Obama Making Plans to Use Executive Power
    February 12, 2010

With much of his legislative agenda stalled in Congress, President Obama and his team are preparing an array of actions using his executive power to advance energy, environmental, fiscal and other domestic policy priorities.

Mr. Obama has not given up hope of progress on Capitol Hill, aides said, and has scheduled a session with Republican leaders on health care later this month. But in the aftermath of a special election in Massachusetts that cost Democrats unilateral control of the Senate, the White House is getting ready to act on its own in the face of partisan gridlock heading into the midterm campaign.

"We are reviewing a list of presidential executive orders and directives to get the job done across a front of issues," said Rahm Emanuel, the White House chief of staff.

Any president has vast authority to influence policy even without legislation, through executive orders, agency rule-making and administrative fiat. And Mr. Obama's success this week in pressuring the Senate to confirm 27 nominations by threatening to use his recess appointment power demonstrated that executive authority can also be leveraged to force action by Congress.

Mr. Obama has already decided to create a bipartisan budget commission under his own authority after Congress refused to do so. His administration has signaled that it plans to use its discretion to soften enforcement of the ban on openly gay men and lesbians serving in the military, even as Congress considers repealing the law. And the Environmental Protection Agency is moving forward with possible regulations on heat-trapping gases blamed for climate change, while a bill to cap such emissions languishes in the Senate.

In an effort to demonstrate forward momentum, the White House is also drawing more attention to the sorts of actions taken regularly by cabinet departments without much fanfare. The White House heavily promoted an export initiative announced by Commerce Secretary Gary Locke last week and nearly $1 billion in health care technology grants announced on Friday by Kathleen Sebelius, the health and human services secretary, and Hilda L. Solis, the labor secretary.

White House officials said the increased focus on executive authority reflected a natural evolution from the first year to the second year of any presidency.

"The challenges we had to address in 2009 ensured that the center of action would be in Congress," said Dan Pfeiffer, the White House communications director. "In 2010, executive actions will also play a key role in advancing the agenda."

The use of executive authority during times of legislative inertia is hardly new; former Presidents Bill Clinton and George W. Bush turned to such powers at various moments in their presidencies, and Mr. Emanuel was in the thick of carrying out the strategy during his days as a top official in the Clinton White House.

But Mr. Obama has to be careful how he proceeds because he has been critical of both Mr. Clinton's penchant for expending presidential capital on small-bore initiatives, like school uniforms, and Mr. Bush's expansive assertions of executive authority, like the secret program of wiretapping without warrants.

Already, Mr. Obama has had to reconcile his campaign-trail criticism of Mr. Bush for excessive use of so-called signing statements to bypass parts of legislation with his own use of such tactics. After a bipartisan furor in Congress last year, Mr. Obama stopped issuing such signing statements, but aides said last month that he still reserves the right to ignore sections of bills he considers unconstitutional if objections have been lodged previously by the executive branch.

Another drawback of the executive power strategy is that actions taken unilaterally by the executive branch may not be as enduring as decisions made through acts of Congress signed into law by a president. For instance, while the E.P.A. has been determined to have the authority to regulate carbon emissions, the administration would rather have a market-based system of pollution permits, called cap and trade, that requires legislation.

Still, presidents have logged significant accomplishments through the stroke of a pen. In 1996, on his own authority, Mr. Clinton turned a 2,600-square-mile section of southern Utah into the Grand Staircase-Escalante National Monument, in what was called at the time his boldest environmental move. Mr. Bush followed suit in 2006 by designating a 140,000-square-mile stretch of islands and ocean near Hawaii as the largest protected marine reserve in the world, in what some see as his most lasting environmental achievement.

The use of executive power came to a head this week when Mr. Obama confronted Senator Mitch McConnell of Kentucky, the Republican leader, about nominations held up in the Senate. In a meeting with Congressional leaders at the White House on Tuesday, Mr. Obama turned to Mr. McConnell and vowed to use his power to appoint officials during Senate recesses if his nominations were not cleared.

By Thursday, the Senate had voted to confirm 27 of 63 nominations that had been held up, and the White House declared victory. Two administration officials, speaking on the condition of anonymity, said Friday that the White House had drafted a list of about a dozen nominees for the president to appoint during the recess that just began, but most were among those cleared.

Mr. McConnell's office denied that the president's threat had anything to do with the confirmations, pointing out that the Senate regularly passes a batch of nominees before going on recess.

"All presidents get frustrated with the pace of nominations, and all Congresses say they're doing their best, so it's not a surprise," said Don Stewart, a spokesman for Mr. McConnell. "But the fact is nominees are being confirmed, particularly those nominated since December."

The recess appointment power stems from the days when lawmakers were in session only part of the year, but in modern times presidents have used it to circumvent opposition in the Senate. Mr. Clinton made 139 recess appointments, 95 of them to full-time positions, while Mr. Bush made 171, with 99 to full-time jobs. Mr. Obama has yet to make any.

Those given such appointments can serve until the end of the next Congressional session. As a senator, Mr. Obama was less enamored with recess appointments. When Mr. Bush used the power to install John R. Bolton as ambassador to the United Nations, Mr. Obama called Mr. Bolton "damaged goods."

But the White House argued that Mr. Obama's choices have been held up more than Mr. Bush's and left open the prospect of giving recess appointments to some of those still held up, including Craig Becker, a labor lawyer whose nomination for a seat on the National Labor Relations Board has been blocked.

"If the stalling tactics continue," said Robert Gibbs, the White House press secretary, "he's not ruling out using recess appointments for anybody that he's nominated."

Time for Obama to go 'gangsta' on GOP

By Roland S. Martin, CNN Political Analyst
    February 11, 2010 10:32 a.m. ESTFebruary 11, 2010 10:32 a.m. EST

Editor's note: Roland S. Martin, a CNN political analyst, is a nationally syndicated columnist and author of "Listening to the Spirit Within: 50 Perspectives on Faith," and the forthcoming book, "The First: President Barack Obama's Road to the White House." He is a commentator for TV One Cable Network and host of a one-hour Sunday morning news show. (CNN)

-- Civil rights activist Fannie Lou Hamer made famous the phrase, "I'm sick and tired of being sick and tired."

For me, I'm sick and tired of Democrats having power and being unwilling to use it. I've always respected Republicans when they had power because they were willing to use it and maybe apologize later.

Today, President Obama walked into the White House briefing room and took some questions, and one of them revolved around recess appointments.

He has watched Republicans block many of his appointments, and now he says he made it clear to them that he will "consider" making some when the U.S. Senate goes into recess.

"One senator, as you all are aware, had put a hold on every single nominee that we had put forward due to a dispute over a couple of earmarks in his state," President Obama said.

"In our meeting, I asked the congressional leadership to put a stop to these holds in which nominees for critical jobs are denied a vote for months. Surely we can set aside partisanship and do what's traditionally been done to confirm these nominations.

If the Senate does not act -- and I made this very clear -- if the Senate does not act to confirm these nominees, I will consider making several recess appointments during the upcoming recess, because we can't afford to allow politics to stand in the way of a well-functioning government."

This is where the president needs to show his toughness and just do it. Forget the threats. The actions of Sen. Richard Shelby, R-Alabama, and other Republican obstructionists will continue if President Obama allows them to run roughshod over him. When you're the top dog, you do what you have to do to govern. Allowing Republican senators to continue to deny your appointments is nonsense.

If all of them choose to support a filibuster, then you take it to the American people and show the obstructionists for what they are. You get your grass-roots movement fired up to stand up and do something.

The political right used its base to go after Democrats who blocked appointments to the federal bench and other positions. So why not be just as aggressive?

If there are members of your own party who stand in the way, such as Sen. Ben Nelson, D-Nebraska, then you also blast them and make them pay for acting so foolishly.

This president got rolled by the Senate over health care. His team made some boneheaded mistakes, and now they are paying for them.

Continuing to play footsie with opponents will only get him into more trouble. He should set a deadline to have his folks confirmed. If not, appoint them all during the recess and go on about your business.

Obama's critics keep blasting him for Chicago-style politics. So, fine.

Channel your inner Al Capone and go gangsta against your foes. Let 'em know that if they aren't with you, they are against you, and will pay the price.

    Obama Better Start Breaking Kneecaps

    Posted: February 14, 2010 06:04 PM

By now most Americans would agree the ascendancy of Barack Obama to President was due in large part to his promise of obliterating the petty Washington-politics-as-usual mentality when it comes to governing.

In 2000 when running for president, George W. Bush trotted out a nifty campaign slogan: "compassionate conservatism." He didn't coin the term; it was first used in a speech given in 1979 by right-wing presidential adviser Doug Wead. But Bush owned it in the 2000 election in an effort to pander to moderate voters. Compassionate conservatism, he argued, would be his guiding principle should he win the presidency.

(He probably didn't realize when he used that term he was implying conservatism at its core is inherently uncompassionate. After all, if conservatism was truly compassionate he wouldn't have needed a qualifier.) He also boasted that when he was governor of Texas he worked across party lines, though the state's elected Democrats are often considerably more conservative than northeastern Republicans.

For myriad reasons, the American people bought Bush's blatant lies; even the most ardent Bush supporters now readily admit that he neither practiced compassionate conservatism nor did he ever have any intent of working "across party lines." His presidential administration was perhaps the most partisan and blatantly conservative of any in American history.

So what does this have to do with President Obama?

Most Americans want at least some sort of harmony among government entities (especially within the intelligence communities). The only way America moves -- forward or backward -- is when legislation and agendas are advanced. Now historically speaking, the advancement of legislation and agendas can have detrimental effects on society (see particularly Ronald Reagan's f*ck-the-poor decade and Newt Gingrich's Contract with on America).

But nonetheless agendas were advanced, and many politicians followed the cliché: "Let the chips fall where they may." Pass legislation that you believe in and f*ck the voters come November. For all of Gingrich's repulsiveness, he pushed through his agenda -- the people's will be damned. And yeah, the people didn't forget; they loathed him, and he was eventually driven out of office.

President Obama, on the other hand, has spent an entire year desperately attempting to win over the hearts and minds of the Republican establishment. While Obama could have rammed his will down the throats of the American people by going overboard in issuing executive orders, he only passed 39 executive orders in his first year in office. By contrast George W. Bush passed 54 executive orders.

Obama's entire first year in office can be summed up this way: pandering, placating, and pussy-footing around the Republican Party. He offered his hand to the Republicans, and they gave him a firm backhand. Look at the health care reform bill. For God's sake, it's a giveaway to Republicans: It has no public option, it allows for interstate insurance shopping, and if passed, will add millions of customers to the oligarchical insurance companies. How much more Republican-friendly could the bill be? If you ask the Republicans they'd say, "The only good health care reform bill is a dead health care reform bill." (Poor choice of words deliberate.)

Clearly, Obama has a distaste for political hardball.

By his actions, he doesn't want to become simply a liberal version of George W. Bush, ramming liberal policies down the throats of Congress -- much to my chagrin. He needs to rethink that.

Here's what I'd say to Obama, and I believe many of his advisers are saying these sorts of things as well:
You've given it your best shot, you've tried numerous times to talk with the Republicans, to negotiate, to meet them halfway on every single matter before the American people.

But they hate you for many reasons. It's time you break kneecaps. It's time to destroy the Republican Party. They don't deserve a seat at the table when all they want to do is score political points by being the Party of No.
It's looking like Obama may be getting the message. Just yesterday he threatened to bypass Republican foot-dragging on his stalled nominations by using the recess-appointment process -- a procedure Bush 43 used on numerous occasions (with nefarious results -- remember John Bolton).

As expected, after Senate Minority Leader Mitch McConnell was shown weeping on the Senate floor he said the potential recess appointments would undermine the President's efforts to reach out to Republicans. Seriously!? According to McConnell "reaching out to Republicans" means giving them everything they ask for, all the time.

Elections have consequences. After Bush's narrow reelection in 2004, he had the temerity to address the press and say, "I earned political capital, and now I intend to spend it." Why can't Barack Obama, whose victory was far more impressive and more decisive, say the same thing?

Obama Justice Department Shut Down Federal ACORN Investigation According to Documents Obtained by Judicial Watch

    Mar 11 01:20 PM US/Eastern

    WASHINGTON, March 11 /PRNewswire-USNewswire/

Judicial Watch, the public interest group that investigates and prosecutes government corruption, announced today that it has obtained documents from the Federal Bureau of Investigation (FBI) detailing federal investigations into the alleged corrupt activities of Association of Community Organizations for Reform Now (ACORN).

The documents reference serious allegations of corruption and voter registration fraud by ACORN as well as the Obama administration's decision to shut down a criminal investigation without filing criminal charges.

The documents include background information on two specific complaints filed in October 2008 by Lucy Corelli and Joseph Borges, Republican Registrars of Voters in Stamford and Bridgeport, Connecticut, respectively, during the 2008 election season.

According to Corelli, on August 1, 2008, her office received 1,200 ACORN voter registration cards from the Secretary of State's office. Over 300 of these cards were rejected because of "duplicates, underage, illegible and invalid addresses," which "put a tremendous strain on our office staff and caused endless work hours at taxpayers' expense." Corelli claimed the total cost of the extra work caused by ACORN corruption was $20,000. Likewise, Borges contended that: "The organization ACORN during the summer of 2008 conducted a registration drive which has produced over 100 rejections due to incomplete forms and individuals who are not citizens..." Among the examples cited by Borges was a seven-year old child who was registered to vote by ACORN through the use of a forged signature and a fake birth certificate claiming she was 27-years old.

The FBI and Department of Justice opened an investigation. However, the Obama Justice Department, while noting that ACORN had engaged in "questionable hiring and training practices," closed down the investigation in March 2009, claiming ACORN broke no laws.

By contrast, the documents also include records related to a federal investigation of ACORN corruption in St. Louis, Missouri, involving 1,492 allegedly fraudulent voter registration cards submitted by Project Vote, a liberal non-profit organization affiliated with ACORN on voter registration drives, during the 2006 election season. Assistant United States Attorney Hal Goldsmith initiated the investigation with "concurrence" from the Department of Justice and the participation of the FBI. According to a Justice Department memo, Goldsmith "advised he would prosecute any individual responsible for submitting fraudulent voter registration cards." Goldsmith identified the statute for prosecution: Title 42, USC 1973 (gg), which provides for criminal penalties for fraudulent voter registrations. In April 2008, eight former ACORN employees from the St. Louis office pled guilty to voter registration fraud.

Other documents show that the Bush Justice Department failed to prosecute ACORN voter registration fraud of non-citizens in Phoenix, Arizona in 2007 because the allegations that led to the opening of the investigation were "unverifiable." Notably, the FBI document detailing this questionable decision reveals that a "draft Intelligence Bulletin... concludes that ACORN's employment practices perpetuate fraudulent voter registration."

The ACORN documents uncovered by Judicial Watch include internal FBI memoranda, signed affidavits, subpoenas, fraudulent voter registration cards, and publications describing ACORN's policies and practices. The documents also include details regarding numerous allegations of corruption extending beyond voter registration fraud, to include attempts by ACORN employees to coerce workers to participate in campaign activities on behalf of Democratic candidates.

"These documents reflect systematic voter registration fraud by ACORN," said Judicial Watch President Tom Fitton. "It is a scandal that there has been no comprehensive criminal investigation and prosecution by the Justice Department into this evident criminal conduct.

Given President Obama's close connections to ACORN, including his campaign's hiring of the ACORN's Project Vote organization, it seems rather obvious why Attorney General Holder has failed to seriously investigate these and other alleged ACORN criminal activities."

    Obama's Secret Power Grabs

    By Phil Kerpen
    - FOXNews.com

President Obama seems to believe that most of his sweeping agenda to transform the country can be accomplished without even a vote of Congress.

While Congress considers sweeping new legislation to permanently institutionalize the bailouts and federal control of our financial system (right on the heels of their health care takeover, of course) several other sweeping power grabs are going on outside the spotlight of legislative debate.

Indeed President Obama seems to believe that most of his sweeping agenda to transform the country can be accomplished without even a vote of Congress. The chart seen above and found here shows what the administration is up to.

As I’ve previously noted here in the Fox Forum, the the EPA is pursuing an aggressive global warming power grab under the direction of White House Climate czar Carol Browner (who was not subject to Senate confirmation), and the FCC is pursuing a regulatory takeover of the Internet.

Both of those efforts are now escalating. The EPA has now finalized its vehicle emissions rule, for the first time regulating global warming under the 1970 Clean Air Act.

While EPA Administrator Lisa Jackson is trying to calm a political backlash by promising the delay the onslaught of regulations (the overall blueprint is over 18,000 pages and regulates almost everything that moves and lots of things that stay put) she remains committed to them. The Senate will have a key vote on S.J. Res. 26, which would stop the EPA, some time in May.

The FCC was smacked down in court last week in Comcast v. FCC, which held that the Commission has no jurisdiction to regulate the Internet.

Yet FCC Chairman Julius Genachowski, a close friend of Obama’s, is now considering Internet regulations of an even more extreme nature and by an even more dubious mechanism—reclassifying the Internet as a phone system to regulate it like an old-fashioned public utility.

Obama has a pattern of sidestepping Congress that will only get worse in the aftermath of the health care fight and the pending financial “reform” legislation. For a full explanation of all of these threats as well as action items on how to stop them, please check out the interactive version of the chart on www.ObamaChart.com.

They stole the Nevada election to keep Reid running the Senate and put Pelosi back in after America voted to stop the Socialization of America.

This group running our government is not going to pivot and move to the center, they are doubling down with their far left agenda.

More proof we are dealing with Marxist Revolutionaries in this Administration that will destroy our freedoms at any cost to stay in power.

    Introduction and summary

    The opportunity

Concentrating on executive powers presents a real opportunity for the Obama administration to turn its focus away from a divided Congress and the unappetizing process of making legislative sausage. Instead, the administration can focus on the president’s ability to deliver results for the American people on the things that matter most to them:

    • Job creation and economic competitiveness
    • Educational excellence
    • A clean energy future and energy independence
    • Quality affordable health care
    • Consumer protection
    • The home foreclosure crisis
    • Accountable government delivering results at lower cost
    • Sustainable security for the nation

In addition, the key legislative accomplishments of President Obama’s first two years in office, most notably health care and financial reform, now need to be implemented effectively. Both the Affordable Care Act and the Dodd-Frank Wall Street Reform and Consumer Protection Act require hundreds of separate rule- makings and other agency actions to implement the legislative framework.

The public has made clear its disgust with Washington’s ways—the same sentiment that helped to bring President Obama to office. It would be a welcome relief from watching legislative maneuvering to see the work of a strong executive who is managing the business of the country through troubled times, doing more with less, each day working to create a stronger economy and a more effective government.

The Obama administration, of course, is already using the capacity of the presidency to drive change in the public and private sector. For example, it promoted the forma1tion of Skills for America’s Future, a new public-private initiative in support of the president’s goal of 5 million more community college graduates and certificates by 2020. At the recent White House Community College Summit, convened by Dr. Jill Biden, industry, labor unions, community colleges, and other training providers made commitments to help put this initiative into action.

Similarly, President Obama’s recent trip to India provided an opportunity for him to win agreements that will bring significant economic benefits to U.S. firms and American workers. Trade transactions were announced or showcased, exceeding $14.9 billion in total value with $9.5 billion in U.S. export content, supporting an estimated 53,670 U.S. jobs in the production of aircraft, energy generation equipment, advanced machinery, and telecommunications services, among others.

There is much more the president can do. The list below of ideas from the Center for American Progress’s policy experts offers just some of the many possible actions the administration can take using existing authority to move the country forward.

Specifically, in the energy and environmental arena, the president can:

    • Reduce oil imports and make progress toward energy independence.
    • Progress toward reducing greenhouse gas pollution by 17 percent by 2020.
    • Conserve federal lands for future generations.
    • Manage public lands to support a balanced energy strategy.
    • Convene and engage hunters and anglers in the development of a fish and wildlife climate adaptation plan.
    • Generate solar energy on U.S. Air Force hangar roofs.

On the domestic economic policy front, President Obama can:

    • Direct an assessment, strategy, and new policy development to promote U.S. competitiveness.
    • Launch the new consumer financial protection bureau with an aggressive agenda to protect and empower consumers.
    • Increase the capacity of small businesses to expand hiring and purchases by accelerating the implementation of the Small Business Jobs Act.
    • Promote automatic mediation to avoid foreclosure where possible and speed resolution.
    • Create a web portal to empower housing counselors, reduce burdens on lenders, and speed up home mortgage modifications.
    • Help stabilize home values and communities by turning “shadow REO” housing inventory into “scattered site” rental housing.
    • Promote practices that support working families.

Elsewhere on the domestic policy front, the Obama administration can:

    • Partner with the private sector in health care payment reform.
    • Focus on health care prevention in implementing the Affordable Care Act.
    • Streamline and simplify access to federal antipoverty programs.
    • Replace costly, inhumane immigration detention policies with equally effective measures.

In the education policy arena, the president can:

    • Launch an “educational productivity” initiative to help school districts spend every dollar wisely to best prepare our children for the 21st century.
    • Ensure students can compare financial aid offers from different postsecondary institutions.
    • Improve the quality, standards, and productivity of postsecondary education.

In improving the performance of the federal government, the president can:

    • Scrutinize federal spending programs and tax expenditures to achieve greater returns on public investment.
    • Build the next-generation Recovery.gov web site to track all public expenditures and performance in real time.
    • Use new information technology for faster, more transparent freedom of information.
    • Create a virtual U.S. statistical agency.
    • Collect data on lesbian ,gay, bisexual, and transgender Americans in federal data surveys.

And in the foreign policy and national security arena, the president and his administration can:

    • Rebalance our Afghanistan strategy with greater emphasis on political and diplomatic progress.
    • Promote domestic revenue generation in Afghanistan and Pakistan.
    • Appoint a special envoy for the Horn of Africa and the southwest Arabian Peninsula region.
    • Appoint a special commission to assess contracting practices in national security and foreign affairs.
    • Use executive branch authority to mitigate the impact of the “Don’t Ask, Don’t Tell” policy if Congress does not repeal it.
    • Redouble support for Palestinian state- and institution-building efforts.
    • Pursue dual-track policy on Iran while sharpening focus on Iranian human rights issues.
    • Reinvigorate the U.S.-Turkey strategic alliance. Develop a comprehensive policy on the Russia-Georgia conflict.

This is by no means an exhaustive list of the important policy objectives President Obama can pursue over the next two years, but it illustrates the range of important executive branch work beyond proposing and negotiating legislation.

    Statement from John D. Podesta

    November 15, 2010

In the aftermath of this month’s midterm congressional elections, pundits and politicians across the ideological spectrum are focusing on how difficult it will be for President Barack Obama to advance his policy priorities through Congress. Predictions of stalemate abound. And some debate whether the administration should tack to the left or to the center and compromise with or confront the new House leadership.

As a former White House chief of staff, I believe those to be the wrong preoccupations. President Obama’s ability to govern the country as chief executive presents an opportunity to demonstrate strength, resolve, and a capacity to get things done on a host of pressing challenges of importance to the public and our economy. Progress, not positioning, is what the public wants and deserves.

The U.S. Constitution and the laws of our nation grant the president significant authority to make and implement policy. These authorities can be used to ensure positive progress on many of the key issues facing the country through:

    • Executive orders
    • Rulemaking
    • Agency management
    • Convening and creating public-private partnerships
    • Commanding the armed forces
    • Diplomacy

The ability of President Obama to accomplish important change through these powers should not be underestimated. President Bush, for example, faced a divided Congress throughout most of his term in office, yet few can doubt his ability to craft a unique and deeply conservative agenda using every aspect of the policymaking apparatus at his disposal. And, after his party lost control of Congress in 1994, President Clinton used executive authority and convening power to make significant progressive change. For instance, he protected more great spaces in the lower 48 states than any president since Theodore Roosevelt, established for the first time significant protections for Americans’ medical privacy, and urged the creation of the Welfare-to-Work Partnership that enlisted the help of 20,000 businesses in moving more than 1 million welfare recipients into the workforce.

The upshot: Congressional gridlock does not mean the federal government stands still. This administration has a similar opportunity to use available executive authorities while also working with Congress where possible. At the Center for American Progress, we look forward to our nation continuing to make progress.

Podesta: Obama Can Use ‘Armed Forces’ to Push Progressive Agenda (WTF?!?)

The liberal Center for American Progress doesn’t believe significant GOP gains in the House and Senate should stop the President from implementing more of his polices. The group released a report Tuesday suggesting ways Obama can bypass Congress to accomplish a progressive agenda, and it cites the president’s power as commander-in-chief to make its point.

“I think most of the conversation since the election has been about how President Obama adjusts to the new situation on Capitol Hill,” Center for American Progress head and former Bill Clinton Chief of Staff John Podesta told the Daily Caller. “While that’s an important conversation, it simply ignores the president’s ability to use all levels of his power and authority to move the country forward.”

How does one “move the country forward”? In the center’s report, Podesta explains that Obama can use executive orders, rulemaking, and even the armed forces “to accomplish important change” and that such means “should not be underestimated.”

What exactly does Podesta think the president should use such powers to “accomplish”? Among others, the report suggests “job creation,“ ”quality affordable health care,“ ”sustainable security,“ and ”a clean energy future.”

The report cites specific goals such as mitigating the effects of the military’s “Don’t Ask, Don’t Tell” policy, supporting a Palestinian state, and reducing greenhouse gasses by 17 percent by 2020.

“The U.S. Constitution and the laws of our nation grant the president significant authority to make and implement policy,” Podesta writes.

Dictatorship by Executive Order Could Be Headed Our Way; We Must Stop It

By Jerry McConnell Wednesday, January 19, 2011

On Wednesday, November 03, 2010, the day following the national elections, Barack Obama proclaimed, “They ‘shellacked’ us” meaning the conservative Republicans won a hugely significant number of seats in Congress along with a large number of state governorships that had been held for the previous four years by the Democrats; and more specifically, the liberal Democrats.

Since that date, now two plus months ago, this same bunch of losers have done nothing to correct the mistakes and terribly bad moves they made to cause such a drubbing, in fact, they have done nothing but complain, label the voting public as fools and accomplices of nefarious politicians who lie, cheat and steal; the vices that have been largely proven to be more attributable to those same liberal Democrats.

On Saturday, January 08, 2011 a mentally deranged young man, Jared Lee Loughner, a reader of the Communist Manifesto, a book written by the German Marxist political theorists Karl Marx and Friedrich Engels; also reader of the works of Adolph Hitler the leader of the National Socialist German Workers Party, commonly known as the Nazi Party and Chancellor of Germany prior to and during World War II; and follower of the American liberal Democrat Party, opened fire at a crowd who came to see and hear Congresswoman Gabrielle Giffords in Tuscon, Arizona.

This madman, shot and killed six people including Republican U.S. District Judge John Roll, and wounded more than a dozen more including Congresswoman Giffords a Democrat; but did Obama’s followers attach any blame on their own people who are primarily of the same beliefs as the crazed gunman; most assuredly NOT, in fact, the only ones being blamed by the liberal Democrats and their mainstream media stooges were conservatives and Republicans in spite of overwhelming evidence to the contrary.

Faced with these adverse conditions and results, Obama is seen as losing his grip on leadership of the country mainly through loss of Congressional power and he is aiming for rule by fiat, or an authoritative decree, sanction, or order; in other words, by Executive Order.

This is affirmed by an information bulletin on January 14, 2011 created by the United States Justice Foundation (USJF) saying that “Mr. Obama has already decided that he is going to try to rule by Executive Order” even though “Executive Orders are unconstitutional, as they are simply interoffice memos from the “boss” of the Executive Branch to his employees.”

USJF Executive Director Gary G. Kreep, Esq., explains “Yes, Executive Orders are unconstitutional, as they are simply interoffice memos from the “boss” of the Executive Branch to his employees. And, in precisely the same vein, “Secretarial Orders,” the new “under the radar slider” used by Mr. Obama’s department heads, are equally unconstitutional.

Executive Orders and Secretarial Orders bypass the U.S. Congress, which Barack Obama no longer controls.

“Mr. Obama is determined to circumvent the United States Congress on issues that he cannot pursue through legislation—-and, since all of his social progressive mandates are pretty much unconstitutional, he fully intends to operate as a Dictator, while he pretends to be a moderate, Constitutional, Democrat.”

CFP readers may remember a column I wrote just last December 14, 2010, “Presidential Executive Orders - Powerful Dictates or Whimsical Wishing?” where I quoted Obama regarding Executive Orders that are used to hide or cover up information that the president wishes to keep secret, “For a long time now, there’s been too much secrecy in this city.

This administration stands on the side not of those who seek to withhold information but with those who seek it to be known,” Obama said after signing the order rescinding the Bush-era measure.

“The mere fact that you have the legal power to keep something secret does not mean you should always use it. Transparency and the rule of law will be the touchstones of this presidency.”

That was one of the first utterances made by Obama after taking office; I DON’T THINK HE HAS TOLD A BIGGER LIE THAN THAT ONE EVER SINCE.

This man is such an arrogant, narcissistic self-adoring tyrant I do believe that he already thinks he is a divine ruler of the people; and the really and truly sad part of it is that, in spite of what he has shown and what we know about his faults and power-hungry plans, almost half of the country’s voters STILL believe he is doing a good job of running the country.

That is proof unto itself that the man is wickedly distractful and able to make horrible decisions like ObamaCare, START treaty and egregiously misdirected spending and piling our national debt into the massive trillions of dollars and yet to keep fooling the voters into thinking these things are of no problem to the people.

A Rasmussen poll dated January 14, 2011 shows that “Overall, 47% of voters say they at least somewhat approve of the president’s performance. Fifty-one percent (51%) disapprove.” Pretending to be a moderate, he has succeeded in fooling almost half of our country. But as the USJF Director Kreep says, “.don’t be fooled by who, or what he really is. He is a socialist. He is pro-Islamic, and he believes that he is “above” the law and the Constitution of the United States of America. Let him succeed in legislating by Executive Order, and his department heads by Secretarial Orders (a right they don’t even possess), and, somewhere, down the road, between now and the Election of 2012, he may just take away all of our Constitutional rights by Executive Order. And, when you say, “Nah, he couldn’t do that here because we are protected by a written Constitution,” remember this:

“In 1934, the Weimar Republic was protected by a written Constitution that was just as powerful as the Constitution of the United States. The Weimar Constitution required the President and Chancellor of Germany go to the members of the Reichstag for authority to do anything. Once he was able to rule by decree, IT TOOK ADOLPH HITLER EXACTLY 39 DAYS TO DESTROY THE WEIMAR CONSTITUTION and become an absolute dictator—-and assume the power of life and death over every subject in the THIRD REICH.”

Obama is just slick enough and stealthily imbued enough to try it; pray to God he doesn’t succeed.

I have doubts he will try such a thing. I have extreme doubts he'd succeed. Too many people will start screaming publicly. Is he a socialist? Yes. Is he Hitler? I don't think so. Might he try to remain "King"? Maybe, but doubtful on that as well.

FCC: Presidential Emergency Alerts to be Tested

    February 7, 2011 - 9:17am

    By Suzanne Kubota
    Senior Internet Editor
    FederalNewsRadio.com

Everybody has heard the national Emergency Alert System (EAS). Those familiar "duck calls" that reassure listeners "THIS is a test...this is ONLY a test..."

The FCC is planning an upgrade to the tests by including presidential announcements in the system.

Lisa Fowlkes, deputy chief of the Public Safety and Homeland Security Bureau of the FCC, explained to the Federal Drive the Presidential Alert isn't new.

"The primary goal is to provide the President with a mechanism to communicate with the American public during times of national emergency," said Fowlkes. The change, she said, is that prior to last week's order there was no rule in place to call for or allow a test from top to bottom.

Fowlkes said, "There's never been a test from top to bottom where it's issued by FEMA and it goes straight down to all the different levels of EAS to the American public. So this is a way for us to glean, okay, if there were an actual emergency and the federal government needed to activate the Presidential EAS, making sure that it actually works the way it's designed to."

Now that there's a rule in place, the next challenges are going to be working with all the stakeholders on timing of the test and to reach out to the public so they understand it's a test and not a real emergency, Fowlkes said.

"We want to make sure that it works the way it's designed to," Fowlkes said. "If there are things that work well, great. If there are things that don't work well, we can work with EAS participants and with state and local governments as well as our federal partners to correct or improve what doesn't work."

At the same time, said Fowlkes, the FCC is looking at how wireless broadband could also enhance the EAS as part of a recommendation that was in the FCC's National Broadband Plan from last year.

The idea is to leverage broadband and the Internet for emergency alerting with the "Commercial Mobile Alert System (CMAS) being developed by FEMA and the wireless industry."

CMAS would allow three kinds of text messaging or wireless alert to be sent, said Fowlkes:

    • Presidential Alerts - "Which would be the same as what the president might issue or FEMA might issue through the EAS system,
    • Imminent Threat Alerts - Which Fowlkes said would warn when "there's a hurricane coming or a tornado coming," and then the
    • Child Abduction Emergency/AMBER Alerts - Alerts related to missing or endangered children due to an abduction or runaway situation.

Fowlkes said the CMAS is slated to begin deployment in April 2012.

The Agenda Revealed: How Obama Will Rule by Executive Order in 2011

    by Ben Johnson

Late last month, a reporter asked the head of the Office of Public Engagement Valerie Jarrett what she would tell her close friend Barack Obama about the American uprising against his aggressive liberalism. She replied, “To stay the course and to know that it will get better.” Those were not idle words of comfort; they were marching orders. The president told the New York Timeshe runs every decision by Jarrett, and she has admitted to Vogue magazine, “I kind of know what makes [both Obamas] who they are.” When she speaks, Obama listens.

The day after the election, as pundits forecast how he would compromise with the Republican House, Barack Obama revealed that he planned to continue moving this country to the Left. As though he were invincibly ignorant to the will of the people, Obama told Democratic volunteers on a conference call, “We’ve just got to work harder to deliver the change the American people want.”

Last week, the Center for American Progress (CAP), which received significant seed money from George Soros, released a 47-page paper (54 pages including the foreword and covers) illustrating how he could do that: by ruling through executive order, as this author reported he would. Some of their proposals include blocking legislation passed by Congress, advancing the Cloward-Piven Strategy, and levying a new fee on foreign oil.

Now, Soros is threatening to dry up the cash flow if Obama does not comply. Obama appears poised to continue shoving the big government liberalism Americans repudiated this month down their collective throat through executive action.

    I Told You So….
My readers have long known this was in the works. On October 8, I wrote, “Obama Considering Rule by Executive Order in 2011.” Since then, others have jumped on the story. The most recent is a column today from Dick Morris and wife Eileen McGann entitled, “Obama Using Executive Authority to Implement Radical Agenda.” My original piece a month ago quoted an L.A. Times article that revealed Obama planned “to advance his agenda through executive actions he can take on his own, rather than pushing plans through an increasingly hostile Congress…That means more executive orders, more use of the bully pulpit, and more deployment of his ample regulatory powers and the wide-ranging rulemaking authority of his Cabinet members.” (Emphases added.) The evidence has continued piling up ever since.

    Pressure from Soros’ Astroturf
Ben Feller wrote an article for The Huffington Post late in October entitled, “What Obama’s Post-Eelection Presidency Could Look Like.” [sic.] Feller said Obama “is already giving clues about how he will govern in the last two years of his term…He will use executive authority when blocked by Congress, and steel for scrutiny and investigations if the GOP is in charge.”

Just after the midterms, Karen Dolan posted an article on the website of the Soros-funded Institute for Policy Studies encouraging IPS members to “push Obama to finally do the right thing through as many Executive Orders as we can present to him.”

Now the Center for American Progress has not only outlined the strategy but provided several examples of executive authority Obama might use to bypass Congress. In making the announcement, CAP president and CEO John Podesta, who served as Bill Clinton’s last chief of staff, told the New York Times Obama “needs to rise above the definition of the presidency as just being a skirmish between Republicans and you…He’s capable of doing things on his own without them.” (Emphasis added.)
As with Jarrett, CAP is not an ordinary think tank. Time magazine called CAP “Obama’s idea factory.” When Green Jobs Czar Van Jones left the White House, he landed as a senior fellow at the Center, leading its Green Opportunity Initiative. More to the point, it is George Soros’ voice in Washington.

    Soros Blackmails Obama?
Coincidentally, the same day the media reported CAP’s executive order strategy, word that George Soros had threatened to cut off Obama’s access to the Left’s wealthiest donors at a highly secretive “private meeting” leaked on The Hufffington Post. Arianna Huffington has been associated with Soros for at least ten years, since she ran the “Shadow Conventions” to drum up support for campaign finance reform. Last March, The Huffington Post received a $1.75 million grant to begin an Investigative Fund from George LaMarche, a member of Democracy Alliance – another funnel of Soros’ mega-bucks into politics, which happened to be the secretive meeting where Soros made his comments. He reportedly told the multimillionaire and billionaire donors “if this president can’t do what we need, it is time to start looking somewhere else.”

In his foreword to the report, Podesta wrote Obama needed to force hard-Left policies through the executive branch “to demonstrate strength, resolve, and a capacity to get things done.”

Soros’ leaked statement was the dagger behind Podesta’s report. Rule from the Left by any means necessary, or else.

    Tips of the CAP
CAP laid out a strategy to promote “progressive change” in “The Power of the President: Recommendations to Advance Progressive Change,” compiled by Sarah Rosen Wartell. Echoing Obama, or perhaps vice-versa, Podesta wrote in the foreword, “Progress, not positioning, is what the public wants and deserves.”

CAP then divides government into six separate areas where Obama should exercise unilateral action. Aaron Klein gave a brief overview at WorldNetDaily , reproducing the pleasant-sounding subheads, like “Promote practices that support working families,” and “Replace costly, inhumane immigration detention policies with equally effective measures.” Who could oppose that?

As with everything, the devil is in the details, which have gone unreported.

    Cloward-Piven, Here We Come
The CAP report suggests Obama make it easier for Americans to sign up for public assistance programs, such as food stamps and Medicaid. It suggests the president overcome “bureaucratic hurdles designed to insure [sic.] income eligibility” by “simplifying and consolidating…public benefits application” requirements. In addition to spending less time assuring the “eligibility” of each applicant, the government should be “directly certifying families for one program is they qualify for another” – e.g., so the 14 percent of the U.S. population that receives food stamps would automatically be eligible for government health care or other services.
The report insists enrolling as many Americans as possible in social welfare programs will not lead to government dependence nor bust the budget. Government handouts, it argues, “increase self-sufficiency.” Since “the vast majority of antipoverty programs are not entitlements – their budgets will be no more or no less than what Congress allots to them.”
This is precisely the Cloward-Piven Strategy. In their 1966 article in Nation magazine entitled, “The Weight of the Poor,” they decried “cumbersome…investigatory procedures (which cost 20c for every dollar dispersed).” Instead, “As delays mount, so should the public demand that a simplified affidavit supplant these procedures, so that the poor may certify to their condition.” This will flood the system with new welfare recipients.
If government funds for these programs run out, the Democratic Party can point to the long lines of poor, naked, sick masses huddling for warmth and demand the Republican Party pony up or have these deaths on their conscience. If the past is any indication, most Republicans will cave in. Meanwhile, bottom-up pressure from Soros-funded groups will demand more radical measures. As Cloward and Piven wrote, “The ultimate aim of this strategy is a new program for direct income distribution.”

Jails? We Don’t Need No Stinkin’ Jails!
Under the category of replacing “costly, inhumane immigration detention policies with equally effective measures,” CAP offers a novel idea: just let illegal immigrants roam free. “The massive increase in the practice of jailing noncriminal immigrants is costly and unnecessary,” it stated. Instead, “detention should be the practice of last resort.” Minors, the elderly, and “the sick” enjoy a “presumption of release.” Virtually all illegal aliens without a criminal record – except breaking the law to enter this country – should be given a court date and released, perhaps with an ankle bracelet any felon can remove. CAP continues, “When detention is warranted, the agency will adopt alternatives that are in the least restrictive setting possible.” It suggests expanding the “Legal Orientation Program that provides detained immigrants with information about their rights” to all facilities where illegals are held.

This policy is the Cloward-Piven Strategy for immigration. It assures the maximum number of illegal aliens remain in the United States by fleeing authorities or exploiting legal loopholes. As I have noted, increasing the number of Hispanics voters is part of the Obama-SEIU plan to create a permanent left-wing voting majority.

    Don’t Pass “Don’t Ask, Don’t Tell”? Don’t Listen
As a measure of the brazen power grab CAP/Soros is advising, they suggest Obama unilaterally allow open homosexuals to serve in the military, even though that is currently illegal. Soros’ think tank instructs Obama to “mitigate the impact of the ‘Don’t Ask, Don’t Tell’ policy if Congress does not repeal it.” CAP advises Obama to allow out-and-proud homosexuals to continue serving in the armed forced for the rest of the war, “in the interests of national security.”

Obama could also begin to “[c]ollect data on lesbian, gay, bisexual, and transgender Americans in federal surveys.” This is to aid “organizations interested in applying for federal funding to support programs designed to improve the well-being of this group of Americans.” It is true homosexuals die an average of 8-21 years younger than their straight counterparts, suffer higher infectious disease levels (especially STDs), and are driven by rampant depression into drug abuse or suicide more than those in the traditional nuclear family.

These disparities reflect less about “discrimination” (do diseases discriminate?) than the inherent dangers of promiscuous homosexuality.

However, to the Left all disparities are caused solely by the rampant discrimination of an evil nation founded by their modern totems of iniquity: white Christian males. The Left would like to use these disparities to drive new Affirmative Action or hate crimes laws granting LGBT members special privileges. Collecting statistics is a first step to this end.

    Nation-Building in Afghanistan
Its foreign policy section calls for full-out nation building in Afghanistan, demanding “the Karzai government” implement “political reforms that increases [sic.] accountability for government actors.” Set revenue goals for the Afghan and Pakistani governments to produce a set amount of money, and help “create a legal and economic framework that plans for the responsible development of Afghanistan’s mineral deposits…and a governance framework that represents affected communities and ensures that that this wealth benefits the Afghan people.”

The report also asks Obama to “increase financial, technical, and training assistance to the Palestinian Authority.”

Read My Lips: New Petroleum Taxes
The CAP report suggests the president levy a “temporary $2 per barrel fee on the nearly two-thirds of U.S. oil imported from other nations,” which would allegedly only “raise gasoline prices by an estimated 2 cents per gallon.” But taxes in a Democratic administration are like government programs; as Ronald Reagan said, they are “the nearest thing to eternal life we’ll ever see on this earth.”

    Rigging Academic Standards
The Obama administration has made war on “for-profit” colleges – DeVry, Corinthian, Phoenix, etc. Stephen Spruiell has noted in NRO, “for-profit schools are the latest front in the Obama administration’s campaign to control as much of the higher-ed industry as possible.” The Wartell-compiled paper provides another weapon: The Department of Education may base accreditation, not on academic standards, but “graduation rate, job placement rate, loan default and loan repayment rates,” and other non-academic criteria. That is, instead of rating whether colleges adequately teach students, they rate them based on their students’ achievements after graduation. The move is another set of special, ex post facto standards crafted specifically to punish an identifiable industry the president hates.

    “The People’s Will”? He Won’t
What startles is not that liberals openly advocate anti-democratic means to achieve their goals; they always have. After all, George Soros said last week, “Today, China has not only a more vigorous economy, but actually a better functioning government than the United States.” Obama has praised “an activist Attorney General’s office and Justice Department” since his 2001 interview with Chicago public radio. Virtually every major triumph the Left has won has been imposed by unelected judges or bureaucrats, from removing prayer from schools and God from America’s public life to allowing abortion on demand.

What startles is the brazenness of it all. The Huffington Post reported on the results of a recent poll: “Almost 60 percent of likely voters now say cutting the yearly budget shortfall is the priority, even if that means the government can’t spend on new education programs, develop alternative energy sources or enact [Obama’s] health care overhaul or alternative energy policies, an Associated Press-GfK poll found.”

(Emphasis added.) That is, the American people do not want any of the measures the president or the Democratic Party campaigned on or promised to deliver. Pure force is their only trump card. Obama has faced the biggest electoral repudiation since the 1930s, and still he vows to run roughshod over his country in pursuit of radicalizing the economy, the culture, and large segments of the population.

    What Comes Next
Here’s what we can expect in the coming months:
Look for an aggressive agenda in the lame duck session of Congress, focused especially on passing the DREAM Act and repealing “Don’t Ask, Don’t Tell.” Obama has already met last week with the Congressional Hispanic Caucus and gay activists, respectively, to push those measures. Sen. Joe Lieberman – suggested by RINOs as McCain’s (or a generic GOP candidate’s) vice presidential choice in 2008 – said last week, “There’s more than 60 senators, I’m certain, who are prepared to vote for” putting gays in the military. Sadly, he may be right.

After January, Cabinet agencies will issue regulations at a faster clip. His most visible target will be the EPA’s regulation of carbon dioxide as a “pollutant.” The EPA considered, then rejected, banning fishing gear and traditional bullets this summer. Obama has taken steps toward nationalizing millions of acres of land in the American West. In June, Obama extended same-sex benefits to overpaid federal workers.

However, every agency will roll out reams of red tape, a process that has already begun. The National Labor Relations Board, including former SEIU/AFL-CIO lawyer Craig Becker, may implement card-check. OSHA will ratchet up ergonomic standards and loosen the strictures restraining workers from suing their employers. As the EPA caps coal emissions from above and the administration makes construction of new plants an impossibility, OSHA’s companion mine regulation agency, MSHA, will pressure the mines from below through tighter worker standards and increased safety suits.

Stealth amnesty will continue apace. A U.S. Citizenship and Immigration Services draft memo that surfaced this summer contemplated ways to enact “meaningful immigration reform absent legislative action.” In June, eight Republicans led by Sen. Chuck Grassley, R-IA, wrote a letter to President Obama asking about a possible executive-granted amnesty. His war against Arizona will spread to any state that steps up enforcement under the guise of fighting discrimination. Obama will continue to create crisis conditions to blackmail Republicans into voting for a comprehensive amnesty bill.

However, the issue closest to Obama’s heart will be an activist role in racially charged issues. His citation of racial disparities will lead to increased federal intervention in every aspect of life, especially from Eric Holder’s Justice Department.

Obama will rule increasingly through executive orders and appeals to the United Nations.

George Soros’s billions will continue to fund faux “grassroots” uprisings, as they have for amnesty, and socialized medicine. Politico quoted Soros spokesman Michael Vachon as saying that Soros told the Democracy Alliance “liberals need to be more forceful and should create pressure from the Left.” As I have repeatedly noted, this gives Obama desperately needed cover to continue moving the country toward outright socialism. And Obama will match their efforts by conscripting as much of your tax dollars as possible to create propaganda aimed at convincing Americans his every action only has their interests at heart.

    Believe It and Prepare
Just before the midterm elections, Republican Senate leader Mitch McConnell said, “I can’t believe he’s going to continue to ignore the wishes of the American people if his party has a very bad day November 2.”

McConnell and the Republicans had better not only believe it but devise a strategy to prevent, block, and reverse Obama’s liberty-destroying measures – or to remove their source from office.

CREATING AMERICA'S FIRST DICTATOR THROUGH SENATE LEGISLATION S.679

CREATING AMERICA'S FIRST DICTATOR THROUGH SENATE LEGISLATION S.679

Presidential Appointment Efficiency and Streamlining Act of 2011President WILL HAVE the sole power to appoint people to positions of his choosing within our governmentWhile all of America is distracted and focused on the death of Osama bin Laden, our President and his minions have been fast at work laying the groundwork for S. 679: Presidential Appointment Efficiency and Streamlining Act of 2011 to speed through the Senate and then make its way into the House and then to the President to sign. Yes, the other hand is quickly forming into a dictatorial fist that is about to smash our Constitution.

As you will recall, the beginning of the end of liberty in Rome commenced with Augustus Caesar who compromised the authority of the Senate through the force of arms and basically the Senate became a facade.

America is poised with this proposed bill, to morph immediately from a Republic into an empire with the privileged eunuchs of the Senate as window dressing and a dictator – the first American Caesar – at the country’s helm.

And leading the progressive charge is Chuck Schumer (D-NY). No big surprise there. Schumer is an elitist Marxist and a first class progressive who hates America almost as much as he loves power. He introduced S. 679 on March 30th, 2011. He was joined by a gaggle of progressives from the left and the right. This is something I have been warning Americans about for a long time. If we are to survive as a nation, we must rid ourselves of ALL progressives or our nation is doomed and freedom will be swept into the dustbin of history

Schumer’s esteemed list of constitutional traitors is as follows:

    Sen. Lamar Alexander (R-TN)
    Sen. Jeff Bingaman (D-NM)
    Sen. Richard Blumenthal (D-CT)
    Sen. Scott Brown (R-MA)
    Sen. Thomas Carper (D-DE)
    Sen. Susan Collins (R-ME)
    Sen. Richard Durbin (D-IL)
    Sen. Mike Johanns (R-NE)
    Sen. Jon Kyl (R-AZ)
    Sen. Joseph Lieberman (I-CT)
    Sen. Richard Lugar (R-IN)
    Sen. Mitch McConnell (R-KY)
    Sen. John Reed (D-RI)
    Sen. Harry Reid (D-NV)
Sen. Sheldon Whitehouse (D-RI)((SO MUCH FOR REPUBLICAN LEADERSHIP))
From The Heritage Foundation, here is a succinct explanation of the bill:

The bill reduces the number of presidential appointments that require the consent of the Senate and establishes within the executive branch a Working Group on Streamlining Paperwork for Executive Nominations.

Individuals nominated to senior executive offices suffer slow and detailed background investigations and mounds of duplicative paperwork before a President sends their nominations to the Senate. After nomination, many nominees suffer time-consuming inaction or time-consuming and excruciating action as the Senate proceeds (or does not) with consideration of the nomination. The sponsors of S. 679 have identified a valid problem, but proposed the wrong solution. Congress should not enact S. 679.

In essence they want to give the President the sole power to appoint people to positions of his choosing within our government. Obama would be free to do this without the approval of the Senate. Senate approval of such positions is mandated by the U.S. Constitution in Article II, Section 2 under the “Appointments Clause”:

… shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments. (emphasis added)

This bill will do away with the checks and balances that separate an American form of government from those such as Venezuela and Brazil.

Already we have power mongers such as Cass Sunstein our Regulatory Czar (more commonly known as the Office of Information and Regulatory Affairs and more aptly titled the Office of Government Propaganda) running amok across the US using agencies such as the EPA as a weapon of regulation and control. There is not a single area in our country that Sunstein does not have his claws sunk deep into. It should scare the crap out of Americans, but all I hear are crickets. The silence of capitulation seals our fate as surely as the thunderous applause of approval – so ends the Republic.

    More from The Heritage Foundation:

When the delegates of the states gathered in Philadelphia in the summer of 1787 and wrote the Constitution, they distributed the powers of the federal government among two Houses of Congress, a President, and a judiciary, and required in many cases that two of them work together to exercise a particular constitutional power. That separation of powers protects the liberties of the American people by preventing any one officer of the government from aggregating too much power.

The Framers of the Constitution did not give the President the kingly power to appoint the senior officers of the government by himself. Instead, they allowed the President to name an individual for a senior office, but then required the President to obtain the Senate’s consent before appointing the individual to office. Thus, they required the cooperation of the President and the Senate to put someone in high office.

I know Americans have not forgotten about Obama’s string of Czars. Czars that he was supposed to downsize or get rid of. Czars, which in my personal viewpoint, were and still are illegal under the Constitution. But progressives never go away, they just shift… As has done so many of Obama’s Czars. With this sweeping bill, over 200 positions will no longer require Senate approval. Obama will dictate who are his powerful lieutenants and who will control America. The Senate will merely be a sham to parrot Obama’s dictates. With this bill, checks and balances will be effectively nullified.

What does that portend you say? One day, your right to own a gun will be gone, just regulated away.

Businesses will be nationalized even more than they are now.

Heavy regulation will ensue concerning communications and the Internet. Many, many private businesses will whither and die.

You will be told what and how much to eat – food and gas rationing will become the norm.

Poverty and squalor will become equal for all as wealth is redistributed to other nations.

If there are elections, they will be a joke and pointless.

There will be a few powerful elites and then the masses.

Guess which camp you and I will be in?

Our best hope at this juncture is that this abomination will be stopped in the House. We must weed out the progressives and we must win in 2012.

This country will not survive another four years of progressive policies. Not as a Republic and not as a free entity anyway.

The bitter irony on display here, is that the same jackals that have barked and snarled and feigned horror at “American Imperialism,” are the very ones who now howl their support for a true American Dictator.

The process by which heads of executive branch departments are appointed and confirmed is set forth by Article II, Section 2 of the U.S. Constitution. The “Appointments Clause” provides that the President:
… shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.

If this bill passes, the checks and balances established by our Founding Fathers as a protection against tyranny will be eliminated, as well as the concept of enumerated powers.

I have a migraine, and am doing bench work, so don't have enough time to dig very deep on this. Was taking a few minutes break so I can get my vision back enough to see what I'm working on, at the work bench but can read a bit.

If I get time later, I'll try to find the bill in it's totality and post it.
