COMPLAINT FOR DECLARTORY AND INJUNCTIVE RELIEF PRELIMINARY STATEMENT

1. Article II, Section I of the United States Constitution, states in particular part, "No Person except a natural born Citizen, or a Citizen of the United States at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been Fourteen Years a Resident within the United States." Furthermore, all Presidents since and including Martin Van Buren were born in the United States subsequent to the Declaration of Independence.
2. "The general doctrine of our Constitution is, that the executive power of the nation is vested in the President; subject only to the exceptions and qualifications, which are expressed in the instrument." 7 Works of Alexander Hamilton, J. C. Hamilton ed. (New

1. Obama is a representative of the Democratic People. However, the Obama must meet the Qualifications specified for the United States Office of the President, which is he must be a "natural born" citizen. Unfortunately, Obama is not a "natural born" citizen. Just to name one of the problems, Obama lost his U.S. citizenship when his mother married an Indonesian citizen and relocated herself and Obama to Indonesia wherein Obama's mother naturalized in Indonesia and Obama followed her naturalization, as he was a minor and in the custody of his mother. Obama failed to take the oath of allegiance when he turned eighteen (18) years to regain his United States Citizenship status.
2. The Democratic National Committee is for Plaintiff and "We the People" who believe in the Democratic Vision. The Democratic National Party is supposed to represent the Democratic Americans in seeking honest leadership, Open Government, Real Security, Energy Independence, Economic Prosperity, Educational Excellence, a Healthcare System that works for Everyone and Retirement Security. The Democratic Party is supposed to represent and protect the interests of working Americans and guaranteeing personal liberties for all. Of which includes securing a Democratic Nominee on the Presidential Election ballot who represents the Democratic vision and who is qualified and eligible to run for Office of the President under the qualifications of the United States Constitution.
3. The actions of Obama, a U.S. Senator, in running for President of the United States, knowing he is not eligible, have been taken entirely without authorization under the

United States Constitution, completely ignoring the qualification and procedures created

>by the United States Constitution he is purporting to enforce.

>6. Should Obama become the Nominee of the Democratic Party and then be discovered by virtue of malfeasance, or negligence, on his part not to have revealed material evidence showing him to be Ineligible for the Office of President of the United States of America and thereby his Nomination be declared void by the appropriate Authorities Acting under the Law, Plaintiff as well as other Democratic Americans will suffer Irreparable Harm including but not limited to:

>A) Functional, or Actual, Disenfranchisement of large numbers of Citizens, being members of the Democratic Party, who would have been deprived of the ability to choose a Nominee of their liking;

>B) Irreparable Harm to the structure and integrity of the Democratic Party and the Democratic National Committee. In tum, this too would lead to Disenfranchisement; and

>C) A severe and genuine likelihood of Civil Disturbance by virtue of reaction to said Disenfranchisement.

JURISDICTION AND VENUE

1. This case arises under the Constitution and laws of the United States and presents a federal question within this Court's jurisdiction under Article III of the Constitution and 28 U.S.C. § 1331.
2. This Court has authority to grant declaratory relief pursuant to the Declaratory Judgment Act, 28 U.S. C. § 2201.
3. Venue is proper in this Court under 28 U.S.c. § 1391(b).

PARTIES

1. Plaintiff, Plaintiff, Philip J. Berg, Esquire [hereinafter "Plaintiff'], is an adult individual with a businessaddress of 555 Andorra Glen Court, Suite 12, Lafayette Hill, PA 19444-2531.
2. Defendant, Barack Hussein Obama, alk/a Barry Soetoro, alkla Barry Obama, alk/a Barack Dunham, a/kla Barry Dunham [hereinafter "Obama" is an adult individual with an office address of713 Hatch, Senate Office Building, Washington D.C.
3. Obama, The Democratic National Committee (hereinafter referred to as "DNC") is a Corporation with a principal address of 430 S. Capitol Street SE, Washington, DC 20003.
4. Defendant, The Federal Election Commission (FEC) was created in 1975 by Congress to administer and enforce the Federal Election Campaign Act (FECA). The FEC is a Governmental Agency with a principal address of 999 E Street, NW, Washington, DC 20463.

FACTUAL ALLEGATIONS

1. Since the beginning of the U.S. Constitution, in order to run for Office of the President, you must be a "natural born citizen" and you may not hold dual citizenship or multiple citizenships with foreign Countries. U.S. Constitution, Article II, Section 1.
2. There are questions as to where Obama was actually born, in the United States or abroad and then registered his birth. There are further questions regarding Obama's United States Citizenship, ifhe ever held such, being expatriated and his failure to regain his citizenship by taking the oath of allegiance once he turned eighteen (18) years of age. There are additional questions regarding Obama's multi citizenships with foreign countries, which he still maintains. To date, Obama has refused to prove he is qualified under the U.S. Constitution and his eligibility to run as President ofthe United States.
3. The facts are undisputed by Obama that his mother, Stanley Ann Dunham, was a U.S. Citizen however, his father, Barack Obama, Sr., was a Citizen of Kenya. Obama's parents, according to divorce records, were married on or about February 2, 1961.
4. Obama claims he was born in Honolulu, Hawaii on August 4, 1961; however, has never given the name of the hospital he was born in; whereas Obama's grandmother on his father's side, half brother and half sister claim Obama was born in Kenya. Reports reflect Obama's mother went to Kenya during her pregnancy; however, she was prevented from boarding a flight from Kenya to Hawaii at her late stage of pregnancy, which apparently was a normal restriction to avoid births during a flight. Stanley Ann Dunham (Obama) gave birth to Obama in Kenya, after which she flew to Hawaii and registered Obama's birth. There are records of a "registry of birth" for Obama, on or about August 8, 1961 in the public records office in Hawaii.
5. Upon investigation into the birth of Barack Hussein Obama in Honolulu, Hawaii, Obama's birth is reported as occurring at two (2) separate hospitals, Kapiolani Hospital and Queens Hospital. Wikipedia English Version under the subject "Barack Obama"

states Obama was born at Kapiolani Hospital. Wikipedia Italian Version under the subject "Queens Hospital" states Barack Obama was born in Queens Hospital.

1. There are further references circulating on the internet claiming examination of the hospital's records in Hawaii show no birthing records for Stanley Ann Dunham (Obama), Obama's mother. However, there are records of a "registry of birth" for Obama, on or about August 8, 1961 in the public records office in Hawaii.
2. Wayne Madsen, Journalist with Online Journal was a contributing writer and published an article on June 9, 2008 stating the GOP sent a research team to Mombasa, Kenya and located a Certificate Registering the birth of Barack Obama, Jr. at a Maternity Hospital, to his father, a Kenyan Citizen and his mother, a U.S. Citizen.
3. At the time ofObama's birth in 1961, Kenya was a British Colony.
4. There is a Canadian Birth Certificate posted on the Internet in the name of Barack Hussein Obama, Jr.; however, the date of birth shows to be August 23, 1961.
5. Under the Independence Constitution of Kenya, Obama became a Kenyan citizen on December 12, 1963. Chicago-based Internet journalist, broadcaster and critic Andy Martin states Obama has never renounced his Kenyan citizenship. Andy Martin further states on Obama's Senate web site, Obama tap dances around his own dual nationality when discussing his father. Obama obviously knows, because his father told the Obama, that he (Obama) also held/holds Kenyan nationality.
6. If in fact Obama was born in Kenya, the laws on the books at the time of his birth stated if a child is born abroad and one parent was a U.S. Citizen, which would have been his mother, Stanley Ann Dunham, Obama's mother would have had to live ten (10) years in the United States, five (5) of which were after the age of fourteen (14). At the time of

Obama's birth, his mother was only eighteen (18) and therefore did not meet the

residency requirements under the law to give her son (Obama) U.S. Citizenship. The laws in effect at the time of Obama's birth prevented U.S. Citizenship at birth of children born abroad to a U.S. Citizen parent and a non-citizen parent, if the citizen parent was under the age of nineteen (19) at the time of the birth of the child. Obama's mother did not qualify under the law on the books to register Obama as a "natural born" citizen. Section 301(a)(7) of the Immigration and Nationality Act of June 27,1952,66 Stat. 163, 235, 8 U.S.c. §1401(b), Matter of S-F-and G-, 2 I & N Dec. 182 (B.I.A.) approved (Att'y Gen. 1944). Obama would have only been Naturalized and a Naturalized citizen is not qualified and/or eligible to run for Office of the President. U.S. Constitution, Article II, Section Clause 4.

1. Furthermore, if Obama had been born in Kenya, his birth father Barack Obama, Sf. was a citizen of Kenya; therefore, Obama would have automatically become a citizen of Kenya.
2. In or about 1967, when Obama was approximately six (6) years old, his mother, Stanley Ann Dunham married Lolo Soetoro, a citizen of Indonesia and moved to Indonesia with Obama. At this time, if Obama was Registered as a "natural born" citizen, which he did not qualify to be registered as, he would have lost his U.S. Citizenship when his mother married Lolo Soetoro and took up residency in Indonesia. The first requirement is that naturalization must be achieved through "application." Such type of naturalization occurs, for example, when a person acquires a foreign nationality by marriage to a national of that country. Nationality Act of 1940, Section

>317(b). Additionally, there is rumor circulating on the Internet that his Indonesian stepfather, Lolo Soetoro, adopted Obama.

1. >The Nationality Act of 1940 provided for the loss of citizenship when the person became naturalized upon the naturalization of his or her parent having custody of such person. Obama's mother expatriated her U.s. Citizenship when she married Lolo Soetoro, a citizen of Indonesia and relocated her and her son (Obama) to Indonesia.
2. >Obama was enrolled by his parents in a public school, Fransiskus Assisi School in Jakarta, Indonesia. Plaintiff has received copies of the school registration where it clearly states Obama's name as Barry Soetoro and lists his citizenship as Indonesian, Obama's father is listed as Lolo Soetoro, Obama's date of birth and place of birth are listed as August 4,1961 in Honolulu and Obama's Religion is listed as Islam. This document was verified by television show Inside Edition, whose reporter, Matt Meagher took the actual footage of the school record.
3. >In or about 1971, Obama's mother sent Obama back to Hawaii. Obama was ten (10) years of age upon his return to Hawaii.
4. >Sometime after the return of Obama to Hawaii, Obama's mother, Stanley Ann Dunham returned to Hawaii and divorced her husband, Lolo Soetoro. At the time of Divorce, Obama's mother, Stanley Ann Dunham could have regained her U.S. Citizenship. In order to regain her citizenship, Obama's mother would have had to take the oath of allegiance required. Such oath of allegiance may be taken abroad before a diplomatic or consular of the United States, or in the United States before the Attorney General or the judge or clerk of a Court. Such Oath of allegiance would have been entered in the records of the appropriate embassy, legation, consulate, court or the

Attorney General and upon demand, a certified copy of the proceedings, including a copy of the oath administered, under the seal of the embassy, legation, consulate, court or the Attorney General shall be delivered. The certified copy shall be evidence of the facts stated therein before any court of record or judicial tribunal and in any department or agencyoftheGovernment oftheUnitedStates. 8U.S.c.§1435.

31. As stated above, The Nationality Act of 1940 provided for the loss of citizenship when the person became naturalized upon the naturalization of his or her parent having custody of such person. Obama's mother expatriated her U.S. Citizenship when she married Lolo Soetoro, a citizen of Indonesia and relocated her and her son (Obama) to Indonesia.

Obama's mother failed to take the oath in order to regam her U.S. Citizenship. Therefore, Obama would not have been able to regain his U.S. Citizenship until he turned eighteen (18) years after he took the oath of allegiance before a diplomatic or consular officer of the United States, or in the U.S. before the Attorney General or the judge or clerk of court. Plaintiff is informed, believes and thereon alleges Obama failed to regain his citizenship by taking the oath of allegiance. Since the oath of allegiance would have been entered in the records of the appropriate embassy, legation, consulate, court or the Attorney General, if Plaintiff is incorrect, then Obama should be able to produce in Court a certified copy of the proceedings, including a copy of the oath administered.

Investigation further showed in 1981, Obama traveled to Pakistan usmg his Indonesian passport. At the time of travels to Indonesia, Obama was twenty (20) years old. He was well aware he maintained his Indonesia citizenship, and failed to regain his United States citizenship. Indonesia does not allow dual citizenship. Had Obama

regained his United States citizenship, he would have been traveling on a United States Passport.

Obama and his Campaign office have been asked Obama's Certificate of Birth in order to prove he is a "natural born" citizen as required by the U.S. Constitution.

1. After many attempts of the public to obtain Obama's Certificate of Birth, a Hawaiian CCl1iticate of Live Birth (COLB) was placed on Obama's campaign website. However, as posted all over the internet, three (3) independent Document Forensic Experts performed extensive Forensic testing on the Certificate of Live Birth posted on Obama's campaign \vebsite. Thc Forensic Expert findings were the Certificate of Live Birth (COLB) was in a forgery. It was further discovered that this original Cer1ificate of Live Bil1h which had becn altered and f()rged was issued to Maya Kasandra Soetoro, born in J 970. Maya Kasandra Soetoro is Obama's half sister \vho was born in Indonesia and her birth was later registered in Hawaii. The altered and forged COLB is still on Obama's website located at http://my.barackobama.com/page/invite/birthcert
2. Further investigation led to Obama's State Bar Registration and Public Disciplinary Record. On the Illinois State Bar Registration and Public Disciplinary Record it specifically asks for "Full former name(s). Obama put "None," when in fact he went by the name Barry Soetoro, and Barry Obama. It is further believed Obama has used the name Barry Dunham. Obama lied on the State government form that he signed under the penalty of perjury.
3. Even if Obama maintained his United States Citizenship, which he failed to do, he also carries citizenships in Kenya and Indonesia. Obama has divided loyalties with

foreign countries. Thus, Obama carries multiple citizenships and is ineligible to run for President of the United States. United States Constitution, Article II, Section 1.

1. All the efforts of supporters of legitimate citizens were for nothing because the Obama cheated his way into a fraudulent candidacy and cheated legitimately eligible natural born citizens from competing in a fair process and the supporters of their citizen choice for the nomination.
2. Voters donated money, goods and services to select a nominee, and were defrauded by Obama's obfuscations. Obama clearly shows consciousness of guilt by his actions by posting a forged birth certificate on his website, and by and the falsifications he told to cover his loss of citizenship.
3. Obama proclaims himself a Constitutional scholar and lecturer, but did not learn he had no eligibility to become President except by means of obfuscations and deceptions.
4. The injunctive relief must be granted because failing to do so, this inaction defrauds everyone who voted in the Democratic Primary for a nominee that is a fair representation of the voters. Failure to grant injunctive relief would allow a corrupted, fraudulent nomination process to continue.
5. It not only allows, but promotes an overwhelming degree of disrespect and creates such a lack of confidence in voters of the primary process itself, so that it would cement a prevailing belief that no potential candidate has to obey the laws of this country, respect our election process, follow the Constitution, or even suffer any consequence for lying and defrauding voters to get onto the ballot when they have no chance of serving if they fraudulently manage to get elected.
6. If declaratory and injunctive relief is not given, it would be extremely unfair to the country for candidates of either party to become the nominee when there is any question as to the nominee's eligibility to serve if elected.
7. As stated above, Plaintiff as well as Democratic American Citizens will suffer Irreparable Harm if Declaratory and Injunctive relief is not granted. Plaintiff does not have any other way of redress regarding these very significant and important issues.
8. The DNC has failed Plaintiff and the Democratic American Citizens by their failure to perform due diligence and inquire into Obama's eligibility to run for Office of the President.

COUNT ONE
>
VIOLATION OF THE UNITED STATES CONSTITUTION, ARTICLE II, SECTION I

1. >Plaintiff hereby incorporates Paragraphs 1 through 45 as if fully set forth herein.
1. >>The United States Constitution, Article II, Section I, Clause 4, Qualifications, Office of President, states: "No person except a natural born citizen, or a citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of
2. >thirty-five Years, and been fourteen Years a Resident within the United States."
2. >Obama's failure to maintain his United States Citizenship makes him ineligible to run for Office ofthe President.
3. >Obama, if born in Kenya would have made him a citizen of Kenya. Furthennore, because of the 1940 Naturalization Act, June 1952, Obama's mother would have had to be nineteen (19) in order for Obama to be a "natural born" United States citizenship upon registration of his birth. Obama's mother was only eighteen (18) when she birthed Obama and therefore was not old enough to meet the residency requirements under our laws at the time of Obama's birth and be able to register her son's birth as a "natural born" citizen.
4. >Even if Obama would have been able to be registered as a "natural born" citizen in Hawaii, he lost his citizenship in the United States when his mother married Lolo Soetoro, a citizen of Indonesia and then took Obama to Indonesia and set up residency with her new husband.
5. >Obama's mother could have regained her and Obama's United States Citizenship status when she divorced her husband, Lolo Soetoro and moved back to Hawaii. However, in order to regain her citizenship in the United States she would have had to take the oath of allegiance, which would have been recorded. Obama's mother never did take the oath of allegiance to regain her citizenship In the United States.
6. >Moreover, Obama could have regained his citizenship in the United States when he turned eighteen (18), again by taking the oath ofallegiance that would have been recorded. However, Obama failed to do so.
7. >The Democratic National Committee (DNC) is supposed to represent and protect the interests of working Americans, which includes securing a Democratic

Nominee on the Presidential Election ballot who represents the Democratic vision and who is qualified and eligible to run for Office of the President under the qualifications of the United States Constitution. The DNC has failed to inquire into Obama's eligibility status.

54. For the above aforementioned reasons, Obama needs to immediately supply a certified copy of his oath of allegiance proving he regained his United States Citizenship. In addition, Obama needs to furnish a certified copy of his Certificate of Live Birth to further prove he was born in Hawaii as he claims. However, if Obama is unable to supply a certified record of his oath of allegiance, he needs to immediately step down and withdrawal his candidacy for President.

WHEREFORE, Plaintiff respectfully prays that this Court:

A. Declare that Defendant Barack Hussein Obama, a/k/a Barry Obama, a/k/a Barry Soetoro, a/k/a Barack Soetoro, a/k/a Barry Dunham, a/k/a Barack Dunham is ineligible to run for United States Office ofthe President under the United States Constitution, Article II, Section I;

B. Preliminary and permanently enjoin Defendant Barack Hussein Obama, a/k/a Barry Obama, a/k/a Barry Soetoro, a/k/a Barack Soetoro, a/k/a Barry Dunham, a/k/a Barack Dunham from running for United States Office of the President;

C. Preliminary and permanently enjoin Defendant, The Democratic Committee from nominating Defendant Barack Hussein Obama, a/k/a Barry

COUNT TWO
>
DUAL CITIZENSHIP

1. Plaintiff hereby incorporates Paragraphs 1 through 54 as if fully set forth herein.
2. From the beginning of our Constitution, our forefathers inferred a person running for Office of the President could not have divided loyalties. This was a result of people coming from England to the United States who owed loyalties to both England and the United States. Our forefather's did not want a person with dual loyalties to be able to secure the position as President of the United States.
3. This inference is taken from Article II, Section I, which plainly states qualifications for Office of the President must be a "natural born" citizen.
4. The United States President cannot run our Country and have responsibilities and obligations owed to other countries.
5. Obama is not eligible to run for Office of the United States President as his mother failed to regain her citizenship after her divorce to Lolo Soetoro, a citizen of Indonesia, when Obama was a minor and Obama himself failed to regain his

United States Citizenship when he turned eighteen (18). Therefore, Obama is not

>a "natural born" citizen.

1. >Furthermore, Obama is well aware he is not a United States Citizen and does not qualify as a "natural born" citizen. Obama traveled to Pakistan in 1981, at which time he was twenty (20) years old and used his Indonesian Passport, not a United States Passport.
2. >The Democratic National Committee (DNC) is supposed to represent and protect the interests of working Americans, which includes securing a Democratic Nominee on the Presidential Election ballot who represents the Democratic vision and who is qualified and eligible to run for Office of the President under the qualifications of the United States Constitution. The DNC has failed to inquire into Obama's eligibility status.
3. >For the above aforementioned reasons, Obama needs to immediately step down and withdrawal his candidacy for Presidency.

WHEREFORE, PlaintitfrespectfuIly prays that this Court:

FRAUD

1. Plaintiff hereby incorporates Paragraphs 1 through 62 as if fully set forth herein.
2. Obama committed Fraud upon Plaintiff and the American Citizens by running for President claiming to be eligible knowing he was not eligible as a result of his failure to regain his United States Citizenship and by maintaining multi citizenships with Kenya and Indonesia.
3. Obama further committed Fraud upon Plaintiff and the American people by falsifying infonnation on his Illinois State Bar Registration and Public Disciplinary Record. Obama stated on his Application to the State Bar of Illinois, as proven by the Illinois State Bar Registration and Disciplinary Record, stating he never used any other names. Obama signed his

>knowing the information to be false. The fact of the matter is Obama used the

>name Barry Soetoro in Indonesia and was registered as a citizen of Indonesia on

1. >Obama attempted to defraud Plaintiff and the American people by allowing an altered and forged Hawaii Certificate of Live Birth (COLB) to be placed on his campaign website. Obama was well aware the Government issued COLB was altered and forged as the original document was in the name of Maya Kasandra Soetoro born in 1970. Maya Kassandra Soetoro Obama's half sister who was born in Indonesia and her birth was later registered in Hawaii. I agree. Plenty of hard fact issues to push. The 'Not a real American' angle is pie in the sky wishful thinking since it would immediately disqualify him and thow the Dems into a spin all but handing the election to McCain. There was a little bit there, enough to raise an eyebrow, but I seriously doubt it will play out to anything useful.

I thought this was all some stupid conspiracy theory crap. After a little investigating, I have to say that I am glad that Berg started the lawsuit. We, the American people, need to find out the truth, whether the man is or isn't eligible to run for the Presidency. If it all checks out, fine. But it does need to be checked out by the court. There are a few things that didn't ring true in reading Factcheck. For instance, this number 151 1961 - 010641, being crossed out and then stating that it isn't of any importance to the world. Document numbers reveal significant things. For instance, a document number does legally establish and verify dates. First, keep in mind: Senator Obama was the first Chairman of the Board of the Chicago Annenberg Challenge, which was a Division, or Project, of the Annenberg Foundation.
William (Bill) Ayers, unrepentant Weather Underground terrorist and a friend of the Obamas, was instrumental in founding the Challenge, thanks to his ties to Mayor Richard Daley. The first Daley was also a pal of Thomas Ayers, Bill’s father, former CEO of ComEd (owned by Exelon).

That is at least a conflict of interest issue.

Interesting, Aplomb ... thanks for that nugget. I've only ever judged FactCheck's credibility based on their actual articles, which have seemed to me to be rather non-partisan. If you look at their current list of items on their main page (and from other political races I've seen in the past) they generally take on all popular memes and give a pretty thorough (and I've felt, fair) look-over.

But, having links to the Annenberg Foundation is an extremely interesting thing ... probably why they had such good access to the Obama camp staff, getting to physically handle the document, etc. Of course, if you read their take, they say that the birth certificate is good enough to pass the State Dept.'s standards for getting a passport ... which makes sense since he just got back from his world rock tour.

On Aug. 21st attorney Philip J. Berg requested an injunction in Federal Court against the nomination of Barack Obama, citing evidence that candidate Barack Obama is not a US citizen, and "the obvious problems that will occur when the Republican Party raises these issues after Obama is nominated."


Berg argues that Barack Obama was born in Kenya in 1961 to an American woman, Stanley Ann Dunham, and a Kenyan man, Barack Hussein Obama Senior, as reportedly shown by a birth certificate from Mombasa Maternity Hospital. According to the law at that time, a parent could pass US citizenship on to a child born abroad if the parent was at least 19 years old. Obama's mother was only 18.


No hospital birth certificate has been produced to show Obama was born in Hawaii, only a certificate of birth registry after the fact, which forensics experts have denounced as a forgery.


Moreover, when Obama was six years old his mother remarried and moved with her husband to his country, Indonesia. Records indicate Obama was naturalized as an Indonesian citizen. Indonesia does not allow dual nationality, so even had he been born in Hawaii, he would have lost his citizenship then.


Even if Obama is able to provide a US birth certificate, a dozen more insurmountable scandals face this unelectable candidate, which the Republicans can hardly wait to unleash on him after he is nominated.


1. When Obama recently made an issue of the number of houses the McCains own, McCain shot back with much heavier artillery: Obama's friend Rezko is a convicted felon, sitting in jail. Obama is the candidate of Chicago corruption. His other cronies Auchi and Alsammare are also convicted felons who have stolen hundreds of millions from the Iraqi Provisional authority and from the government in Illinois. This has been detailed by investigative journalist Evelyn Pringle on opednews, and by Webster Tarpley in his forthcoming book, "Barack H. Obama: the Unauthorized Biography."


2. Obama has very close links to the convicted Weathermen terrorist bombers Bill Ayres and Bernardine Dohrn. He shared board memberships with Ayres on the Woods Fund and the Chicago Annenberg Challenge. This and most of the following scandals are detailed in Tarpley's "Obama - The Postmodern Coup: Making of a Manchurian Candidate," released in June.


3 Obama is very close to the racist demagogues Rev. Jeremiah Wright, Otis Moss III, Hopkins, Meeks, and Pfleger.


4 Obama has been accused in Federal Court of using crack cocaine by Larry Sinclair, along with gay sex. The Obama camp retaliated by arresting Sinclair in an enemies list operation by Beau Biden, son of veep candidate Joe Biden.


5. The mysterious deaths of black gays in and around Wright's Church: Donald Young, Nate Spencer, Larry Bland could be linked to Obama.


6. Obama's relations to Chechen Terrorism through Ilyas Achmadov.


7. His Relations to CIA-controlled Palestinian factions Khalidi and Abu Nimah.


8. The mysterious deaths of key Clinton delegates and floor leaders just before the convention: Bill Gwatney and Tubbs Jones.


9. The alleged Michelle Obama Hate Whitey tape.


10. Two mysterious envelopes sent to McCain HQ with powder in them raised questions of what Obama's fanatical supporters may be capable of.


Then of course there is the problem that Obama is a very weak candidate as regards appeal across the spectrum. In the primaries Obama was not able to carry any of the big Blue states that a Democrat has to win in the electoral college for the general election.


Obama is not able to appeal to the electorate on the issues, only on his personality. His attempt to appear populist fails since he is in fact the puppet of the right-wing Chicago School and revanchist Brzezinski faction. Instead of offering what the great majority of Americans want, peace abroad and fixing the economy at home, he will deliver increased austerity. The war in Georgia shows that the post-9/11 era has now ended with a new cold war against Russia, inspired by Obama's guru Brzezinski.


As Tarpley points out, Obama has never won a real election contest; his way has always been smoothed by engineered scandals.


But this time the scandals are set to go the other way.


The Democrat National Committee has to be certified insane if they nominate Obama. There is no way he can beat "war hero" McCain with a ton of dirty laundry like this around his neck.

And even that pales beside the blamage, the loss of face for the Democrats if they nominate a candidate who is not even a US citizen, thus giving the election by default to the Republicans. That could be the final blow to what is left of the two-party system as we know it.

Annenberg Papers: Putting On Ayers?

Election '08: The Obama camp tries to suppress a campaign ad and university archives linking the candidate to a '60s terrorist who hosted his first campaign fundraiser. Is he being "swiftboated," or is this a cover-up?


When Obama's association with William Ayers was raised at a Democratic debate this year, Obama replied: "This is a guy who lives in my neighborhood. . . . He's not somebody who I exchange ideas from on a regular basis."


Tuesday's release of papers from a Chicago school reform project known as the Annenberg Challenge shows once again Barack Obama has a problem with the truth.


The long-sought records that were kept under wraps at the Richard J. Daley Library at the University of Illinois, Chicago (UIC), show that Obama and Ayers attended board meetings, retreats and at least one news conference as the education project got under way. The records also show the two continued to attend meetings together during the 1995-2001 operation of the program.


Clearly the relationship between Ayers and Obama is much deeper and longer than Obama admits. They in fact were partners in various entities and regularly exchanged ideas, including on how to turn Chicago schools into re-education camps to create a generation of social revolutionaries.


Tuesday's release of the papers of the Chicago Annenberg Challenge were sought by the National Review's Stanley Kurtz, who had met a stone wall erected by Obama's UIC friends. UIC temporarily closed the supposedly public archives after Kurtz inquired.



Ayers, who has long taught there, may have had a hand in suppressing the documents showing Obama to be a liar.


The UIC records show that in the 1990s, Ayers was instrumental in starting the Annenberg Challenge, securing a $50 million grant to reform the Chicago Public Schools, part of a national initiative funded by Ambassador Walter Annenberg, who died in 2002.


Obama was given the Annenberg board chairmanship only months before his first run for office. He ran the fiscal arm that distributed grants to schools and raised matching funds. Ayers participated in a second entity known as the Chicago School Reform Collaborative, the operational arm that worked with grant recipients. They met and talked often.


When Obama first ran for office, articles in the Chicago Defender and the local Hyde Park Herald mentioned his Annenberg chairmanship among his qualifications.


During Obama's tenure as Annenberg chairman, Ayers' own education projects received substantial funding. As we've noted in our series, "The Audacity of Socialism," Ayers, now a tenured distinguished professor of education at UIC, works to educate teachers in socialist revolutionary ideology, urging that it be passed on to impressionable students.


One of Ayer's descriptions for a course called "Improving Learning Environments" says prospective K-12 teachers need to "be aware of the social and moral universe we inhabit and . . . be a teacher capable of hope and struggle, outrage and action, teaching for social justice and liberation."


The Annenberg papers are quite extensive — 132 boxes containing 947 file folders with 70 linear feet of material. They undoubtedly contain more surprises regarding Obama's relationship with Ayers, one of many relationships Obama has sought to hide.


Obama is actively trying to suppress a campaign ad by an independent group that notes Obama's long and intimate relationship with Ayers. The ad is put out by the conservative American Issues Project (AIP) and financed by Texas billionaire Harold Simmons.


Simmons was one of the main funders of Swift Boat Veterans for Truth. Democrats cry Obama is being "swift boated" and blame that examination of John Kerry for his loss, not his less than swift campaign.


The ad factually states: "Obama's political career was launched in Ayers' home. And the two served together on a left-wing board. Why would Barrack Obama be friends with someone who bombed the Capitol and is proud of it? Do you know enough to elect Barack Obama?"


We say not nearly enough. As columnist and political analyst Michael Barone points out, Obama has left no papers from his Illinois Senate days. Nor has he listed his law firm clients or provided more than one page of his medical records.


Obama has tried to distance himself from Ayers, his former campaign contributor and foundation colleague. When asked in the Pennsylvania debate if he could "explain that relationship for the voters and explain to Democrats why it won't be a problem?"



Obama's lame response was that "the notion that somehow, as a consequence of me knowing somebody who engaged in detestable acts 40 years ago when I was 8 years old somehow reflects on me and my values doesn't make much sense to me."


It makes sense to us. Ayers, a founder of the Weather Underground organization that bombed the U.S. Capitol and Pentagon four decades ago, wasn't just a passing acquaintance to Obama.


When Obama was making his first run for the Illinois Senate, Ayers and terrorist wife Bernadine Dohrn had Obama to his house for a 1995 campaign event. Ayers also served with Obama on the board of the Woods Fund of Chicago for three years and made a donation to the Friends of Barack Obama in 2001


The AIP ad has run about 150 times in markets in Pennsylvania, Ohio, Virginia and Michigan.


Obama campaign lawyer Robert Bauer has warned station managers suggesting their broadcast license might be at risk: "Your station is committed to operating in the public interest, an objective that cannot be satisfied by accepting for compensation material of such malicious falsity."


Bauer has also written twice to the Justice Department demanding "prompt action to investigate and to prosecute" Simmons and AIP for violation of campaign laws and individual contribution limits. The problem is that, as the Annenberg papers show, the ad is breathtakingly true and accurate.


The only thing needing investigating is why Obama is trying so hard to hide his past.

Motion denied in Obama lawsuit

PHILADELPHIA - A Lafayette Hill lawyer who filed a legal challenge to Sen. Barack Obama's presidential candidacy claiming he doesn't meet U.S. residency requirements had a motion for a temporary restraining order denied Friday.

A day earlier, Philip Berg filed a motion for a temporary restraining order in federal court in Philadelphia questioning the authenticity of Obama's Hawaii birth certificate and claiming the Illinois senator was actually born in Kenya, according to court papers.

Though the motion was denied, Berg said he was encouraged that Judge R. Barclay Surrick did not dismiss the lawsuit. The litigation also sought "expedited discovery."

"We're still waiting to serve the senator," Berg said in a telephone interview Wednesday.

Discovery would include examining the candidate's birth certificate and adoption papers, among other documents, Berg said.

Besides Obama, the Democratic National Committee (DNC) and Federal Election Commission (FEC) are also named as defendants.

In the motion's supporting memorandum, Berg charges that the DNC failed to verify Obama's eligibility to run for president.

In order to be eligible, presidential candidates are required to be "natural born" citizens and may not hold dual or multiple citizenship from foreign countries, according the suit's legal memorandum.

According to Obama's birth certificate, which his campaign posted on its Internet site in June to quell rumors, the senator was born in Hawaii on Aug. 6, 1961.

The lawsuit, however, questions the Democratic candidate's claim that he was born in a Honolulu hospital.

The candidate's late father, Barack Obama Sr., was a native of Kenya, and Berg claims the 47-year-old presumptive presidential candidate's Kenyan relatives say he was born in the African country.

Obama's mother, Ann Dunham, grew up in Kansas, and his parents met at the University of Hawaii when Dunham was a student there, according to the Obama campaign.

Eventually, Obama's father returned to Kenya, and his son grew up in Hawaii with his mother and for a few years in Indonesia after Dunham married an Indonesian man, Lolo Soetoro. As well, Obama lived with his maternal grandparents in Hawaii.

Dunham reportedly traveled to Kenya during her pregnancy, and she was prevented from boarding an airline flight from Kenya to Hawaii because of the late stage of her pregnancy, the lawsuit alleges. She reportedly gave birth to Obama in Kenya, then flew home to Hawaii and registered his birth there.

Under U.S. law at the time of the Illinois lawmaker's birth, if he had been born abroad, and one parent was a U.S. citizen, his mother would have had to live 10 years in the U.S., five of which after she reached 14 (years of age), according to court papers.

However, Dunham was only 18 years old when she gave birth to her son, not 19, Berg says, and Obama therefore would not have met U.S. citizenship requirements.

Berg concludes that the Democratic candidate is a Kenyan citizen. And because he never renounced his Kenyan citizenship, he is ineligible to run for president.

Berg's office has not received confirmation that Obama's campaign has received the legal complaint, but he feels certain the campaign has heard about it.

"Six days later (after the suit was filed), there's not been one word from his campaign, which tells me I'm on the right track," he said.

The 64-year-old Whitemarsh attorney has been fielding phone calls almost nonstop after word got out about the legal action.

On Friday, Judge Surrick denied Berg's emergency request, Berg said, because Obama had not yet been served with the legal complaint and a summons.

The U.S. Attorney's Office of the Eastern District of Pennsylvania accepted service of the suit on behalf of the DNC and FEC, according to Berg's office.

Once the senator is served, Berg will be able to move the suit forward in court. The case is still "very alive and active," according to an e-mail message from his office.

The lawyer plans to file another motion for a temporary restraining order once Obama has been served.

The Democratic National Committee could not be reached for comment Wednesday.
Mary Brandenberger, a spokeswoman for the Federal Election Commission, knew about
the suit, but said the FEC could not comment on any ongoing litigation.

I found last night's speech by Barak Obama to be interesting and at the same time infuriating. I think it's dangerous the way Democratic candidates can say or do whatever they wish, to make broad or outrageous statements with little or no recourse and stand behind the right to 'free speech'. however, when other voice their opinion, when others invoke and make use of their own right to speech and publicly voice opposition to Democratic ideals, ideas or candidates, or question their actions or connections, its suddenly no longer free speech but has become 'terrorist slanders' and various other multitude of petty name-calling and insults.

I am writing to urge you to SUPPORT Stanley Kurtz, and to keep him on the air to voice HIS right to free speech, the same as any Liberal Democrat would have, because i beleive in America BOTH SIDES deserve the right to have their voices heard, whether one side or the other does or does not like the message. Its the great debate, the exchange of ideas, and if Mr Obama doesnt like what comes out, he has the right and the ability to challenge the facts, instead of resorting to petty name calling, or worse.

By or worse, i mean putting pressure on YOU to remove Mr Kurz in an effort to silence dissent, hide inconvenient facts to benefit himself politically. This is AMERICA with the US Constitution still in full force. Mr Obama ought to propose an amendment to remove free speech from it, if he doesnt want to hear what other people have to say about him. If he wants to stand on a podium as a political figure, this is part of the price he must pay, as every political figure does.

Silencing Dissent is Un-American, and i urge you to stand up for what is right. Tell the Obama supporters and Mr Obama himself he is welcome to refute Mr Kurz in any way he wants but it is not acceptable to try the unamerican way of dealing with things, to try to silence dissent. Obama's Years at Columbia Are a Mystery

He Graduated Without Honors

Senator Obama's life story, from his humble roots, to his rise to Harvard Law School, to his passion as a community organizer in Chicago, has been at the center of his presidential campaign. But one chapter of the tale remains a blank — his education at Columbia College, a place he rarely speaks about and where few people seem to remember him.

Contributing to the mystery is the fact that nobody knows just how well Mr. Obama, unlike Senator McCain and most other major candidates for the past two elections, performed as a student.

The Obama campaign has refused to release his college transcript, despite an academic career that led him to Harvard Law School and, later, to a lecturing position at the University of Chicago. The shroud surrounding his experience at Columbia contrasts with that of other major party nominees since 2000, all whom have eventually released information about their college performance or seen it leaked to the public.

For better or worse, voters have taken an interest in candidates' grades since 1999, when the New Yorker published President Bush's transcript at Yale and disclosed that he was a C student. Mr. Bush had never portrayed himself as a brain, but many were surprised to learn the next year that his opponent, Vice President Gore, did not do much better at Harvard despite his intellectual image. When Senator Kerry's transcript surfaced, reporters found that he actually had a slightly lower average at Yale than Mr. Bush did.

Some political observers cite such disclosures as proof that candidates' intelligence cannot be judged solely by their political careers or the schools they attended. Grades provide a rare measure of intellect that is immune to political spin, proponents say.

"We like to pretend IQ doesn't matter, but it really does with a lot of jobs, including the presidency," a professor at Smith College who studies the effects of human intelligence on the economy, James Miller, said. "We can't trust the information that candidates give us, so it's important to look for objective data that they can't falsify or distort."

Mr. Miller acknowledged that Mr. Obama displayed academic achievement at Harvard, where he graduated magna cum laude and led the Harvard Law Review. Still, Mr. Miller said, he would like to see information about how Mr. Obama performed in various subjects at Columbia.

That view is not shared by other election observers, including some who have themselves indulged the public's interest in candidates' academic records. One of them is Geoffrey Kabaservice, a political historian who in 2000 published Senator Bradley's relatively low score of 485 on the verbal SAT. Mr. Bradley, a Rhodes Scholar who was a star basketball player at Princeton, was running for the Democratic presidential nomination.

"It's awfully hard to correlate anything, really, about a person on the basis of their grades," Mr. Kabaservice said, explaining that he published Mr. Bradley's score to highlight limitations in intelligence testing. He said he doubted that candidates' grades have affected the outcome of any recent presidential elections.

"For people who didn't like George W. Bush, for example, the grade aspect only confirmed what they thought about him," Mr. Kabaservice said. "And for everybody else, it made him more of a regular guy."

The Obama campaign declined to comment for this article and did not offer an explanation for why his transcript has not been released. But observers speculated that one reason might be the racially charged nature of the election. Mr. Obama has acknowledged benefiting from affirmative action in the past, and details about his academic performance might open him up to critics eager to accuse him, probably unfairly, of receiving a free ride, Mr. Kabaservice said.

"Anyone who is a minority and who's come up partially through the meritocracy — getting into good colleges, and subsequently good law schools — is going to come under suspicion that there was some kind of affirmative action boost," he said. "I suspect this is an area of discomfort for Obama."

In contrast with the rest of Mr. Obama's life story, little is known about his college experience. He attended Occidental College in Los Angeles for two years before transferring to Columbia in 1981. The move receives only a mention in Mr. Obama's 1995 memoir, "Dreams from My Father," which instead devotes that chapter to his impressions of race and class struggles in New York.

An article in a Columbia University publication, Columbia College Today, reported that Mr. Obama has portrayed Columbia as a period of buckling down following a troubled adolescence. He did not socialize much, he has said, instead spending a lot of time in the library, "like a monk." He has also stated that he was involved to some extent with the Black Students Organization.

Federal law limits the information that Columbia can release about Mr. Obama's time there. A spokesman for the university, Brian Connolly, confirmed that Mr. Obama spent two years at Columbia College and graduated in 1983 with a major in political science. He did not receive honors, Mr. Connolly said, though specific information on his grades is sealed. A program from the 1983 graduation ceremony lists him as a graduate.

More is known about Mr. McCain's experience at the United States Naval Academy, where he was a self-described troublemaker and graduated in the bottom 1% of his class. The McCain campaign has declined to release his transcript, saying that his performance at the academy can only be viewed in the context of his larger military career.

"His record stands on its own," a McCain spokesman, Peter Feldman, said. "His time spent in college was part of the transformative years that made him who he was."

3 October 2008 To discredit the merits of the lawsuit and have it summarily dismissed, all Barack Hussein Obama (a/k/a Barry SOETORO)has to do is provide a legitimate copy of his birth certificate. The lawsuit was filed by Philadelphia lawyer Phillip Berg in late August.
Instead, Obama has opted to fight the lawsuit as illustrated in the federal court documents which can be viewed online HERE.
As they say, however, the devil is in the details...
First, it is notable that Barack Hussein Obama retained Washington lawyer Joseph SANDLER of the Washington law firm Sandler, Reiff, and Young to fight the lawsuit. Who is Joseph SANDLER? He is a lawyer who has represented CAIR - the Council on American Islamic Relations and MoveOn.org.
Last week, Obama and the Democratic National Committee filed a Motion to Dismiss the lawsuit. On Monday, Attorney berg filed a response to that motion, requesting (1) that the suit not be dismissed, and (2) that the Court order the production of documents that would validate Obama's constitutional qualifications as a legitimate candidate for president.
As mentioned - the devil is in the details - well beyond the obvious (the obvious being a CAIR lawyer responding on behalf of Obama).
Over the last few days, there have been relentless Internet rumors that the court has dismissed the Berg lawsuit. As of this writing, that is untrue, and Attorney Berg claims that he is confident that the defendant's Motion to Dismiss will be defeated.
Based on information I obtained confidentially from sources close to this case within the last 48 hours, it appears that the court will, in fact, dismiss this complaint. Unfortunately, the dismissal will be based on a series of obscure technicalities and citations, thus setting the stage for a larger constitutional crisis in the months ahead.
Count on it.
