    The BYPASS Congress Amnesty Memo

    According to an internal U.S. Citizenship and Immigration Services memo going the rounds of Capitol Hill and obtained by National Review, the agency is considering ways in which it could enact “meaningful immigration reform absent legislative action” — that is, without the consent of the American people through a vote in Congress.

    “This memorandum offers administrative relief options to . . . reduce the threat of removal for certain individuals present in the United States without authorization,” it reads.


    Also: “In the absence of Comprehensive Immigration Reform, USCIS can extend benefits and/or protections to many individuals and groups by issuing new guidance and regulations, exercising discretion with regard to parole-in-place, deferred action and the issuance of Notices to Appear (NTA), and adopting significant process improvements.”


    In recent weeks, Sen. Chuck Grassley and others in Congress have been pressing the administration to disavow rumors that a de facto amnesty is in the works, including in a letter to Department of Homeland Security head Janet Napolitano. “Since the senators first wrote to the president more than a month ago, we have not been reassured that the plans are just rumors, and we have every reason to believe that the memo is legitimate,” a Grassley spokesman tells NR. (NR contacted DHS, but a spokesman did not have a comment on the record.)


    Many of the memo’s proposals are technical and fine-grained; for example, it suggests clarifying the immigration laws for “unaccompanied minors, and for victims of human trafficking, domestic violence, and other criminal activities.” It also proposes extending the “grace period” H-1B visa holders have between the expiration of their visa and the date they’re expected to leave the country.


    With other ideas, however, USCIS is aiming big. Perhaps the most egregious suggestion is to “Increase the Use of Deferred Action.” “Deferred action,” as the memo defines it, “is an exercise of prosecutorial discretion not to pursue removal from the U.S. of a particular individual for a specific period of time.” For example, after Hurricane Katrina, the government decided not to remove illegal immigrants who’d been affected by the disaster.


    The memo claims that there are no limits to USCIS’s ability to use deferred action, but warns that using this power indiscriminately would be “controversial, not to mention expensive.” The memo suggests using deferred action to exempt “particular groups” from removal — such as the illegal-immigrant high-school graduates who would fall under the DREAM Act (a measure that has been shot down repeatedly in Congress). The memo claims that the DREAM Act would cover “an estimated 50,000” individuals, though as many as 65,000 illegal immigrants graduate high school every year in the U.S.


    In the immediate wake of the court decision blocking the Arizona immigration law yesterday, the memo is sure to create controversy — and the sense that the administration is bent on preserving and extending the nation’s de facto amnesty.

    Well, it looks like a Federal Judge put the smack down on Arizona’s fancy new Immigration law, thus the wingnuts have gone loco on the internet. One fun thing is the return of this lovely email forward, which has mutated slightly since the last time I saw it. Sort of like the flu!
    If you cross the North Korean border illegally you get 12 years hard labor.
    If you cross the Iranian border illegally you are detained indefinitely.
    If you cross the Afghan border illegally, you get shot.
    If you cross the Saudi Arabian border illegally you will be jailed.
    If you cross the Chinese border illegally you may never be heard from again.
    If you cross the Venezuelan border illegally you will be branded a spy and your fate will be sealed.
    If you cross the Mexican borders illegally you will jailed for two years.
    If you cross the Cuban border illegally you will be thrown into political prison to rot.
    If you cross the United States border illegally you get:
    1 – A job
    2 – A driver’s license
    3 – A Social Security card
    4 – Welfare
    5 – Food stamps
    6 – Credit cards
    7 – Subsidized rent or a loan to buy a house
    8 – Free education
    9 – Free health care
    10 – A lobbyist in Washington
    11 – Billions of dollars in public documents printed in your language
    12 – Millions of servicemen and women who are willing to – and do – die
    for your right to the ways and means of our @#$%—-ution
    13 – And the right to carry the flag of your country – the one you walked
    out on – while you call America racist and protest that you don’t get
    enough respect.
    My favorite part is how this version somehow can’t bring itself to type out Constitution and instead goes with @#$%—-ution. What the frak is that?
    Oh, and you don’t get those things in America for being illegal.

    Now, the lovely subtext of this email forward is that the author seems to think that all the so called “evil” countries doing horrible things to people is something to admire. So let’s be more like North Korea, America!

    NEW YORK - Two men carrying Mexican flags ran into the outfield during the seventh inning of the New York Mets' game against the Arizona Diamondbacks on Friday night at Citi Field.

    The men were apprehended by security fairly quickly without much incident.

    Before the game, about 40 demonstrators across the street from the ballpark protested Arizona's immigration law, chanting "Oppose racism!" and "Boycott Arizona!"

    Others stationed closer to the subway exit handed out leaflets that requested Major League Baseball move next year's All-Star game out of Phoenix.

    "It's not going to distract me. I'm here to play baseball," Diamondbacks interim manager Kirk Gibson said after his team's 9-6 victory over the Mets.

    "You have an opinion, I have an opinion. They have the right to say what they want, but it's no distraction."

    Judicial activism is pushing America to the breaking point. This week, a federal judge blocked key provisions of Arizona's immigration law, thwarting the will of the people. The decision was ominous and will reverberate for years to come.

    Judge Susan Bolton, appointed by former President Bill Clinton, is a liberal elitist who believes judicial imperialism trumps democracy. Her ruling states that local police cannot check the immigration status of people arrested or stopped for violations of the law. In her view, that would amount to an abuse of civil liberties and unduly burden the federal immigration system. She also stipulated that residents cannot be required to carry proof of legal status.

    Obama: "Patchwork" Immigration Reform Won't Work

    President Says He Understands Frustration over Hot-Button Issue, but Says Reform Isn't Responsibility of Local Authorities

    (CBS) President Barack Obama said he understands frustration over the hot-button issue of illegal immigration, but warned against local authorities' "patchwork" attempts to enact reform on their own.

    "I understand the frustration of people in Arizona. But what we can't do is demagogue the issue," Mr. Obama told "Early Show" co-anchor Harry Smith in an exclusive interview. "And what we can't do is allow a patchwork of 50 different states, or cities or localities, where anybody who wants to make a name for themselves suddenly says, 'I'm gonna be anti-immigrant and I'm gonna try to see if I can solve the problem ourself.'"

    Last week, U.S. District Judge Susan Bolton temporarily halted controversial portions of Arizona's newly enacted immigration law, including the requirements for police officers to check a person's immigration status while enforcing other laws and for immigrants to carry their papers at all times.

    The ruling sets up a lengthy legal battle that may end up in the Supreme Court.

    While the Obama administration filed a legal challenge to the law, Mr. Obama still acknowledged the "mission of controlling our immigration processes are absolutely correct. And that's why my administration's actually put more resources on the border to the point where we now have more of everything - border patrols. More over flights and, you know, more immigration agents. You name it, we've got more of them.

    Mr. Obama also said he wants to "work with Arizona" on the issue.

    'Tea party' groups plan Arizona rally against illegal immigration

    "Tea party" groups are planning a large rally on Sunday in Arizona, near the Mexican border, to support both the state's hard-line stance on illegal immigration and the political campaign of the local talk show host who is challenging Sen. John McCain (R-Ariz.).

    Candidate J.D. Hayworth, a former congressman turned conservative radio commentator, is one of dozens of scheduled speakers for the morning rally on a remote ranch about 100 miles south of Tucson.

    Others include Sharron Angle, the Republican challenging Senate Majority Leader Harry M. Reid (D) in Nevada, and Sue Krentz, the wife of a rancher killed near the rally site. The unsolved shooting death of Rob Krentz, who had spoken out on the problem of illegal immigration, prompted the state legislature to pass a law this year empowering police to question people if there is a "reasonable suspicion" they are illegal immigrants.

    A federal judge blocked some of the law's most controversial aspects last month after the Justice Department challenged it in court.
    "We're trying to stand behind Governor [Jan] Brewer while the federal government is proceeding with its lawsuit challenging Arizona's right to protect its own borders," said Tim Selaty Sr., vice president of a tea party group called United We Stand for Americans.

    Selaty said the group timed the rally to have maximum impact on Arizona's Aug. 24 Republican primary. Hayworth, a hard-liner on illegal immigration, is challenging McCain, who until recently had been a strong voice for creating a path to citizenship for those in the country illegally.

    Hayworth, who lags significantly behind McCain in the polls, has hammered the Arizona senator on his past support of what Hayworth calls amnesty. McCain has recently toughened his stance. Last week, he joined the chorus of Republican lawmakers who said they may be open to changing the country's longstanding policy of granting automatic citizenship to anyone born on U.S. soil. They say the policy, established in the Constitution's 14th Amendment, is a magnet for illegal immigrants seeking the benefits of a U.S. passport for their children.

    Although tea party groups have long argued for harsher penalties against illegal border crossers, this will be the first large-scale rally on the U.S.-Mexican border, Selaty said. Some participants say it could be as large as the one held in March in Reid's home town of Searchlight, Nev., when thousands joined former Alaska governor Sarah Palin to oppose Reid and protest the health-care overhaul.

    Organizers hope the rally will also draw attention to porous sections of the border, which they say have become magnets for smugglers and drug traffickers.

    Though some of the border has the 13-foot-high barriers favored by those who support stronger protections, some stretches have less-imposing vehicle walls and some areas have no fence.

    The event will take place on the private property of a local rancher, so counterprotesters will not be permitted. Security will be provided by the U.S. Border Patrol, two sheriff's offices and the rancher's personal security force, Selaty said. Attendees will not be barred from bringing firearms, but organizers are asking that they leave their long arms and rifles in their cars.

    Illegal immigrants flocking to 3 states to obtain identification

    BURIEN, Wash. - Carlos Hernandez packed up his family and left Arizona after the state passed its sweeping immigration crackdown. The illegal immigrant's new home outside Seattle offered something Arizona could not: a driver's license.

    Three states - Washington, New Mexico and Utah - allow illegal immigrants to get licenses because their laws do not require proof of citizenship or legal residency. An Associated Press analysis found that those states have seen a surge in immigrants seeking IDs in recent months, a trend experts attribute to crackdowns on illegal immigration in Arizona and elsewhere.

    "It's difficult being undocumented and not having an identification," said Hernandez, of Puebla, Mexico. "You can use the Mexican ID, but people look down on it."

    An American driver's license is also a requirement for many jobs.

    The immigration debate has thrown a spotlight on the license programs, which supporters say make financial sense because unlicensed drivers typically do not carry car insurance. Opponents insist the laws attract illegal immigrants and criminals.

    "Washington state and New Mexico have been magnet states for the fraudulent-document brokers, human traffickers and alien smugglers for years," said Brian Zimmer, president of the Coalition for a Secure Driver's License, a non-profit research group in Washington, D.C.
    State officials in New Mexico dispute that claim.

    Zimmer said there is mounting evidence that the spike in license applications is a result of pressure on immigrants in states such as Arizona and Oklahoma, where police have been authorized to help enforce federal immigration laws.

    Republican lawmakers in New Mexico and Washington state have pushed to tighten the laws in recent years, only to be thwarted by Democrats. The issue is less heated in Utah, where illegal-immigrant licenses carry only driving privileges. People cannot use the IDs to board a plane, get a job or buy alcohol, for example.

    Candidates in New Mexico's governor race have made the licenses a campaign theme, with the Republican saying she would revoke IDs granted to illegal and legal immigrants since the state enacted the law in 2003. The Democratic candidate opposes illegal-immigrant licenses but prefers a softer approach.

    The AP analysis of data in the three states revealed some striking numbers: The rate of licenses issued to immigrants during the 10 weeks that followed approval of Arizona's Senate Bill 1070 reflected a 60 percent increase over the annual average for last year.

    By comparison, the rate of licenses issued to non-immigrants during the same period increased only modestly.

    Among the other findings:

    • New Mexico issued 10,257 licenses to immigrants through the first six months of 2010, compared with 13,481 for all of 2009. The pace has intensified since April, when neighboring Arizona signed SB 1070 into law. The figures include both illegal immigrants and legal residents from outside the U.S.

    • New Mexico issued about 417 licenses a week to immigrants from the day after Arizona enacted SB 1070 through July 1. That is a big jump from the 323 per week it was issuing from Jan. 1 to the day before the law was signed.

    • Utah handed out 41,000 illegal-immigrant licenses for 2010 through June 7, compared with 43,429 for all of 2008. Utah did not provide data for 2009.

    • Washington granted 3,200 licenses to people from outside the U.S. through June, exceeding the pace of 5,992 for all of 2009.

    Hernandez said he and his family moved to Washington because he and his wife were spooked by SB 1070, which states that an officer engaged in a lawful stop, detention or arrest shall, when practicable, ask about a person's legal status when reasonable suspicion exists that the person is in the U.S. illegally. A federal judge has put most of the law on hold, saying it may be unconstitutional.

    Hernandez said he knows other illegal immigrants who considered New Mexico because of the ease of getting a license. But he and others thought Washington would be safer.

    "I know that it's not OK for people who come here to cross the border, but there's people that come here that want to contribute ... that want to follow the rules," said Hernandez, 31, who has a 2-year-old daughter.

    Recent fraud cases in New Mexico and Washington show some people try to exploit the rules.

    An Illinois man is accused of driving two Polish immigrants from Chicago to Albuquerque last month in a scheme to charge them $1,000 each for help getting driver's licenses, according to a criminal complaint.

    Officials suspect Jaroslaw Kowalczyk of Des Plaines, Ill., of running an ad in a Polish newspaper boasting, "Social security not necessary. 100 percent guarantee."

    In Washington, the FBI was tipped that people from across the country were coming to the state because of its license law. Three people, including one current and one former state Licensing Department employee, were arrested in June in a case dealing with the sale of identification documents to illegal immigrants.

    "We don't think we're asking for much," said Rep. Tom Campbell, sponsor of a bill last year in Washington seeking to require proof of citizenship to get a license. "We have to have a handle of who's in our state."

    In New Mexico, Michael Sandoval, director of the Motor Vehicle Division, cautioned that it's impossible to identify any specific cause-and-effect linking SB 1070 to illegal immigrants relocating in New Mexico because of the way the licenses are issued.

    The state does not require clerks to document where immigrants moved from. And clerks cannot ask if someone is in the country illegally.

    As a result, there's no way to tell between a license issued to a Swiss chemist employed with a visa at Los Alamos National Laboratory and a license for a Mexican laborer in the U.S. illegally.

    David Ayala, a Washington state immigrant advocate, said it's better for drivers to have licenses, especially for public safety. "The people who are driving in the streets need to be tested that they have the knowledge and ability to be on the highway," said Ayala, organizing director of a group called OneAmerica.

    Obama Administration may sue Arizona's Sheriff Arpaio for not cooperating in investigation

    A federal investigation of a controversial Arizona sheriff known for tough immigration enforcement has intensified in recent days, escalating the conflict between the Obama administration and officials in the border state.

    Justice Department officials in Washington have issued a rare threat to sue Maricopa County Sheriff Joe Arpaio if he does not cooperate with their investigation of whether he discriminates against Hispanics.

    The civil rights inquiry is one of two that target the man who calls himself "America's toughest sheriff." A federal grand jury in Phoenix is examining whether Arpaio has used his power to investigate and intimidate political opponents and whether his office misappropriated government money, sources said.

    The standoff comes just weeks after the Justice Department sued Arizona and Gov. Jan Brewer (R) because of the state's new immigration law, heightening tensions over the issue ahead of November's midterm elections. The renewed debate has focused attention on Arpaio, a former D.C. police officer who runs a 3,800-employee department, and a state at the epicenter of the controversy over the nation's estimated 12 million illegal immigrants.

    Once seen as a quirky figure who has inmates dress in pink underwear and forces them to work on chain gangs, Arpaio has in recent years become a kind of folk hero to those who favor his heavily publicized "crime sweeps," conducted mostly in Hispanic neighborhoods.

    But civil rights groups accuse the 78-year-old lawman of racial profiling.

    And some Maricopa County officials say Arpaio has begun meritless corruption investigations of officials who have criticized his policies or opposed his requests.

    Those allegations are at the core of the Justice Department investigations, according to documents, lawyers familiar with the inquiries, and people who have been questioned by FBI agents and the grand jury.

    The investigations reflect the tangled politics surrounding the immigration debate. The criminal probe is led by Dennis K. Burke, the U.S. attorney in Phoenix who was a top aide to Homeland Security Secretary Janet Napolitano.

    Two of Arpaio's attorneys, Robert N. Driscoll and Asheesh Agarwal, were officials in the Justice Department's civil rights division in the George W. Bush administration. They denied that the sheriff, a Republican who has been reelected four times since 1992, has been uncooperative or has engaged in racial profiling, misusing money or targeting political enemies.

    "The sheriff's office is cooperating fully with the grand jury investigation and has complete confidence that the inquiry will clear it of any wrongdoing," Agarwal said. "The office has always fulfilled its responsibilities truthfully, honorably, and in full compliance with state and federal law."

    Arpaio's attorneys contend that the investigations are politically motivated, citing a news conference in March at which Attorney General Eric H. Holder Jr. was quoted as saying he expects the inquiries to "produce results."

    "While we have no quarrel with the assistant U.S. attorneys handling the investigation, the attorney general's comments appear to violate federal regulations, departmental policy and state ethical rules designed to ensure the fairness of criminal investigations," Agarwal said.

    Brewer and her supporters have also asserted that the Justice Department was politically motivated in its lawsuit over the state law, which authorizes, among other things, police officers to ask about the status of people suspected of being in the country illegally. A federal judge last month stopped the most controversial sections of the legislation from taking effect.

    Justice Department officials denied any political considerations, saying the investigations and the lawsuit are based on the facts and the law.

    They declined to comment on details of the Arpaio inquiries.

    The civil rights division's investigation began in March 2009 and focuses on whether Arpaio's department engaged in "discriminatory police practices and unconstitutional searches and seizures," along with allegations that his jail discriminated against Hispanic inmates, according to letters the division sent to Arpaio. A complaint to the Justice Department said that even bilingual jail guards are required to speak to inmates only in English and that the rule could endanger prisoners' medical care. The jail was also accused of forcing Hispanic visitors to fill out a "citizenship check" form, the letters said.

    Lawyers in the division have repeatedly interviewed Phoenix area human rights leaders about Arpaio's immigration sweeps, and local "cop watch" groups have turned over hours of video footage of the sweeps to investigators.

    "Their questions are in regards to racial profiling, questions about what are the practices when people get stopped," said Salvador Reza, an organizer with the Puente human rights movement who has met with Justice Department lawyers. He said the lawyers have asked about the treatment of inmates in Arpaio's jail.

    In an Aug. 3 letter to Arpaio's attorneys, Thomas E. Perez, assistant attorney general for the civil rights division, said the sheriff's office had declined repeated requests to turn over documents and meet with investigators. Without cooperation by Tuesday, the letter said, the government would file suit "to compel access to the requested documents, facilities and personnel."

    In his Aug. 5 reply, Driscoll accused the Justice Department of "a desperate attempt" to compel cooperation and of "a public relations campaign against Sheriff Arpaio." He added: "DOJ cannot require the reproduction of millions of pages of documents so DOJ can 'see what it can find.' "

    Arpaio's resistance is highly unusual: Justice Department officials said the threat of such a lawsuit is rare. They added that they plan to meet with the sheriff's attorneys next week in a last-ditch effort to forestall litigation. If the department files a broader civil lawsuit, it could result in the department terminating the several million dollars in grants to Arpaio's office each year or in a judge's order forcing him to change his policies.

    On a separate track, the grand jury investigation has been underway since at least January. Lawyers familiar with the inquiry and witnesses said it is focused on allegations that as Arpaio has fought with the county board over his budget and other issues, he and his deputies have retaliated by carrying out at least seven criminal investigations of county officials alleging corruption, fraud and other crimes.

    Some legal experts say it could be difficult for such allegations to result in criminal charges. "I don't know what a charge would be," said Peter Zeidenberg, a former Justice Department public corruption prosecutor.

    "We all would agree that being abusive is wrong, but I'm not aware of any federal statute that would fit."

    In one case, Arpaio leveled 40 corruption-related charges against a county supervisor who had spoken out against his policies, all of which a judge dismissed. In another, the sheriff's allies in the county attorney's office filed more than 100 criminal counts against another supervisor for improperly filling out required financial disclosure forms. Several days after a judge dismissed most of those, Arpaio's deputies arrested the supervisor in a parking garage and walked him before TV cameras to jail, announcing more than 100 new charges, which a judge dismissed.

    (Some of the original charges remain on appeal.)

    "They'll never stop," said Deputy County Manager Sandi Wilson, who was named in one of Arpaio's investigations. Wilson testified before the grand jury and has spoken to FBI investigators more than a dozen times, as recently as last week. "They don't care who tells them to stop."

    County Manager David Smith said grand jurors also questioned him about deputies' trips to conferences and training missions in Las Vegas, Honduras and other destinations, where he said they often stayed at "boutique" hotels. He said prosecutors were focusing on "issues that might involve the crime of extortion over the county budget, misappropriation of funds and abuse of police power."

    State banishes teaching school students 'overthrow of United States government'

    The superintendent of the Arizona Department of Public Education says his agency will consider a refusal by the school district in Tucson to videotape its "Raza studies" classes as evidence the district is "deliberately" concealing its agenda.

    The state had asked Tucson, in view of a new state law that takes effect at the end of this year that bans promoting to students "the overthrow of the United States government" and other issues, to record its "Raza" classes this fall to document what is being taught.
    No, said Tucson officials.

    So the state, which starting Jan. 1 can withhold 10 percent of the district's state funding, confirmed it would cite that refusal when the dispute comes up for judicial review.

    When the funds are withheld, said a state letter to the district, "You will have the right to appeal to an administrative law judge. If you agree to this videotape, it will be helpful evidence to the administrative law judge. If you refuse, we will offer that refusal as evidence to the administrative law judge that the school district has deliberately hidden facts that would show that the district is in non-compliance with H.B. 2281."

    The new law was adopted this year by the legislature and signed into law by Gov. Jan Brewer. But it largely has been overshadowed by the international furor over the state's plan to make illegal under state law what already is illegal under federal law – being in the state without permission.

    The law, S.B. 1070, now is under consideration by possibly dozens of other states even as its enforcement in Arizona has been suspended by a federal judge pending a trial over its constitutionality.



    S.B. 1070 even attracted the criticism of Mexican authorities, who decried that it would crack down on illegal aliens in Arizona. However, Eagle Forum founder Phyllis Schlafly said the crackdown on illegals "may not be the most controversial Arizona law about illegal aliens."

    The additional law, Schlafly wrote, "bans classes that 'promote the overthrow of the United States government' or 'promote resentment toward a race or class of people' because schools should treat all pupils as individual Americans."

    She explained the issue arose because the Tucson School District offers courses in "Mexican-American studies (known locally as Raza Studies) that focus on that particular group and its influence."

    "The law doesn't prohibit these classes so long as they are open to all students and don't promote ethnic resentment or solidarity," she explained. "However, Arizona's Superintendent of Public Instruction, Tom Horne, says the basic theme of the Mexican-American studies program is that Latino students 'were and continue to be victims of a racist American society driven by the interests of middle- and upper-class whites.'"

    The district's goals for its Mexican-American Studies include "social justice" along with "Latino Critical Race Pedagogy," and Schlafly reported pictures of the classroom walls revealed "heroes" such as Che Guevara and Fidel Castro.



    Horne, who also is running for attorney general, and Deputy Superintendent Margaret Dugan had asked Tucson to videotape its "so-called 'ethnic studies' classes during the upcoming fall semester to provide important evidence as to whether those courses are in violation of H.B. 2281."

    The school district, however, sent WND a copy of a letter it dispatched to Horne refusing his request. Tucson Superintendent John Carroll cited his decision that the taping "would unnecessarily disrupt" the classes.
    Horne had suggested state officials have reason to suspect the district may be in the position to infringe on the law.

    "Margaret Dugan and I have worked for more than two years to get legislation passed to ensure that students are taught to be Americans and to treat each other as individuals, and not on the basis of their ethnic backgrounds," Horne said in an announcement about the request.

    "Though we are pleased the legislation passed, it is very unfortunate that it will not take effect until January of 2011. Margaret Dugan and I are asking the Tucson district to videotape the classes to provide evidence for an expected appeal to an administrative law judge, as to whether these courses violate H.B. 2281," he said.

    "The Ethnic Studies curricula that will be prohibited by law are designed to promote ethnic chauvinism and there is never a time or place for that in the classroom," Dugan continued. "The lessons divide students on the basis of their race and ethnicity, instead of promoting the fundamental American value that we are all individuals."

    Horne's recent letter to Carroll said that teachers and former teachers have reported the "whole inference and tone" of the "Raza Studies" was "anger."

    "(They taught students) that the United States was and still is a fundamentally racist country in nature, whose interests are contrary to those of Mexican-American kids," the letter said.

    "Individuals in this (Ethnic Studies) department are vehemently anti-Western culture. They are vehemently opposed to the United States and its power. They are telling students they are victims and that they should be angry and rise up," the letter continued.

    "A teacher describes how the TUSD administration intimidated him by removing him from his class, and calling him a 'racist,' even though he himself is Hispanic," it added.



    The state officials charged that Tucson "has hired a group of radical socialist activists who promote an anti-capitalist and anti-Western Civilization ideology. They use ethnic solidarity as their vehicle of delivery. A climate of outright intimidation has stopped many from standing up to this group for fear of being labeled racists. "

    Further, "Impressionable youth in TUSD have literally been reprogrammed to believe that there is a concerted effort on the part of a white power structure to suppress them and relegate them to a second-class existence. This fomented resentment further encourages them to express their dissatisfaction through the iconoclastic behavior we see – the contempt for all authority outside of their ethnic community and their total lack of identification with the political heritage of this country. "

    The letter also cited a statement from Augustine Romero of the district's Ethnic Studies program on a television interview about why the course uses the word "Raza."

    His response, according to the letter, was, "So that our students could recognize and connect to their indigenous side, just like the word 'dine' for the Navajo translates to 'the people,' like the word 'O'odham' for the Tohono O'odham translates to 'the people.' The word 'Yoeme' for the Yoeme people translates to 'the people.' It was an attempt to connect to our indigenous sides, as well as our Mexican side. "

    "This would appear," Horne wrote, "to us to be an admission, not only that the course violates the provisions of H.B. 2281, but that it was intended to do so by those who designed and implemented it."

    He wrote that he understands the district denies the charges and said the best course to determine the nature of the classes would be to record them.

    "Please consider this a formal request to video tape the Ethnic Studies courses, and in particular, the Mexican-American/Raza Studies course, in their entirety, in the coming semester. To protect privacy of students, the videos should focus on the teacher alone. The videos should be of all classroom hours, and not selected," Horne wrote.

    He said he expects that when the law takes effect after Dec. 31, the state will announce it is withholding 10 percent of its allocations for Tucson, as allowed under the law.

    The Mexican American Studies page on the Tucson school website boasts it advocates for curricula "that is centered within the Mexcian American-Chicano cultural and historical experience," and "promoting and advocating for social and educational transformation."

    According to a report in the Tucson Sentinel, one of the books in use for the classes has been "Occupied America: A History of Chicanos." The report also cited Tucson board president Judy Burns saying, "We don't teach all those ugly things they think we're teaching."

    Burns said there were no plans to end the program.

    The National Review reported when John Ward, a Tucson teacher "who saw his U.S. history course co-opted by the Raza Studies department," said students were being taught "that Mexican-Americans were and continue to be victims of a racist American society driven by the interests of middle and upper-class whites."

    Just when you thought you've heard every insane story imaginable about the Feds and illegals, along comes another to top the last. An illegal voted in a TN election in 2004, and perjured himself by stating in writing (a felony) that he was a citizen.

    So is he being deported? Going to jail?

    Uh, guess again.

    The Dept. of Homeland Insecurity, which KNOWS he voted illegally, is HELPING him try and purge his felonious record in order to smooth his path to citizenship! Is this the kind of person America wants as a citizen? Is this how you expect DHS to handle criminals?

    Obama Administration Hauls Arizona Before the UN Human Rights Council

    Apparently Barack Obama is not content to make a federal case out of his immigration feud with Arizona; he just made it an international one.

    The president’s first-ever report on U.S. human rights to the UN Human Rights Council contains a rich vein of offensive material. So far, one aspect has not been reported: our petty president used the situation to bash Arizona’s immigration law — and possibly transfer jurisdiction over the law from Arizona to the UN. Throughout the report, which sounds like an Obama campaign speech, the president discusses “the original flaw” of the U.S.

    Constitution, America’s tolerance for slavery, and his version of our long and despicable history of discriminating against and oppressing minorities, women, homosexuals, and the handicapped. After each complaint, he addresses how he is delivering us from ourselves, patting himself on the back for such initiatives as ending “torture,” promoting Affirmative Action, and passing health care legislation.

    In his section on “Values and Immigration,” he praised the Department of Homeland Security’s efforts to provide better medical care for detainees and increase “Alternatives To Detention” (e.g., letting them go). Then he turned to the one state that has had the temerity to stand in his way of fundamentally transforming the American electorate:
    A recent Arizona law, S.B. 1070, has generated significant attention and debate at home and around the world. The issue is being addressed in a court action that argues that the federal government has the authority to set and enforce immigration law. That action is ongoing; parts of the law are currently enjoined.
    On Obama’s command, Attorney General Eric Holder has sued the State of Arizona for passing a law that he criticized without reading, and which merely upholds federal law. (He gave sanctuary cities a pass.) He now threatens an additional lawsuit against Sheriff Joe Arpaio for “racial profiling” when arresting illegal immigrants near the Mexican border.

    Obama’s turns his skirmish with Jan Brewer from a states rights dispute into an international human rights cause. It also places Arizona’s law in the hands of the United Nations.

    The national report is but the first step of the international government’s review process. On November 5, the United States will be examined by a troika of UN bureaucrats from France, Japan, and Cameroon (an oppressive nation which is a member of the Organization of Islamic Conference).

    This trio will consider three items: Obama’s self-flagellating report, reports written about America by UN tribunals or international governing bodies, and testimony from NGOs with a pronounced anti-American bias. It will also consider “voluntary pledges and commitments made by the State,” such as suspending an Arizona state law.

    Then the French, Japanese, and Cameroon diplomats will draw up a plan of action for the United States to implement.

    Nations are re-examined every four years. The Human Rights Council looks for voluntary compliance. However, its website asserts, “The Human Rights Council will decide on the measures it would need to take in case of persistent non-cooperation by a State with the” World Body.

    When the Left cannot win at the ballot box (virtually every time), it overrules the people in the courts. Now that Obama is not sure he can prevail in the courts, he has overruled the American people by hauling Arizona and the two-thirds of Americans who support its law before the United Nations.

    State Department Submits to UN Human-rights Review for the First Time

    On August 20, for the first time in its history, the United States submitted an official report of its record on human rights to the Office of the UN High Commissioner for Human Rights. This survey of our Republic’s human-rights situation is known as the Uniform Periodic Review (UPR).

    The submission of the report is the second step in the UPR process. Next, a representative of our government will deliver a formal presentation of the report’s findings to the UN Human Rights Council in Geneva in November. The completion of the first two stages of the UPR process demonstrates the willingness of the Obama administration to subject the laws of the United States and those of the several sovereign states of which it is composed to the judgment of the world.

    The State Department’s official announcement of the inaugural submission of the United States to this review proudly proclaims, “The review ... has featured an unprecedented level of consultation and engagement with civil society across the country.” The roster of the “Civil Society Consultants” that participated in the collection of relevant human-rights data reveals the report's bias and the underlying purpose of the procedure.

    Nearly a dozen conferences were held throughout the country from January to April. The attendees (and thus the chief contributors to the descriptions and suggestions forming the core of the UPR report) included many of this nation’s top-shelf globalists. Among them were Stephen Rickard and Wendy Patten of George Soros’ Open Society Institute, a worldwide foundation devoted to spreading “democracy”; Devon Chaffee from Human Rights First, a New York-based group that for over 30 years has pressed the U.S. government to acquiesce to the UPR process; Andrea Prasow from Human Rights Watch; Imad Hamad, a man who in 2003 was selected by the FBI to receive its Exceptional Public Service Award (the FBI caved to pressure from Israel and did not give Hamad the award) once praised a Palestinian Authority TV Sesame Street-style program that encourages Palestinian children to kill Jews and Christians and recommends they serve Allah by becoming suicide bombers. In the disturbing production, a young Palestinian boy sings, “When I wander into Jerusalem, I will become a suicide bomber.” Another song: “How pleasant is the smell of martyrs ... the land enriched by the blood, the blood pouring out of a fresh body.” Hamad, Lebanese-born Palestinian, called the program “patriotic”; Dawud Walid of the Council American Islamic Relations (CAIR), whose Los Angeles branch leader blogged about his “admiration” for suspect al-Qaeda associate Anwar al-Awlaki; Ron Scott, from the Detroit Coalition Against Police Brutality; Osama Siblani, from Arab American News; Shannon Minter, of the National Center for Lesbian Rights, a group that has published guidelines for radical sex-ed classes in elementary and secondary schools in order to “prevent harassment on the basis of real or perceived sexual orientation and gender identity;” and Cynthia Soohoo from the Center for Reproductive Rights.

    With buskers like these in the band, is it any question what tune they sang in their showcase performance for the United Nations?

    In the digest of the human-rights condition of the United States, these authors wrote that they wanted to provide a “snapshot of the current human rights situation in the United States, including some of the areas where problems persist in our society.” It should come as no surprise that one of the “problem areas” pointed to in the report is the “plight” of immigrants, particularly in Arizona since the passage of S.B. 1070, the law aimed at eliminating the flow of crime and criminals across the southern border. Given the bent of the contributors to the UPR report, one would assume they would gleefully welcome the oversight of the United Nations into the laws of Arizona or any other sovereign state with the audacity to protect its borders.

    President Obama ratified the coalition’s assessment of S.B. 1070’s effect on human rights. The UPR report declares, “President Obama remains firmly committed to fixing our broken immigration system” and to work “with fellow members of the Human Rights Council.” In light of the President’s commitment to cooperate with the Human Rights Council, it should be noted that the final step on the path to UPR fulfillment is the “voluntary compliance” with the recommendations of that body.

    The State Department brags about the UPR report recently submitted by the United States. In fact, the 29-page report expresses the hope that the United States “will serve as an example for other countries on how to conduct a thorough, transparent, and credible UPR presentation. Undoubtedly other countries will follow suit, but the United States was beaten to the head of the UN human rights parade by such legendary palladiums of human-rights as China, Iran, and North Korea, all of whom have already handed in their reviews.

    From the first page of the report, the preparers make mention of our nation’s founding document, the Declaration of Independence, and the Constitution that put flesh on that skeleton of the first principles of liberty.

    Paragraph 1 of Section 1.1 of the report reads:

    The story of the United States of America is one guided by universal values shared the world over — that all are created equal and endowed with inalienable rights. In the United States, these values have grounded our institutions and motivated the determination of our citizens to come ever closer to realizing these ideals. Our Founders, who proclaimed their ambition “to form a more perfect Union,” bequeathed to us not a static condition but a perpetual aspiration and mission.

    The universality of the equal creation of and endowment of inalienable rights to all men is indisputable. The notion that somehow that premise logically gives rise to the conclusion that the United States is justified in imposing our interpretation of those beliefs at the point of a gun is ridiculous.

    And, as for the “mission” bequeathed to us by our Founders, if such exists, the goal of it must be the perpetuation of the limited government chained by the enumerated powers expressed in the Constitution as written by our Founders and not the building of an American empire with outposts in all the provinces of the world.

    Later in the year, the UN Human Rights Council will conduct a final audit of the current state of the promotion of human rights in the United States. Then, it will recommend a slate of necessary reforms to the laws of the United States.

    Between now and then, Americans have the opportunity through the periodic elections to be held in November to remove from office any legislator who favors the subjugation of our national and state sovereignty to the unelected, unaccountable, unconstitutional authority of the United Nations.

    GENEVA (Reuters) - United Nations human rights experts added their voices to criticism of a new immigration law in Arizona, saying it may lead to police targeting people on the basis of ethnic origin, a violation of international law.

    In a joint statement, five independent U.N. experts expressed concern that Hispanics could be subject to discriminatory treatment in the border state.

    "The law may lead to detaining and subjecting to interrogation persons primarily on the basis of their perceived ethnic characteristics," they said.

    "In Arizona, persons who appear to be of Mexican, Latin American or indigenous origin are especially at risk of being targeted under the law."

    The U.N. experts decried a "disturbing pattern of legislative activity hostile to ethnic minorities and immigrants" in Arizona, which passed the United States' toughest immigration law last month.

    The Arizona law requires police to determine if people are in the country illegally, previously a function carried out by U.S. federal immigration police and some local forces.

    Critics of the law argue it is unconstitutional and a mandate for racial profiling, and fear it will destroy trust between Hispanic communities and law enforcement in Arizona.

    Supporters say the law is needed to curb crime in the state, home to 460,000 illegal immigrants and a major corridor for drug and migrant smugglers from Mexico.

    The U.N. experts voiced concern at the "vague standards and sweeping language" of Arizona's law, saying it raised "serious doubts about the law's compatibility with relevant international human rights treaties to which the United States is a party."

    "States are required to respect and ensure the human rights of all persons subject to their jurisdiction, without discrimination," they said.They urged authorities in Arizona and the federal government to "take all measures necessary to ensure that the immigration law is in line with international human rights standards."

    They cited the International Convention on the Elimination of All Forms of Racial Discrimination (CERD), a 1966 treaty ratified by the United States under the Clinton administration.

    President Barack Obama said last week he wanted to begin work on immigration reform this year and that U.S. officials would monitor the Arizona law for civil rights implications.

    The U.N. experts report to the U.N. Human Rights Council, a Geneva forum whose 47 members include the United States. Their mandates cover human rights of migrants, indigenous people, minorities, contemporary forms of racism and cultural rights.

    Obama administration reports to the UN on human rights issues in U.S.

    Under the administration of Barack Hussein Obama, the United States submitted its first ever “Universal Periodic Review (UPR) report” to the United Nations.

    This is the first time in the history of the United Nations that the U.S. has submitted a report to the United Nation’s Human Rights Council, which is the first step in submitting the United States to international review by some of the most repressive and abusive nations in the world.

    The report is the product of about a dozen conferences held across the U.S. between January and April 2010.

    The participants of these conferences featured such luminaries as Stephen Rickard and Wendy Patten, from George Soros’ Open Society Institute; Devon Chaffee, Human Rights First; Andrea Prasow, Human Rights Watch; Imad Hamad (a suspected member of the Popular Front for the Liberation of Palestine (PFLP), a Marxist-Leninist terrorist organization), American-Arab Anti-Discrimination Committee; Dawud Walid, Council American Islamic Relations; Nabih Ayad, Michigan Civil Rights Commission; Ron Scott, Detroit Coalition Against Police Brutality; Osama Siblani, Arab American News; Shannon Minter, National Center for Lesbian Rights and Cynthia Soohoo, Center for Reproductive Rights, among others.

    According to its authors, the report to the United Nations “gives a partial snapshot of the current human rights situation in the United States, including some of the areas where problems persist in our society.”

    Obviously, one of the “problems” identified with the report is illegal immigration and Arizona’s own initiate to solve the problem through state legislation. SB 1070 has been a particularly thorny issue to the Obama administration, which has now been moved to an international venue and potential international oversight by the United Nations.

    The stakes for our national sovereignty have been just raised by the submission of this document, which is the first step of “voluntary compliance” to the provisions of the United Nations’ Human Rights Council.

    It is no surprise that the report is dripping with the all too familiar “blame America first” rhetoric that has been the gold-standard of “citizen of the world” Barack Hussein Obama. The report promises that “President Obama remains firmly committed to fixing our broken immigration system…” and promises to work “with fellow members of the Human Rights Council.”

    Taking counsel from the list of individuals and organizations, some who have openly called for the subjugation of our country to the United Nations and supported our enemies, while engaging in self-flagellation before an international body of dubious distinction… it’s the “gold-standard” of Barack Hussein Obama.

    Brewer condemns report to UN mentioning Ariz. law

    PHOENIX – Arizona Gov. Jan Brewer demanded Friday that a reference to the state's controversial immigration law be removed from a State Department report to the United Nations' human rights commissioner.

    The U.S. included its legal challenge to the law on a list of ways the federal government is protecting human rights.

    In a letter to Secretary of State Hillary Clinton, Brewer says it is "downright offensive" that a state law would be included in the report, which was drafted as part of a UN review of human rights in all member nations every four years.

    "The idea of our own American government submitting the duly enacted laws of a state of the United States to 'review' by the United Nations is internationalism run amok and unconstitutional," Brewer wrote.

    Arizona's law generally requires police officer enforcing other laws to investigate the immigration status of people they suspect are illegal immigrants.

    Critics say it would lead officers to target Hispanics. Supporters, including Brewer, say the law prohibits racial profiling and other human rights abuses.

    The U.S. Justice Department sued to block the measure, arguing federal law trumps the state's authority to enforce immigration laws.

    A federal judge in July sided with the Justice Department and blocked enforcement of the law's most controversial provisions a day before it was scheduled to take effect.

    In its report, the State Department does not specifically allege that Arizona's law would lead to racial profiling.

    "A recent Arizona law, S.B. 1070, has generated significant attention and debate at home and around the world," the report says. "The issue is being addressed in a court action that argues that the federal government has the authority to set and enforce immigration law. That action is ongoing; parts of the law are currently enjoined."

    A State Department spokesman had no immediate comment on Brewer's letter.

    Brewer, a Republican, is running for election in November. Her popularity in Arizona and her national profile have soared since she signed the immigration measure in April.

    After turning NYC over to the Islamists and leftist sympathizers, via endorsing their 9/11 Victory Mosque (any Muslim project called “The Cordoba Initiative” has to be just that), Dictator-in-Chief Obama believes that he has found the way to both destroy opposition to his Orwellian plans for the former United States of America and introduce our country’s final demise.

    For attempting to do that which the Obama refuses to do (his job under the US Constitution--not George Soros and friends), the tyrant has now turned Arizona and the twenty-two other US States trying to protect their citizens over the patently corrupt (Obama’s kind of organization) United Nations as “human rights violators.” Now disregarding the US Constitution and US law entirely--and getting away with it--The Obama and his worldwide anti-US Marxist minions have begun to divvy up the booty from that which was once America. Note: Despite our protests and marches, Obama believes he silenced We-the-People long ago.

    Didn’t Hugo Chavez affect something similar in Venezuela? But, let’s face the truth, folks. Even Chavez didn’t try to destroy his own country. But, considering his true birth place, neither did Obama.



    In his boldest move yet to destroy our country, Dictator-in-Chief Obama has now decided to bring the full force of the world against those who oppose their own slavery at his and his masters’ hands. And the overseers at the United Nations are applauding The Obama’s move.

    As the people of the United States of America are--in greater and greater numbers each and every day--supporting Arizona and other states for working to protect US citizens from the now unstopped marching phalanges of illegal immigrants composed of drug cartel members, Central American gangs, Hezbollah, other middle eastern terrorists and millions of others who sap the resources of sovereign States (entering via our southern border), the tyrant believes he has found a way to stop the States and us.

    Now “elevating” himself to the level of an Islamic Mufti, Obama has effectively issued a fatwa against Arizona and every other US State that opposes their own demise. Obama has issued an, heretofore, unprecedented report to the “UN High Commissioner for Human Rights” (a bad joke considering the organization itself) outlining his carefully crafted and manufactured ‘horrors’ the USA has committed against humans (I suspect that means freedom and liberty are two of them), he has given full sway to the UN to go after any US States that do not comply with the tyrant’s (and soon to be King of the World?) commandments. Suffice it to say, the UN is more than pleased to do so!



    Replete with its proclamations for perversities of all kinds, in order to support any and all fully suppressive and exploitative totalitarian regimes (as long as it gets a substantial piece of the action), the UN is more than willing to go follow The Obama’s “requests.”

    This latest perversion of law by The Obama is, yet, another patent treasonous action against the USA. Each and every day, he is racking up more and more of them. Then, without a care in the world save how to better give his union thugs and other countries funds stolen from the US taxpayer (where lots of our “stimulus” dollars ended up) and then frivolously wasting and spending what’s left, he and his family are now working to establish the record of “most vacations taken while occupying the US White House--and still being able to destroy the country.” I suspect that record will never be broken--but, if he isn’t removed, the country will.

    In November 2010, if we do not take back at least the House of Representatives we will have no chance--whatsoever--of surviving the beast and its minions. But, even worse, if we don’t get rid of said beast our destruction is also assured. If we can rid ourselves of both--and restore our Republic--we must for all time say “Never Again” to tyranny and all would-be tyrants. We cannot and must not allow this to happen to our country, our loved ones and us even one more time…never. This time, we must remember.
