Florida judge won't delay trial on Trayvon Martin's murder

(Reuters) - A Florida judge on Tuesday rejected a bid by George Zimmerman to delay his June trial for the murder of unarmed, black teenager Trayvon Martin, whom he shot and killed a year ago this month.


"I don't see any of your issues as insurmountable," Seminole County Circuit Court Judge Debra Nelson said in denying a motion by Zimmerman's lawyer, Mark O'Mara, for a continuance in the racially charged trial.


A memorial service for Martin, who would have turned 18 on Tuesday, was held on the courthouse lawn before the hearing got under way.
Before ruling, Nelson noted she had set aside several full days of court time for Zimmerman's defense attorneys and prosecutors to bring issues before the court, but most of that time had gone unused.


She also said O'Mara had been working on Zimmerman's defense since April 2012 and still has another four months to prepare for the June 10 trial.
O'Mara had told reporters he needed at least another six months to raise money and lay the groundwork for the trial. Zimmerman could face up to 25 years to life in prison if convicted of second-degree murder.


Prosecutor Bernie de la Rionda signaled his opposition to any delay in the trial last week and accused O'Mara of spending too much time conducting media interviews and not enough interviewing witnesses and examining evidence.


O'Mara testily told a news conference after Tuesday's hearing that it could be "physically impossible" for the defense to get fully prepared for the June trial date.


"We are busting butt on this case," he said, after Judge Nelson failed to cede any ground on the start date.


Jeopardizing his own ability to rely on expert witnesses at the trial, O'Mara told Nelson he would be unable to meet the judge's deadline for notifying prosecutors what experts he plans to call on to testify on Zimmerman's behalf.


Zimmerman, who is out on a $1 million bond, is living in hiding in central Florida pending his trial. At the time of the shooting, he was a neighborhood crime watch volunteer in a gated community where Martin was staying with his father.


The fair-skinned son of a white father and Hispanic mother, Zimmerman claims he shot Martin in self-defense following a confrontation that occurred as Martin was returning to the home of his father's girlfriend in the gated community after buying candy from a convenience store.


Police in the central Florida town of Sanford initially declined to arrest Zimmerman, citing Florida's "Stand Your Ground" law, which allows people to use deadly force when they believe they are in danger of getting killed or suffering great bodily harm.


The lack of an arrest led thousands to march in rallies in Florida and across the nation to demand justice for Martin. Protesters complained that African-Americans are seen as second-class citizens by the police and the U.S. justice system.


The fatal encounter between Martin and Zimmerman also threw the spotlight on gun control and Florida's much criticized "Stand Your Ground" statute, also known as a "shoot first" law, which was signed into law by former Governor Jeb Bush in 2005.


The law, backed by the National Rifle Association, was the first of its kind in the United States. Similar laws have been passed since in at least 23 other states, according to the Brady Campaign to Prevent Gun Violence.

George Zimmerman's attorneys stunned court observers today by deciding to skip a "Stand Your Ground" hearing slated for April that might have led to a dismissal of the charges in the shooting death of unarmed teenager Trayvon Martin.


Under Florida's Stand Your Ground law, Zimmerman is entitled to immunity and if he can prove he shot and killed Martin Feb. 26, 2012 self defense. If self defense was determined, all criminal proceedings would have immediately stopped, and Zimmerman would have walked free.


But Zimmerman's legal team also risked the possibility that the judge would reject the motion and the hearing would give prosecutors an opportunity to pick apart Zimmerman's testimony.


The defense left open the likelihood that they could ask for a Stand Your Ground hearing before the June trial, but by waiting until the later date his legal team would have more time to prepare their case.

Zimmerman, 29, faces second degree murder charges for killing Martin. The teenager was shot after Zimmerman, a neighborhood watch captain, told police he thought Martin was acting suspiciously. Zimmerman got out of his car, but he claims that Martin knocked him down and Zimmerman shot him in a struggle over Zimmerman's gun.
During today's hearing, the two sides wrangled over a couple of other pretrial issues.


Zimmerman's defense appeared to question the credibility of a teenage girl, identified only as Witness 8, who claims she was on the phone with Martin just moments before he was shot. Witness 8 is arguably the key witness in the upcoming trial.


Witness 8 told authorities that Martin told her that he was scared of a strange man following him. She also claimed that that after hearing the shooting over Martin's phone, she was hospitalized for trauma, a claim that prosecutors later admitted was false.


The defense wanted Judge Debra Nelson to question prosecutors about how they learned that this claim was not true, but Nelson refused. Defense attorney Donald West also asked the court for more information about the account she gave attorneys.


According to records obtained by ABC News she was on the phone with Martin as his confrontation with Zimmerman began.


Zimmerman's defense also sought any criminal history police may have on Martin as well as his social media history.


In an earlier hearing the judge ruled that Zimmerman's defense could subpoena Martin's social media history but the undertaking is time consuming and expensive.

Authorities agreed to hand over the documents to the judge so that she could review them and determine if the defense should have them.


"It's time and money to get some of the information here and we are running out of both," said West.

Tuesday was a huge day in the George Zimmerman case. How huge?

“Today was a major turning point,” WESH-Channel 2’s Bob Kealing said. “George Zimmerman’s defense is all in now for a jury verdict of Zimmerman’s guilt or innocence.”
WFTV-Channel 9 anchor Vanessa Welch saw a “bombshell announcement.”


Zimmerman’s defense is not asking for a stand your ground hearing next month. He is charged with second-degree murder in the fatal shooting of Trayvon Martin last year in Sanford.
“The defense says Zimmerman could not have gotten away if he wanted to,” WFTV’s Kathi Belich said. “They’re saying it’s not stand your ground. It’s self-defense.”


WKMG-Channel 6’s Tony Pipitone said it was never a stand your ground case. “At a trial now, the state is going to have the burden to prove it was murder or manslaughter,” Pipitone said. “At one of those immunity hearings, the burden is on the defense.”


WFTV legal analyst Bill Sheaffer said the defense’s move could be smart because Zimmerman could argue self-defense in a civil suit. “He could have the case thrown out on immunity and the Martins wouldn’t see a penny,” Sheaffer said.


Another big development: The state confirmed that Witness No. 8, the woman who had been on the phone with Martin before he was shot, was not in the hospital during his funeral, as she had said. “It could be used to challenge her credibility when she testifies,” Pipitone said.


Defense attorney Mark O’Mara said No. 8 could be the most significant witness in the case.


“You never want your star witness to be caught in a lie,” WFTV’s Sheaffer said. “Lie about one thing. What else could she be lying about?”


WESH legal analyst Richard Hornsby said it was a big deal. “It goes to the heart of what the defense argument is that she was likely coached, that she’s likely being untruthful,” he said. “I think it’s a huge revelation for the defense.”

SANFORD — Trayvon Martin's girlfriend, the state's most important witness in the George Zimmerman murder case, was caught in a lie, it was revealed Tuesday.
It was not the first piece of misinformation tied to her, but it was the most damaging to date and left prosecutors in a very awkward position.





They had to publicly acknowledge that their star witness had lied under oath and had to answer questions about what they intend to do about it.


Reporters asked: Will you charge the 19-year-old Miami woman with perjury?


The state's lead prosecutor, Bernie de la Rionda, gave an ambiguous answer: "You can all read the law and make your own decision."


The woman had told prosecutors she was in the hospital on the day of Trayvon's funeral.


"In fact, she lied," defense attorney Don West said.


The disclosure was one of two major developments Tuesday at what had been expected to be a dull hearing about the exchange of case evidence.


The other: Zimmerman's lawyers will not hold a "stand your ground" hearing in April, one that could clear him of criminal wrongdoing before his trial.


Defense attorney Mark O'Mara made that announcement in court, later saying he had not yet decided whether to scrap it entirely or roll it into Zimmerman's second-degree-murder trial set for June 10.


"Our real focus is getting ready for the trial," O'Mara said.


What Zimmerman most wants is to be tried by a jury of his peers, O'Mara said, and with fewer than 100 days until trial, "There's only time for one hearing, and that's a jury trial. … We have precious little time."


Zimmerman was not at Tuesday's hearing. Neither was his wife, Shellie, who's awaiting trial on a perjury charge, accused of lying at her husband's April 20 bond hearing.

That's what prompted the perjury question to de la Rionda.


If defense lawyers decide to forgo George Zimmerman's immunity hearing, they would be cutting in half their number of opportunities to spare him from a life in prison.


Florida's "stand your ground" statute has generated a great deal of public debate since Trayvon's death one year ago in Sanford. It provides immunity to anyone who uses deadly force, provided he has a reasonable fear of imminent death or great bodily injury.


Zimmerman says he shot Trayvon in self-defense.


Because of Circuit Judge Debra S. Nelson's very tight schedule, when O'Mara told her he would not put on a two-week "stand your ground" hearing starting April 22, he essentially told her he would not hold that hearing before Zimmerman's trial.





She did not press him to spell out his plans.


De la Rionda said he was "bewildered" by O'Mara's decision but did not elaborate.


Zimmerman, a 29-year-old former Neighborhood Watch volunteer, called Sanford police Feb. 26, 2012, describing Trayvon as suspicious. Zimmerman shot the unarmed high-school junior a few minutes later, saying he fired in self-defense after the Miami Gardens 17-year-old punched him, broke his nose, then began pounding his head onto a sidewalk.


Sanford police found no witnesses tothe initial confrontation, but Trayvon's family attorney, Benjamin Crump, found something close: Trayvon's girlfriend,identified in court records as "witness 8." She told Crumpshe had been on the phone with Trayvon just before the shooting.


According to an interview Crump recorded after the shooting, the young woman said Trayvon told her a stranger was following him, and he was scared. Trayvon got away from him once, but the man reappeared, she said, and she heard Trayvon ask, "'What are you following me for?'"


The man answered, "'What are you doing here?'" she said, and then she said the man must have pushed Trayvon because the phone went dead.


The woman gave de la Rionda a very similar account during a sworn statement April 2, and when his office wrote up its probable-cause affidavit, charging Zimmerman with second-degree murder, it rehashed her account but did not include her allegation that she heard Zimmerman push Trayvon.


Despite's Tuesday's revelation, there is no indication the woman lied about what she heard on the phone the evening Trayvon was shot. But she appears to have given Crump another piece of bad information: her age.


He told reporters in March, when he played excerpts from the recorded interview, that she was 16 years old. In fact, she was 18 at the time. Crump has said he did not knowingly misrepresent her age.


O'Mara would not say whether the woman should be prosecuted for perjury for lying under oath about being in the hospital.


But months ago, he and co-counsel Don West began trying to investigate her. They earlier persuaded the judge to allow them to subpoena her Twitter and Facebook accounts so they can read her posts.

Report: Trayvon Martin's Family Settles With Homeowners Association

The parents of Trayvon Martin have settled a wrongful death claim against the homeowners association of the Florida neighborhood where the teenager was fatally shot, the Orlando Sentinel reported Friday.

The report of the settlement comes more than 13 months after neighborhood watch volunteer George Zimmerman shot Martin in Zimmerman's neighborhood in Sanford, Florida.

An attorney representing the homeowners association's president declined to comment when reached by CNN Friday afternoon. CNN's attempts to reach Benjamin Crump, an attorney for Martin's parents, weren't immediately successful.

Zimmerman is awaiting trial, charged with second-degree murder in Martin's death. He claims he shot Martin in self-defense after Zimmerman saw the 17-year-old acting suspiciously in the neighborhood.

Attorneys for Martin's family have accused Zimmerman of racially profiling the 17-year-old and shooting him "in cold blood."

Fact of the matter, little Tray-Tray is probably worth more dead than alive to his family and, in all honesty, society as well. Just think of all the prison costs that will not need to be spent on him and welfare for all the little bastards he was sure to spawn.

SANFORD, Fla. (WSVN) -- For the first time, George Zimmerman's mother is speaking out about the Sanford shooting.


Gladys Zimmerman released a two-page letter through her son Robert's Twitter page on Wednesday-- the anniversary of George Zimmerman's arrest.


He was arrested last April for shooting and killing 15-year-old Trayvon Martin.


In the letter, she criticizes the justice system and bashes the media for perpetuating a false narrative about her son.


An excerpt included: "The truth will finally be revealed to many, but to some who have always seen through the narrative - the truth George always told will not be 'revealed,' but rather 'confirmed.'"

Some deaths are more politically useful than others.



Twenty years ago this week, the Clinton administration ordered a tank assault on the Mount Carmel community, killing 39 racial minorities, 26 of them black. The Clintons and the media suppressed the racial data so rigorously that I doubt even Al Sharpton knows about the black dead at Waco.



A year ago Feb. 26, neighborhood watch captain George Zimmerman shot and killed 17-year-old Trayvon Martin in Sanford, Fla., and within a month every sentient person on the planet knew “Trayvon” by name.



What they did not know was Martin’s background. Sanford Police Department (SPD) investigator Chris Serino, for instance, said publicly of Martin, “This child has no criminal record whatsoever.” He called Martin “a good kid, a mild-mannered kid.” The media almost universally sustained this tragically false narrative.


Martin had the seeming good fortune of attending school in the Miami-Dade School District, the fourth-largest district in the country and one of the few with its own police department.



For a variety of reasons, none of them good, elements within the SPD and the Miami-Dade School District Police Department, or M-DSPD, conspired to keep Martin’s criminal history buried.



As part of its mission the M-DSPD was allegedly trying to divert offending students, especially black males, from the criminal justice system. As the Martin death would prove, the M-DSPD diverted offending students to nothing beyond its own statistical glory.



The exposure of M-DSPD practices began inadvertently on March 26, 2012, when the Miami Herald, the one mainstream outlet to do real reporting on the case, ran a story on Martin’s background.



The Herald’s headline, “Multiple suspensions paint complicated portrait of Trayvon Martin,” should have caused the other media to seek the truth about the very nearly sanctified Martin.



It did not. What it did do was to cause M-DSPD Police Chief Charles Hurley to launch a major Internal Affairs (IA) investigation into the possible leak of this information to the Herald.



At the end of the day, Hurley rather wished he had not. The detectives questioned told the truth about Martin and about the policies that kept him out of the justice system. Hurley would be demoted and forced out of the department within a year.



We now know what the detectives revealed thanks to a recently fulfilled Freedom of Information Act request filed by the dogged researchers at a blogging collective known as The Conservative Treehouse. The “Treepers” have literally done more good work on the Martin case than all the newsrooms in America combined.



On Feb. 15, 2012, 11 days before Martin’s death, the Miami-Dade County Public Schools put out a press release boasting of a 60 percent decline in school-based arrests, the largest decline by far in the state.



“While our work is not completed, we are making tremendous progress in moving toward a pure prevention model,” Hurley told the Tampa Bay Times, “with enforcement as a last resort and an emphasis on education.”



Hurley’s detectives, all of them veterans with excellent records, told a different story under oath when questioned by Internal Affairs. They knew the shell game was about to be exposed upon first learning that Martin was one of their students and outside agencies would be requesting his records.



“Oh, God, oh, my God, oh, God,” one major reportedly said when first looking at Martin’s data. He realized that Martin had been suspended twice already that school year for offenses that should have gotten him arrested – once for getting caught with a burglary tool and a dozen items of female jewelry, the second time for getting caught with marijuana and a marijuana pipe.



In each case, the case file on Martin was fudged to make the crime less serious than it was. As one detective told IA, the arrest statistics coming out of Martin’s school, Michael Krop Senior, had been “quite high,” and the detectives “needed to find some way to lower the stats.” This directive allegedly came from Hurley.
“Chief Hurley, for the past year, has been telling his command staff to lower the arrest rates,” confirmed another high-ranking detective.



When asked by IA whether the M-DSPD was avoiding making arrests, that detective replied, “What Chief Hurley said on the record is that he commends the officer for using his discretion. What Chief Hurley really meant is that he’s commended the officer for falsifying a police report.”



The IA interrogators seemed stunned by what they were hearing. They asked one female detective incredulously if she were actually ordered to “falsify reports.” She answered, “Pretty much, yes.”



Once the top brass understood that the Martin case had the potential to expose the reason for the department’s stunning drop in crime, they told the detectives “to make sure they start writing reports as is; don’t omit anything.”



“Oh, now, the chief wants us to write reports as is,” said a Hispanic detective sarcastically, “and not omit anything, as we have been advised in the past?”



The IA investigation delved into the paranoid concern that the M-DSPD was sharing information about Martin with other relevant police departments as it routinely did in other multi-jurisdictional cases.



The one detective who sent information to the Sanford PD came under heavy fire. He was appalled. “Currently, our department is functioning and operating out of fear,” he told the IA. “It is tragic to see that I’ve been disciplined at the direction of Chief Hurley.”



As it turned out, Hurley need not have worried about the SPD. As the Conservative Treehouse reports, the information sent by the M-DSPD “disappeared down the rabbit hole and was not included in the final victimology report filed by Sanford Detective Serino.”



Serino was the Martin-friendly detective who had insisted that Martin “has no criminal record whatsoever,” calling him, “a good kid, a mild-mannered kid.”



In Hurley’s defense, school districts across the country had been feeling pressure from the nation’s race hustlers to think twice before disciplining black students.

Last year, the White House formalized the pressure with an executive order warning school districts to avoid “methods that result in disparate use of disciplinary tools.”


Jesse Jackson brought this nonsense home to Sanford during a large April 1, 2012, rally. He implied that Martin had been profiled by his high school for being a black male and suspended for the same reason. “We must stop suspending our children,” Jackson told the crowd.



In a way, Jackson was right. Martin should not have been suspended. He should have been arrested on both occasions. Had he been, his parents and his teachers would have known how desperately far he had gone astray.



Instead, Martin was “diverted” into nothing useful. Just days after his non-arrest, he was allowed to wander the streets of Sanford high and alone looking, in Zimmerman’s immortal words, “like he’s up to no good or he’s on drugs or something.”



At the end of the day, Martin had avoided becoming an arrest statistic, only to become a statistic of a much graver kind.

Defense attorneys in the George Zimmerman case today released evidence they discovered on Trayvon Martin's cell phones, including text messages in which he wrote about taking part in organized fights.
The new evidence also includes texts in which he wrote that his mother had just kicked him out of the house and that he was in trouble for cutting class at school.
The evidence packet also includes two dozen photos including one that shows him with gold teeth and one of him making an obscene gesture.

Some of the photos have been widely circulated online, but today defense attorneys officially notified prosecutors that they intend to use them at Zimmerman's second-degree murder trial.
There are also new photos, which defense attorneys indicate came from Trayvon's cell phone. They show the teen blowing smoke. They also show a handgun, which appears to be a .40-caliber Smith & Wesson, as well as what appear to be several marijuana plants.

The text messages about fighting may be the most damaging to the state.
Zimmerman says he acted in self-defense when he shot Trayvon, an unarmed black 17-year-old, in Sanford, Feb. 26, 2012.
Zimmerman described Trayvon to police as an aggressive young man who punched him, knocking him to the ground then climbed on top and began hammering his head onto a sidewalk.
In one text message Trayvon sent Nov. 22, 2011, he wrote about his unnamed opponent, "he got mo hits cause in da 1^st round he had me on da ground an I couldn't do ntn."
In another text send Dec. 12 he acknowledged earning a reputation in the neighborhood – although because words were blacked out, it's not clear what his reputation was. His reputation came, he wrote, because of "Duh way I fight nd duh golds (teeth) I had last year."
Trayvon's text messages also show that he was interested in guns. A few days before the shooting, he wrote an unidentified friend, "U wanna share a .380"
And about a week before that, he texted a young Miami woman who's been described as his girlfriend, "U gotta gun?"
Her response: yes, although she did not have possession of it. "It my mommy but she buy for me," the young woman wrote.
On November 22, 2011, three months before he was killed, he wrote a friend that his mother had ordered him to move out and that he had gotten in trouble for cutting classes.
"I promise my mom just told me I gotta move," he wrote. Two minutes later, he wrote, "Da police caught me outta school."
Circuit Judge Debra S. Nelson must now decide whether to allow jurors to learn about the text messages and photos. In paperwork filed earlier this month, Assistant State Attorney Bernie de la Rionda asked her to ban them, describing them as irrelevant.
The evidence packet also includes information from Trayvon's school records, however, those were not made public because of student privacy laws. Sanford police, however, reported that Trayvon was serving a 10-day suspension at the time of his death because Miami-Dade school police had found him with an empty marijuana baggie in his backpack.

ORLANDO, Fla. - Attorneys for George Zimmerman, the neighborhood watchman who shot and killed 17-year-old Trayvon Martin, released another round of evidence Thursday, including the teen's cellphone records and pictures.


Eight reports, totaling more than 20 pages, of Martin's cellphone records were released, including 25 pictures and videos. The evidence also includes school records and videos from the school, a handwritten letter from Witness 8, Zimmerman's medical report from Feb. 27, 2012, and pictures of Witness 25.

The photos show Martin blowing smoke and extending his middle finger to the camera. The photos also show a gun and what appears to be a potted marijuana plant.
In the text messages, Martin tells a friend that his mother has told him he needs to move out of her house and move in with his father since he was caught skipping school.
In one of the records, Martin tells someone his mother kicked him out of the house. Some of the texts have been redacted, so it's not clear whom Martin is texting.
Attorney Mark O'Mara also included alerts and emails from the neighborhood Retreat at Twin Lakes, where Martin and Zimmerman's altercation occurred on Feb. 26, 2012. The defense appears to be showing that there were problems in the subdivision in the weeks leading up to the shooting.


In one of the records, Zimmerman sent an email regarding a burglary and a prowler. The Sanford Police Department also gave someone a trespassing warning days before the shooting, according to the evidence released.

Jury selection in Zimmerman's second-degree murder trial is slated to begin June 10. Zimmerman has pleaded not guilty, claiming self-defense. The next hearing in his trial is slated for Tuesday.
