of a President Trump administration."

When told there is little legal precedent for overturning a national monument, Turk said, "Yes, and there's no precedent for Donald Trump, either."

With Bears Ears, Obama has invoked the Antiquities Act at least 27 times, setting aside more land, ocean and historic sites for conservation than any other U.S. president. Not including Bears Ears, 12 Western-state landscape-level monuments have been created in the last five years, covering nearly 4 million acres.

The Bureau of Land Management will administer Bears Ears, which is to be added to the National Landscape Conservation System, or the NLCS. This 27-million-acre network of protected Western lands includes monuments, wilderness, Wild and Scenic rivers and historic trails.

Utah's new monument is among NLCS's largest, though smaller than Grand Staircase-Escalante National Monument, the inaugural piece of the NLCS.

Clinton's surprise designation in 1996 of this monument rankles southern Utahns to this day, and the monument's alleged stifling of economic development has been repeatedly cited in the case against Bears Ears.

Turk said he expects that Grand Staircase "will also be given a very close look" and be "turned back as well" during Trump's tenure.

Don Peay — founder of Sportsmen for Fish and Wildlife, who led the effort to elect Trump in Utah — says Obama's Bears Ears designation "reminds us how grateful we are that Trump won."

"I don't think public lands in the West could have survived eight years of Hillary Clinton," he added.

Peay said he expects the Trump administration will work with Congress to minimize the acreage of the monument and ensure local input. Obama's action, he said, plays into the "broader narrative of why people in smaller communities and non-urban centers didn't like Obama or Clinton.

"I can hardly imagine the Trump administration taking an action that is opposed by every elected official in the state," Peay added. "It's just classic Washington, D.C., politics that doesn't care about the local people."

The monument includes roughly 109,000 acres of state school trust lands, according to The Utah School and Institutional Trust Lands Administration (SITLA). Those areas remain part of SITLA's 3.3-million-acre management portfolio, but are now blocked from development, SITLA spokeswoman Deena Loyola said, limiting the amount of revenue that can be generated for public schools.

SITLA awarded roughly $50 million to Utah schools this year. Loyola said it is not yet known how the designation will affect the value of the $2.1 billion Permanent State School Fund, or the annual payments made to schools from the fund's earnings.

Last year, the Utah Board of Education passed a resolution requesting that new monuments in the state include a land-swap or payment to the Permanent State School Fund, a precedent set in 1999 following the designation of the Grand Staircase-Escalante National Monument. Obama's Bears Ears proclamation specifically outlines a process for transferring BLM acreage to SITLA.

In a prepared statement, SITLA Director David Ure said Utah's education system must be fairly compensated for the lands captured by the Bears Ears designation.

"We are disappointed that this designation happened through unilateral executive action, rather than through negotiation and compromise," Ure said, "but SITLA will work in good faith to determine if an exchange agreement is possible and in the best interests of the school trust beneficiaries."

President Obama Calls Donald Trump to Reaffirm ‘Smooth Transition of Power’

    by Charlie Spiering
    28 Dec 2016

President-elect Donald Trump confirmed that he spoke with President Barack Obama on the phone today after he signaled disappointment with the tone of the presidential transition.

“I did he called me, we had a very nice conversation,” he told reporters at Mar-a-Lago when asked about the phone call. “We had a general conversation. Very, very nice.”

Obama called Trump from Hawaii, where the president and his family are currently on vacation. The White House issued a statement after the call, asserting that Obama was still committed to a smooth transition.

“Today’s call, like the others since the election, was positive and focused on continuting a smooth and effective transition,” the statement read. “The President and President-elect committed to staying in touch over the next several weeks and agreed their respective teams would continue to work together to effectuate a smooth transition of power on January 20th.”

Earlier in the day, Trump signaled dissatisfaction about the transition in a message on Twitter.
“Doing my best to disregard the many inflammatory President O[bama] statements and roadblocks,” he wrote. “Thought it was going to be a smooth transition – NOT!”

Trump was likely referring to comments Obama made on a CNN podcast about beating the president-elect in the election, had he been allowed to run for a third term as president.

“I am confident in this vision because I’m confident that if I had run again and articulated it, I think I could’ve mobilized a majority of the American people to rally behind it,” he said.

Happy New Year, America! Now Suffer

    (AP Photo/Carolyn Kaster)

As the late Ed Koch, former mayor of New York City, once famously said; "The people have spoken, and they must be punished."
President Obama's lame duck administration poured on thousands more new regulations in 2016 at a rate of 18 for every new law passed, according to a Friday analysis of his team's expansion of federal authority. While Congress passed just 211 laws, Obama's team issued an accompanying 3,852 new federal regulations, some costing billions of dollars.

The 2016 total was the highest annual number of regulations under Obama. Former President Bush issued more in the wake of 9/11. The proof that it was an overwhelming year for rules and regulations is in the Federal Register, which ended the year Friday by printing a record-setting 97,110 pages, according to the analysis from the Competitive Enterprise Institute.

The annual "Unconstitutional Index" from Clyde Wayne Crews, CEI's vice president for policy, said that it was much higher under Obama than under former President George W. Bush.Sponsored
While Congress leaves much to be desired, it's not the passing of useless laws that's the real disgrace in Washington. That honor belongs to the regulatory agencies, the unconstitutional means through which petty dictators like the Emperor Hussein torture their subjects with next to zero political accountability. As I wrote about the agencies here at PJ Media:

The Constitution doesn't matter to them, nor do legalistic protestations, nor simple human decency. No, armed with nothing more than their own impunity, agents from EPA or OSHA or any other federal agency with a SWAT team (which is most of them) can simply make demands on citizens in the name of "regulations."

This is the inevitable result of ceding representative government to cabals of empowered clerks. Recall that while Republicans talk a good game about "limited government," in fact they're almost as big proponents of Big Government as the Democrats, and promises to the contrary are just a ruse to sucker the rubes into voting for the junior wing of the Permanent Bipartisan Fusion Party, so we all can pretend to believe in democracy.

But democracy is null and void in the face of faceless tyranny like the EPA, which cannot reform itself, and will never stop until it is put out of business, dismantled and its buildings pulled down around its ears. "Mission creep" is the order of the day for the creeps who run these rogue enterprises; I'll believe in smaller government the day I see wrecking balls outside the departments of energy and education, for starters.

Obama's final three weeks in office are already shaping up as a prolonged temper tantrum against a country he's long despised: stabbing Israel in the back, grabbing land in the Mountain West, ruling the Arctic off-limits for energy exploration, trying to pick a fight with Russia -- these things, alas, are just prologue for what is to come. Look for more CIA-sponsored trouble in the international arena, including another spat with Britain, and be very afraid of what will certainly be the largest mass pardon of dangerous criminals in American history as he sashays out of office and into a comfortable, if activist, retirement, courtesy of the American taxpayer.

Obama's Sour Happy New Year to America and the World

The eight years of Barack Obama will go down in American as the strangest aberration in our electoral politics -- a man of dubious background, no accomplishment, no administrative skills, no vision except for the warmed-over cultural Marxism of his youth. A man who preferred to golf, party and vacation, as if the presidency was the first prize in a television game show. A "Being There" president whose "legacy" will whisk away in the wind like the gold dust at the end of The Treasure of the Sierre Madre, except that the joke's been on us all along

President Obama Awards Himself Distinguished Public Service Medal

On Wednesday, President Obama added another prestigious medal to his Nobel Prize collection when he had Defense Secretary Ash Carter award him with the Department of Defense Medal for Distinguished Public Service.

Secretary Carter awarded his boss with the medal on January 4 during the Armed Forces Full Honor Farewell Review for the President held at Conmy Hall, Joint Base Myer-Henderson Hall in Virginia.

Carter insisted that the medal was a token of appreciation for Obama’s service as commander in chief, the Associated Press reported.

After spending the last few weeks throwing roadblocks in the path of President-elect Donald Trump and his transition team, Obama nonetheless claimed in his remarks to the members of the military in attendance that “We’ve got to make sure that during this transition period that there is a seamless passing of the baton, that there’s continuity.”

Along with the AP, CBS News White House correspondent Mark Knoller also marked the ceremony with a Tweet to his followers.

Many commenters on Knoller’s Twitter feed were incredulous at the award. Some likened the award to a much maligned “participation medal” and others were skeptical of Obama’s underling giving his own boss a medal.

@markknoller so Carter whom was picked for Secretary of Defense by Obama gives him an award! I wonder who's idea that was EGO & CHIEF?

In Stunning Last Minute Power Grab, Obama Designates Election Systems As "Critical Infrastructure"

    ZeroHedge
    by Tyler Durden
    Jan 6, 2017 7:42 PM

In a stunning last minute power grab by the Obama administration with just 14 days left in his Presidency, the Department of Homeland Security released a statement this evening officially declaring state election systems to be "critical infrastructure." The statement from DHS Secretary Jeh Johnson defines "election infrastructure" as "storage facilities, polling places, centralized vote tabulations locations, voter registration databases, voting machines" and all "other systems" to manage the election process...so pretty much everything.

I have determined that election infrastructure in this country should be designated as a subsector of the existing Government Facilities critical infrastructure sector. Given the vital role elections play in this country, it is clear that certain systems and assets of election infrastructure meet the definition of critical infrastructure, in fact and in law.

I have reached this determination so that election infrastructure will, on a more formal and enduring basis, be a priority for cybersecurity assistance and protections that the Department of Homeland Security provides to a range of private and public sector entities. By “election infrastructure,” we mean storage facilities, polling places, and centralized vote tabulations locations used to support the election process, and information and communications technology to include voter registration databases, voting machines, and other systems to manage the election process and report and display results on behalf of state and local governments.

Of course, it's likely not a coincidence that the DHS made this announcement just hours after the "intelligence community" declassified their "Russian Hacking" propaganda which basically noted that RT has a very effective social media distribution platform while once again providing absolutely no actual evidence.

Johnson's statement goes on to note that while many "state and local election officials are opposed to this designation" he went ahead with his decision anyway, because that's just what the Obama administration does.

Prior to reaching this determination, my staff and I consulted many state and local election officials; I am aware that many of them are opposed to this designation. It is important to stress what this designation does and does not mean. This designation does not mean a federal takeover, regulation, oversight or intrusion concerning elections in this country. This designation does nothing to change the role state and local governments have in administering and running elections.

The designation of election infrastructure as critical infrastructure subsector does mean that election infrastructure becomes a priority within the National Infrastructure Protection Plan. It also enables this Department to prioritize our cybersecurity assistance to state and local election officials, but only for those who request it. Further, the designation makes clear both domestically and internationally that election infrastructure enjoys all the benefits and protections of critical infrastructure that the U.S. government has to offer. Finally, a designation makes it easier for the federal government to have full and frank discussions with key stakeholders regarding sensitive vulnerability information.

Particularly in these times, this designation is simply the right and obvious thing to do.

Of course, one of the most vocal opponents of this move has been Georgia Secretary of State Brian Kemp who recently told Politico it is nothing more than an attempt to "subvert the Constitution to achieve the goal of federalizing elections under the guise of security."

During an earlier interview with the site Nextgov, Kemp warned: "The question remains whether the federal government will subvert the Constitution to achieve the goal of federalizing elections under the guise of security." Kemp told POLITICO he sees a “clear motivation from this White House” to expand federal control, citing Obama’s health care law, the Dodd-Frank financial-reform legislation and the increased role of the Education Department in local schools.

To some election officials, this sounds like the first stage of a more intrusive plan.

“I think it’s kind of the nose under the tent,” said Vermont Secretary of State Jim Condos, a Democrat. “What I think a lot of folks get concerned about [is] when the federal government says, ‘Well, look, we’re not really interested in doing that, but we just want to give you this,’ and then all of a sudden this leads to something else.”

Meanwhile, Kemp continued on by noting that "this administration only has 15 days left in its term" and to make such a critical decision during the 11th hour "smacks of partisan politics."

But we're sure it's nothing, Obama doesn't really strike us as the type to play the "partisan politics" game.

    Obama’s Legacy Of Deceit

    by Victor Davis Hanson
    Thursday, January 5, 2017

In its remaining days in power, the Obama administration suddenly punished Vladimir Putin’s Russia for allegedly interfering in the U.S. presidential election. It claimed that Russian or Russian-hired hackers tapped into the records of the Democratic National Committee as well as the correspondence of John Podesta, a Clinton advisor.

But what the Obama administration did not say was that such cyber-crimes are by now old hat. Both the Russian and Chinese governments have been hacking into far more important U.S. records and government archives for years without earning retaliation

The administration also did not mention that the election hacking occurred largely because of Podesta’s own carelessness in using his security password. Moreover, it failed to acknowledge that the Republican National Committee was likewise targeted, but apparently had enough safeguards to prevent successful entry into its records. Finally, the administration refused to mention that Wikileaks founder Julian Assange went on the record saying that he did not receive the email trove from the Russians.

The truth is that Obama, throughout his presidency, has appeased Putin. As president, Obama ended the previously agreed-on Eastern European missile defense; he made open-mic promises to be more flexible with Putin after his reelection; he barely responded to Russia’s aggression toward Crimea and Ukraine; and he constantly criticized both George W. Bush and Mitt Romney for being inordinately tough on Russia.

Until now, he saw no reason to stop enabling Russia. Had Hillary Clinton won the election, Putin’s alleged hacking would not have earned any administration attention. But this time around, an emboldened Putin allegedly went too far and crossed the only red line that Obama might have enforced by supposedly enabling the release of information that might have turned off some voters on Clinton. Blaming Putin for Clinton’s loss was a more convenient narrative than admitting that Obama’s own policies have turned off even traditional Democratic constituencies and for now reduced the Democratic Party to a minority coastal party.

All administrations play fast and loose with the truth. It is the nature of high politics to fib, cover up, and fudge in order to ensure the success of a so-called noble agenda for the greater good. But not since the Lyndon Johnson and Richard Nixon administrations have we seen a president so institutionalize misrepresentation.

There are ample examples. It was clear from Clinton’s own leaked emails and from real-time memos from intelligence agencies that the September 11, 2012 attack on the American consulate in Benghazi was not a spontaneous riot over an insensitive video produced by a reactionary Coptic zealot residing in the United States, as the administration claimed. But such a concoction fit Obama’s 2012 reelection narrative: the recklessness of right-wing Islamophobes endangers national security abroad. In contrast, the reality—a preplanned al-Qaeda-affiliated attack on an unprepared and semi-covert American consulate—challenged Obama’s reelection myth that Al Qaeda was “on the run” and that the administration was vigilant in ensuring security for our diplomatic personnel in the Middle East.

The U.S. Ambassador to the U.N. at the time, Susan Rice, went on five Sunday morning talk shows to insist, quite wrongly, that the deaths of four Americans in the attack were the tragic result of ad hoc furor over intolerance. The video-maker Nakoula Basseley Nakoula was abruptly jailed on probation violation charges, in a display of swift American justice never matched by a commensurately prompt arrest and prosecution of real terrorists.

Another example of Obama administration’s misrepresentation concerns U.S. army soldier Bowe Bergdahl, who went AWOL from his post in Afghanistan and ended up a captive of Taliban affiliates from June 2009 until his release in May 2014. The Obama administration conducted lengthy and stealthy negotiations to return the deserter to U.S. custody. As part of the bargain, it agreed to release five Taliban terrorists from the detention center in Guantanamo Bay. In an about-face, an Army command announced last year that Bergdahl will soon be facing charges of desertion and misbehavior before the enemy. Yet to gain Bergdahl’s release, the Obama administration fabricated a completely different narrative to justify the embarrassing swap and concessions to the Taliban. Bergdahl, in National Security Advisor Susan Rice’s words, “served the United States with honor and distinction.”

Upon his release, Bergdahl parents were brought to the White House for photo-ops, where his father appeared with a long beard and shaved lip—not unlike the facial hair worn by his son’s Taliban captors. Bill Bergdahl thanked the concerned parties and broke into rudimentary Pashto and Urdu, praising Allah for his son’s release. The staged press conference was designed to underscore the administration’s view that the son of a multicultural family had naively and innocently wondered off from his compound. But now, young Bergdahl was safe with his family, due to the Obama administration. The disturbing truth was more likely that the administration traded prisoners for a U.S. deserter, while pushing the false narrative of returning an American patriot to his parents.

The far more important Iran nuclear deal of summer 2015 followed a similar pattern of dissimulation. “Bold” and “courageous” Middle East diplomacy nonetheless required White House subterfuge and deceitfulness. Ostensibly only Barack Obama was unaffected by past presidents’ prejudices against the revolutionary regime in Iran and thus could appreciate the mutual advantages of a breakthrough agreement to deter Iran from acquiring a nuclear bomb—as part of a larger diplomatic effort to return Shiite and Persian Iran to its natural role as a balancing force in the otherwise largely Sunni and Arab Middle East

In exchange for the U.S. and its allies dropping sanctions and commercial penalties—some of them approved by the UN—the theocracy purportedly agreed to reduce its installed centrifuges for 10 years. It promised to put limits on the purity of its enriched uranium and to reduce existing stockpiles. It agreed not to expand its enrichment facilities, while allowing on-site inspections.

But after 18 months, the true character of the deal has been revealed through slow leaks. In a secret side deal, Iran can update and improve its centrifuges; it can also inspect its own enrichment centers and report the results to international authorities; beyond that, Iran received a $400 million ransom payment on the exact day that Iranian-held U.S. hostages were let go.

More recently we learned that Iran got the sanctions lifted before it met all its obligations outlined in the deal. Ben Rhodes, an architect of the swap and deputy national security advisor, boasted about the administration’s affinity for deceit. Rhodes, described by a New York Times interviewer as “a storyteller who uses a writer’s tools to advance an agenda that is packaged as politics but is often quite personal,” explained the methods of concocting an Iran narrative to a guidable media: “All these newspapers used to have foreign bureaus,” Rhodes intoned. “Now they don’t. They call us to explain to them what’s happening in Moscow and Cairo. . . The average reporter we talk to is 27 years old, and their only reporting experience consists of being around political campaigns. That’s a sea change. They literally know nothing.”

Rhodes’s cynicism was reminiscent of the boasts of another administration advisor, the MIT economist Jonathan Gruber, who bragged of the administration’s ability to get passed the Patient Protection and affordable Care Act (“Obamacare”), largely through deliberate deceit about the inevitable consequences of higher premiums and deductibles, the dropping of existing coverage and doctors, and increases in federal outlays. Some of the bill’s more obvious and unpopular elements—such as the employer mandate—were not enforced until after Obama’s 2012 reelection bid. Gruber admitted that the law was composed “in a tortured way” to delude people into accepting that “healthy people pay in and sick people get money”—a subterfuge that was both necessary and worked because of “the stupidity of the American voter,” a fact confirming that the “lack of transparency is a huge political advantage”

Other examples of dissimulation exist—from Obama’s about-face on border enforcement, in which he redefined deportation and reneged on his promises to enforce existing law, to the linguistic gymnastics he employed to mask the disastrously abrupt pullout of peacekeepers from Iraq (ISIS as “the “jayvees”). Most recently, the administration has not been candid about the details of its latest estrangement with Israel. Obama and his foreign policy team hid the fact that they had helped to engineer a UN resolution condemning Israel, by suggesting to the public that they were unaware of the depths of apparently spontaneous expressions of anti-Israeli anger.

Why does the Obama administration contort reality and mask the consequences of its initiatives?

Two reasons come to mind. One, Obama advanced an agenda to the left of that shared by most past presidents. Obamacare, the Benghazi catastrophe, the Iran deal, his strange stance toward radical Islam, and the Bergdahl swap were unpopular measures that required politically-driven recalibrations to escape American scrutiny.

Second, Obama’s team believes that the goals of fairness and egalitarianism more than justify the means of dissimulation by more sophisticated elites. Thus Gruber (“the stupidity of the American voter”) and Rhodes (“They literally know nothing”) employ deception on our behalf. Central to this worldview is that the American people are naive and easily manipulated, and thus need to be brought up to speed by a paternal administration that knows what is best for its vulnerable and clueless citizenry.
Such condescension is also why the administration never believes it has done anything wrong by hiding the facts of these controversies. Its players believe that because they did it all for us, the ensuing distasteful means will be forgotten once we finally progress enough to appreciate their enlightened ends.

Live Stream: Obama Says Farewell; Reminds Us One Last Time How Awesome He Is

    ZeroHedge
    by Tyler Durden
    Jan 10, 2017 8:55 PM

Once again parting with Presidential tradition, rather that delivering his farewell speech from the oval office, the ever so humble Obama has decided to give his final address to the American people from his home town of Chicago. And, like his 2008 speech at the Democratic National Convention in Denver, we're certain this will be a glorious event complete with a slew of celebrities and all the pomp and circumstance befitting a king...rest assured that no taxpayer expense was spared.

While the content of Obama's remarks have not been revealed, earlier today he posted the following preview on Facebook which noted that he looks forward to going back to "where it all started" and humbly affirmed that he's "made America a better, stronger place for the generations that will follow."

For Michelle and me, Chicago is where it all started. It’s the city that showed us the power and fundamental goodness of the American people.

It’s that inherent strength that brought our country through our fair share of challenges these last eight years. Because of you, we’ve come through them stronger. Because of you, we’ve held to a belief that has guided us ever since our founding – our conviction that, together, we can change this country for the better.

It’s easy to lose sight of that in the blizzard of our minute-to-minute Washington news cycles. But America is a story told not minute to minute, but generation to generation – a story written by parents, and teachers, and veterans, and neighbors who’ve taken on the call of citizenship, working together, without fanfare, to form a more perfect union.

Over the course of my life, I’ve been reminded time and again that change can happen – that ordinary people can come together to achieve extraordinary things. And I’ve seen that truth up close over these last eight years.

We’ve made America a better, stronger place for the generations that will follow. We’ve run our leg in a long relay of progress, knowing that our work will always be unfinished. And we’ve reaffirmed the belief that we can make a difference with our own hands, in our own time. That’s the imperative of citizenship – the idea that, with hard work, and a generous heart toward our fellow Americans, people who love their country can change it.

So tonight, I’m returning to where it all began to offer my most grateful farewell to the American people. I hope you’ll join me – I want to thank you for everything you’ve done.

And while Obama will undoubtedly brag about his amazing "economic recovery," we would once again highlight the following data that seemingly paints a slightly more sobering picture.

Of course, these charts that we presented last summer also cast a slight shadow over Obama's "economic recovery."

Unfortunately for Obama, simply stating something repeatedly doesn't actually make it a fact.

And speaking of repeating fictitious stories until they somehow become fact, as Post News pointed out yesterday, for weeks now Obama and his various mouthpieces have been peddling the fiction that his administration managed to spend 8 years in the White House without a single major scandal. And while that would be a fantastic accomplishment, unfortunately it's every bit as "fake" as the Obama "economic recovery." In fact, here are just a few of the scandals that plagued the Obama administration over the years (a detailed description of each can be viewed here).

Iran Nuclear Deal and Ransom Payment
    NSA Spying
    Benghazi
    Operation Fast and Furious
Eric Holder - First Attorney General Ever Held In Contempt Of Congress
    IRS Targeting Of Conservative Groups
    Bowe Bergdahl
    The Great “Stimulus” Heist
    Solyndra
    Spying On Journalists
    VA Death-list Scandal

Finally, since Obama will undoubtedly use his pedestal tonight to defend his one crowning piece of legislation, in a last-ditch effort to save it from being repealed by the incoming Trump administration, we leave you with the following charts displaying the epic collapse of Obamacare in just 1 year as insurers pulled out of exchanges all around the country in 2017 leaving Americans with minimal insurance options and substantially higher premiums.

ASSANGE: Obama Administration Destroying Public Records 'Now'

    January 10, 2017

WikiLeaks founder Julian Assange says the Obama administration is destroying public records in the final days in office.

Just days ago, Assange offered a $30,000 reward to any administration employee who would publicly expose any official disposing of information.

During a Periscope press conference on Monday, Assange said the most important thing for Americans to do is to ensure Obama is not destroying those records.

“Past administrations of both Republican and Democratic players have engaged in mass destruction of records as they left office,” Assange said in response to a question.

“We are told that destruction of records is occurring now in different parts of the Obama administration in different departments or agencies.

“That’s what happens when an administration leaves office,” Assange said.

“Our philosophy is that such information is a part of history. It belongs, legally and philosophically, to the American people and more broadly, insofar as the United States interacts with the world, it belongs to the people of the world.

“It is part of human history and the destruction of major archives of human history, frankly, should be formally listed as a crime against humanity because those archives belong to humanity,” he said.

He said those records are what we use to understand the world around us and to form new observations.

“To destroy them is absolutely and egregious act. One understands the political motivation for it,” Assange contended, adding it is done to “eliminate small political risks by destroying major elements of history.”

Reminding listeners of the $30,000 reward, Assange said, “Our request to system administrators in the Obama administration goes for other administrations around the world as well, is take the data now.

“Just take it now. Keep it under your bed, or with your mother and then you can give that to Wikileaks or other journalists at your leisure,” he said.

“Get hold of that history and protect it,” Assange said, “because that is something that belongs to humanity and does not belong to a political party.”

In final act as president, Obama commutes 330 drug sentences

Published January 19, 2017 Associated Press

Jan. 18, 2017: President Barack Obama speaks during his final presidential news conference in the briefing room of the White House in Washington. (AP)

WASHINGTON – In a last major act as president, Barack Obama cut short the sentences of 330 federal inmates convicted of drug crimes on Thursday, bringing his bid to correct what he's called a systematic injustice to a climactic close.

With his final offer of clemency, Obama brought his total number of commutations granted to 1,715, more than any other president in U.S. history, the White House said. During his presidency Obama ordered free 568 inmates who had been sentenced to life in prison.

"He wanted to do it. He wanted the opportunity to look at as many as he could to provide relief," Neil Eggleston, Obama's White House counsel, said in an interview in his West Wing office. "He saw the injustice of the sentences that were imposed in many situations, and he has a strong view that people deserve as second chance."

For Obama, it was the last time he planned to exercise his presidential powers in any significant way. At noon on Friday, Obama will stand with President-elect Donald Trump as his successor is sworn in and Obama's chapter in history comes to an end.

Even as Obama issued the commutations, the White House had been mostly cleared out to make way for Trump. In between carrying out their last duties, the few remaining staffers were packing up belongings as photos of Obama were taken down from the walls of the West Wing corridors.

The final batch of commutations — more in a single day than on any other day in U.S. history — was the culmination of Obama's second-term effort to try to remedy the consequences of decades of onerous sentencing requirements that he said had imprisoned thousands of drug offenders for too long. Obama repeatedly called on Congress to pass a broader criminal justice fix, but lawmakers never acted.

For Bernard Smith, it's a long-awaited chance to start over after 13 years away from his wife and children.

Smith was working at a restaurant in Maryland in 2002 when his brother asked him to obtain marijuana for a drug deal. Though it was his brother who obtained the crack cocaine that the brothers then sold along with the marijuana to undercover officers, Smith was charged with the cocaine offense, too.

His 22-year sentence was far longer than his brother's, owing to what the court called Smith's "extensive criminal history" prior to the drug bust. Smith still had 10 years on his sentence when he was notified Thursday that the president, on his last day in office, was giving him another chance.

"He's looking to turn his life around," said Michelle Curth, his attorney. "He's a good person who, like so many people, got involved in something he's been punished for already."

Curth said that Smith had learned his lesson and owned up to his crime — he asked for a commutation, she noted, not a pardon, which would have erased the original conviction. She said Smith hopes to get licensed in heating and air conditioning maintenance and has lined up family members to help with his adjustment.

But freedom for Smith is still two years away. Rather than release him immediately, Obama directed that he be set free in January 2019 — two years after Obama has left office — and only if Smith enrolls in a residential drug treatment program.

To be eligible for a commutation under Obama's initiative, inmates had to have behaved well in prison and already served 10 years, although some exceptions to the 10-year rule were granted. They also had to be considered nonviolent offenders, although many were charged with firearms violations in relation to their drug crimes.

Obama personally reviewed the case of every inmate who received a commutation, often poring over case files in the evenings or calling his attorneys into his office to discuss specifics. Although a backlog of cases remains as Obama leaves office, his administration reviewed all applications that came in by an end-of-August deadline, officials said.

Eggleston said Obama had been particularly motivated to grant clemency to inmates who had turned themselves around in prison. He said one inmate had trained and obtained a commercial driver's license through a prison program, despite having a life sentence that all but assured he'd never get to use it.

"The ones who really stuck home for the president and me are the ones who got their GED, they worked, they took courses in anger management, they took courses in getting over drug abuse issues, they remained in contract with their families," Eggleston said.

Obama has long called for phasing out strict sentences for drug offenses, arguing they lead to excessive punishment and incarceration rates unseen in other developed countries. With Obama's support, the Justice Department in recent years directed prosecutors to rein in the use of harsh mandatory minimums.

Earlier in the week, Obama commuted most of the rest of convicted leaker Chelsea Manning's sentence, arguing the Army intelligence analyst had shown remorse and already served a long sentence.

Yet Obama will leave office without granting commutations or pardons to other prominent offenders who had sought clemency, including accused Army deserter Sgt. Bowe Bergdahl and former Illinois Gov. Rod Blagojevich. He also declined to pardon former National Security Agency contractor Edward Snowden.

Obama Administration Quietly Released $221 Million To Palestinian Authority Before Leaving

    January 23, 2017

Officials say the Obama administration in its waning hours defied Republican opposition and quietly released $221 million to the Palestinian Authority.

GOP members of Congress had been holding up the money.

A State Department official and several congressional aides say the outgoing administration formally notified Congress it would spend the money Friday morning, just before Donald Trump became president.

More than $227 million in foreign affairs funding was released at the time, including $4 million for climate change programs and $1.25 million for U.N. organizations.

At least two GOP lawmakers had placed holds on the Palestinian funds. Congressional holds are generally respected by the executive branch but are not legally binding.

The official and the aides weren’t authorized to speak publicly on the matter and demanded anonymity.
